
Court appoints Receiver for Sussman Mortgage Funding Inc. Français
FSRA applied to appoint a receiver in response to allegations of serious wrongdoing and multiple legal proceedings by mortgage investors. A receiver can ensure that SMFI's affairs are managed in the best interests of all of its investors. BRF will report to the Court before June 2, 2025.
SMFI was licensed with FSRA as a mortgage brokerage and mortgage administrator. As of March 31, 2025, SMFI had no licensed brokers, and its brokerage licence was suspended. FSRA has since revoked the mortgage brokerage and administrator licenses of SMFI.

FSRA revokes the licence of Expert Financial Corporation and imposes administrative penalties on Expert Financial Corporation, Upanshuman Pandey and Varinder Singh Virk Français
TORONTO, July 25, 2025 /CNW/ - Ontario's financial services regulator, FSRA, has revoked the mortgage brokerage licence of Expert Financial Corporation ("Expert Financial") and imposed administrative penalties on Expert Financial in the total amount of $36,000. FSRA has also imposed administrative penalties in the total amount of $32,000 on Upanshuman Pandey ("Pandey") and an administrative penalty of $2,000 on Varinder Singh Virk ("Virk"). Pandey was the Principal Broker of Expert Financial. His broker licence expired in March 2025. Pandey and Expert Financial facilitated Nasir Syed Zaidi Hussain ("Hussain") in holding himself out as a mortgage agent and conducting unlicensed mortgage business. Hussain met with clients, collected supporting documents, and passed the information to Pandey. Pandey would then submit the mortgage applications and split the brokerage fees with Hussain as commissions. Hussain did not request a hearing, and FSRA imposed orders against him. "Licensees must not facilitate activities for unlicensed individuals," said Elissa Sinha, Director of Litigation and Enforcement at FSRA. "We will act decisively to ensure that consumers are advised by individuals who are properly licensed, and meet legal and professional standards." Pandey breached the Act as follows: Facilitated the illegal holding out and unlicensed activity of a non-licensee contrary to section 3.1 of O. Reg 187/08; Failed to take sufficient steps to verify the identities of borrowers, which caused Expert Financial to violate section 10 of O. Reg 188/08, contrary to section 3 of O. Reg 187/08; Failed to ensure that Expert Financial met its record-keeping obligations, contrary to section 2 of O. Reg 410/07; and Provided false and misleading statements to FSRA on Expert Financial's Annual Information Returns with respect to the lack of referrals and complaints, contrary to section 45 of the Act. Expert Financial facilitated the illegal holding out and unlicensed activity of a non-licensee contrary to section 14.2 of O. Reg.188/08 and failed to maintain complete and accurate records from a borrower, contrary to section 46 of O. Reg. 188/08. Virk dealt in mortgages for remuneration outside of his mortgage brokerage contrary to section 2(3) of the Act. FSRA issued these orders as a result of settlements with Expert Financial, Pandey and Virk. FSRA issues notice of proposal against 2748204 Ontario Inc. operating as Flex Home Loans and against Michael Yosher Français
TORONTO, July 4, 2025 /CNW/ - Ontario's financial services regulator, FSRA, has initiated enforcement action against 2748204 Ontario Inc. operating as Flex Home Loans (Flex Home Loans) and Michael Yosher (Yosher). FSRA alleges that Flex Home Loans' and Yosher's conduct affords reasonable grounds for belief that Flex Home Loans will not administer mortgages in accordance with the law and with integrity and honesty because Flex Home Loans and Yosher contravened the Mortgage Brokerages, Lenders and Administrators Act, 2006 (Act) and its regulations as follows: by carrying on business as a mortgage lender in Ontario while not being licensed or exempted from the requirement of being licensed, contrary to section 4(2) of the Act; and by including false or misleading information in renewal applications, contrary to sections 45(1) and 45(2) of the Act. FSRA is proposing to issue a compliance order requiring Flex Home Loans and Yosher to cease and desist from the business of mortgage lending, to inform the investors of Flex Home Loans of its licence revocation and to either facilitate the investors in finding a new mortgage administrator or to facilitate the investors administering their investments themselves. FSRA seeks to revoke the mortgage administrator licence of Flex Home Loans 31 days after the compliance order takes effect, and to impose an administrative penalty of $10,000 against Yosher. Flex Home Loans and Yosher have requested a hearing before the Financial Services Tribunal about this proposal. FSRA grant funding applications for financial education and research now open TORONTO, June 26, 2025 /CNW/ - Ontario's financial services regulator, FSRA, is supporting financial literacy and better protecting consumers through its second annual proceeds from enforcement grant application program. "Now in our second year, the FSRA grant funding program will make bigger strides in helping consumers better understand the financial services they use each and every day," says Stuart Wilkinson, Chief Consumer Officer at FSRA. "If you have a good idea, whether that's an education initiative or research project, check out the program to see if you qualify." Not-for-profit organizations can now apply to access money FSRA collects through enforcement actions to fund educational initiatives and research. The proceeds from enforcement grant funding is also open to proposals from within FSRA.
