Q&A: What are the new online safety regulations that Big Tech is unhappy about – and will they work?

, the State's media regulatory body, is hoping to address unique issues posed to young people, and society at large, when it comes to online media consumption. 'The era of self-regulation in the tech sector is over,' they say, and propose the new Online Safety Code to affirm this.
Set to come into effect this Monday, it's yet to be seen whether these new rules will have their desired outcome, although they have already ruffled the feathers of

, formerly Twitter, which
launched High Court action on the State body's supposed 'regulatory overreach'

Q: What is the
Online Safety Code?
A:
It's a lot to digest. The nearly 10,000-word document proposes various regulations on our online media consumption. It targets the service providers themselves – say, TikTok, Instagram, Facebook, YouTube, X, for example – in the hope of holding them 'accountable for keeping their users, especially children, safe online', Coimisiún na Meán says.

It works off the back of laws passed by the Dáil in 2022 as well as the
EU Digital Services Act
and the EU Terrorist Content Online Regulation. Needless to say, it is vast in scope although, at times, sparse in detail.
It uses words like 'audiovisual commercial communications' and 'indissociable user-generated content', which simply mean ads and comments under those ads. And super obvious acronyms like VSPS ('video sharing platform services'; think, any social media).
Q: What problems does it hope to solve?
A:
Many. In three words: algorithms, influence and ads. The code makes particular reference to children's online safety, and wants to protect them from content that would negatively impact their physical, mental, and even moral development. As Coimisiún na Meán sees it, this is most easily achieved through imposing restrictions on access to 'adult-only video content, including pornography and gross or gratuitous violence'.
They want to crack down on advertisements directed explicitly towards children, and even those that urge children to pester their parents to buy the product or service being advertised. This practice exploits 'the special trust children place in parents, teachers or other persons', according to the code.

More broadly, it places the onus on the
social media platform
to protect their users from content that constitutes incitement to hatred or violence against a protected group, displays of criminal offences under EU law, encourages self-harm or suicide, or glorifies an eating disorder
Q: And how will they do this?
A:
This is where things get a bit tricky. Coimisiún na Meán has put forward suggestions. However, the new regulations simply mandate that social media platforms implement their own measures to ensure child safety on their platforms. The code hones in on the use of effective age verification strategies to ensure minors cannot access adult content online.
'An age assurance measure based solely on self-declaration of age by users of the service shall not be an effective measure for the purposes of this section,' the code sets out clearly, meaning people will no longer be able to just tick a box saying they're over 18. This is a big change in the digital landscape, as previously you only had to say you were 18 to access over-18 content, never having to prove it.
The code further asks social media platforms that allow adult content to be uploaded on their site to establish an 'easy-to-use, user-led content rating system'. This should allow for content to be flagged as adult-only and unsuitable for children, who otherwise could access the content on the site.
It makes an interesting caveat that violent and distressing imagery can be uploaded to the sites, but only for the advancement of civic discourse in the public interest. They introduce a nuance that this be allowed only 'provided such content cannot ordinarily be seen by children'.

Q: Will the new rules actually work?
A:
We don't know yet. With suggestions instead of mandates, it will rely on the innovation and willingness of big tech firms to comply with standards that most people believe to be necessary to keep kids safe online.
Managing director of Data Compliance Europe Simon McGarr takes issue with a letter to The Irish Times written by Coimisiún na Meán executive chairperson Jeremy Godfrey in January. In it, he writes that it is up to social media platforms to choose how to enforce their rules, and 'uploading documents and/or a live selfie is one such technique, when accompanied by appropriate privacy protections'.
Q: Why are the big tech firms unhappy?
A:
Comisiún na Meán is contesting a case lodged in the High Court by X, formerly Twitter, which says the new code amounts to 'regulatory overreach' on private companies from the State body. X says the requirements are 'broadly framed' and may threaten freedom of speech by banning content that is unsavoury but legal.
It makes the point that current EU regulations draw a distinction between illegal content, such as incitement to hatred, and harmful content, such as encouragement of self-harm.

