
Gold mining graft: Ex-CEO, two children discharged

KOTA KINABALU (Apr 24): The Special Corruption Court on Thursday discharged a 69-year-old former CEO and his two children in a case involving cheating and forged documents linked to alleged gold mining activities. The discharge does not amount to an acquittal.
Judge Jason Juga granted the order for Datuk Lo Fui Ming, his son Lo Teck Yong, 43, and daughter Lo Choon Fung following a request by the prosecution, which cited new developments in the case.
The court also directed the return of their international passports and the refund of their bail.

Fui Ming, formerly the CEO of a company, and his son, an ex-director of the same firm, were accused of cheating the Sabah government namely the Department of Lands and Surveys, by allegedly failing to report gold bar quantities and illegally selling them to a private company causing financial losses to the state between 2019 and 2023.
Fui Ming faces 24 charges under Section 418 of the Penal Code for cheating, with knowledge that wrongful loss may ensue to a person whose interest the offender is bound to protect while Teck Yong is charged with 24 counts of abetment.
Additionally, Fui Ming and his daughter jointly face four counts of using forged documents namely, letters under a company's name dated March 3, 2020, December 10, 2020, October 13, 2021 and January 3, 2022.
Counsel Zahir Shah represented the trio, while Norbert Yapp appeared as a watching brief for a related company.

Cop charged with fatally shooting man gets July 9 court mention date
KUCHING: The Magistrate's Court has fixed July 9 for mention of a case involving a Bukit Aman traffic policeman charged with causing the death of a man along Jalan Stephen Yong. Magistrate Ling Hui Chuan allowed the application by police prosecuting officer Insp Nur Shafiqa Nyaie Ilin for the accused, Lance Corporal Genesis Nitchell David Reddy, 30. Genesis was represented by lawyers Russel Lim and Brenden Ting from the National Legal Aid Foundation. Earlier, the court was informed that the prosecution had yet to receive the ballistics report, chemical analysis on gunshot residue and DNA, as well as the full post-mortem report on the deceased. Genesis, 30, from Kampung Semaba, is charged with the murder of Muhammad Zaki Iderus, 34, who was fatally shot while inside a vehicle on April 26. He was charged under Section 302 of the Penal Code, which carries the death penalty or imprisonment for between 30 and 40 years, and not less than 12 strokes of the cane, upon conviction. On May 7, the police officer was charged in court but no plea was recorded as the murder charge falls under the jurisdiction of the High Court. On April 26, Padawan police chief Supt Mohd Irwan Hafiz Md Radzi was reported as saying that two men had arrived at the Batu Kawa police station at around 5.30am to report that their companion had been shot. Kuching man caught with kiddie porn on smartphone fined RM5,000

Magistrate Mason Jaro Lenya Barayan convicted Terence Sim on his own guilty plea to a charge framed under Section 292(a) of the Penal Code. The Section provides for a penalty of imprisonment for up to three years in prison, or a fine, or both upon conviction. Sim was charged with committing the offence on Jan 27 at approximately 12.30pm at a house here. According to the facts of the case, police conducted an inspection of Sim following information received concerning the possession of child pornography. The investigation confirmed that such content was found on his smartphone. Sim was subsequently arrested and his smartphone, together with the SIM card, was seized by the authorities. As the device was in his possession at the time of the inspection, the court held that he had committed an offence punishable under Section 292(a) of the Penal Code. EAIC Refers AADK Drug Release Case to Public Prosecutor
PETALING JAYA: The Enforcement Agency Integrity Commission (EAIC) has concluded its investigation into allegations that National Anti-Drugs Agency (AADK) officers in Negeri Sembilan released drug addicts who tested positive during an operation two years ago. The commission had received a complaint alleging that AADK officers neglected their duties by releasing several individuals who tested positive for drug abuse during a raid at Kampung Felda LBJ, Labu, Negeri Sembilan, on March 8, 2023. The EAIC stated that this alleged act constitutes an offense under Section 211 of the Penal Code. 'EAIC decided to refer the investigation's findings to the public prosecutor in accordance with subparagraph 30(1)(c) of Act 700,' read the commission's statement. In addition to the referral for potential prosecution, the EAIC has also forwarded findings related to disciplinary offenses committed by the involved AADK officers to the Disciplinary Authority. This comes 'along with a recommendation for disciplinary action under subparagraph 30(1)(b) of Act 700.'