The Social Democrats has lifted the suspension of Eoin Hayes, saying the TD deserves a 'second chance' The Dublin Bay South TD was suspended by the party last December after it emerged that he did not sell his shares in Palantir – a company that has supplied software and technology to the Israel Defense Forces – until a month after he was elected as a Dublin city councillor last June. This contradicted information he had previously given that he had sold the shares in the company, where he worked from 2015 to 2017, before he entered politics. 'Eoin has been suspended from the parliamentary party for nearly eight months and I believe he should be given a second chance,' Cian O'Callaghan, the acting Social Democrats party leader, said. Mr Hayes has once again apologised for giving incorrect information about when he divested his shares in Palantir, and for keeping shares in the controversial company linked with the Israel Defense Forces for as long as he did. Commenting on his return to the party, Mr Hayes said 'at the outset' that he wants to give 'a full and unequivocal apology for giving the incorrect information to the media about when I divested from Palantir.' 'I also want to be clear that I should not have held the shares for as long as I did,' he said. 'For that reason, I have donated $51,000 to three humanitarian organisations active in Gaza – split between, Unrwa, Unicef and Doctors without Borders. This figure represents the uplift in share price, less applicable taxes, from October 7 2023 to July 26 2024, when I sold the shares. 'I know I have let people down and I am determined to work hard and earn back people's trust.' Mr Hayes was one of 11 Social Democrats TDs who won a seat in last November's General Election. By December, before the Dáil had even sat, Mr Hayes was suspended from the party with 'immediate effect' after providing incorrect information about when he sold the shares to the media. In February, the Social Democrats decided to extend Mr Hayes suspension following a review by the party's national executive. The review had decided to endorse the decision of the parliamentary party to indefinitely suspend Mr Hayes.

Trump and von der Leyen to meet in effort to land trade deal

European Commission president Ursula von der Leyen and United States President Donald Trump are to meet in Scotland on Sunday, in an effort to get a deal on tariffs over the line. The planned meeting followed a phone call between the head of the EU's executive and the US president, after several days of intense negotiations between officials to hammer out an agreement that would head off a trade war. 'We have agreed to meet in Scotland on Sunday to discuss transatlantic trade relations and how we can keep them strong,' Dr von der Leyen said in a post on X. EU negotiators have been pushing to finalise a deal that would avert higher rates of import duties which Mr Trump has threatened on goods coming from Europe. READ MORE Speaking before departing for a golf trip to Scotland, Mr Trump said there was a '50-50″ chance a deal would be agreed. 'I would say that we have a 50-50 chance, maybe less than that, but a 50-50 chance of making a deal with the EU,' Mr Trump told reporters on Friday. The US president said negotiators from both sides were working 'closely' together. 'I think the EU has got a pretty good chance of making a deal,' Mr Trump said. The current outline of a draft agreement would see the EU accept blanket tariffs of 15 per cent on future trade with the US, up from a 10 per cent levy Mr Trump introduced in early April. Speaking earlier on Friday, Taoiseach Micheál Martin said an EU-US tariff deal would 'hopefully be signed off before the weekend is over.' Work was continuing to get a 'framework agreement' over the line, which would comprise the broad outline of a tariff deal, allowing further details to be worked out later. The EU is also seeking to have higher 25 per cent tariffs the US has put on EU-made cars to be reduced to that rate. National governments appear willing to stomach an across-the-board tariff of 15 per cent, to end the uncertainty Mr Trump's threats of potentially much higher levies has caused the European economy, or an escalating trade war if no deal is agreed. 'There has been a degree of volatility in all of this, which has been unsettling for investment and that's a concern I have,' Mr Martin said. The EU wanted to secure some 'certainty' around US tariffs targeting specific sectors, outside of the blanket rate, he said. The EU was not anxious to have to turn to possible retaliation, such as counter-tariffs on US products, he said. Speaking in Luxembourg, the Fianna Fáil leader said he hoped 'sense will prevail' in the ongoing negotiations concerning pharmaceutical products. The sector has avoided US tariffs to date, though Mr Trump previously promised they are coming in a bid to force companies to relocate manufacturing capacity and jobs to the US. Getting a deal on pharma products was 'of equal significance' to the US side, he said. Any 'significant disruption' of the heavily intertwined pharma supply chains would be damaging to the US, and potentially lead to shortages of medicines, Mr Martin said. Access to the European market had been of huge benefit to US pharma multinationals, he said. 'It's a two-way street ... unilateral action on the part of one [side] could ultimately damage the companies themselves and patients and consumers,' he said. Europe had to look at what it could do to increase trade within the bloc, to compensate for the knock-on impact of US tariffs on transatlantic trade, he said.

EU chief to meet Trump in Scotland for trade talks

European Commission President Ursula von der Leyen said she will meet with US President Donald Trump in Scotland this weekend to address the EU-US tariffs standoff, with a week to go until the 1 August negotiating deadline. "Following a good call with @POTUS, we have agreed to meet in Scotland on Sunday to discuss transatlantic trade relations, and how we can keep them strong," Ms von der Leyen wrote on X. Earlier, Mr Trump said there was a "50-50 chance" that the United States would reach a trade agreement with the European Union. He was speaking before he left the White House to head to Scotland for several days of golfing and bilateral meetings. Taoiseach Micheál Martin has said he hopes a framework trade agreement between the European Union and the United States can be "signed off before the weekend is over". Speaking in Luxembourg, Mr Martin said he would "welcome an end to the uncertainty" around the trade dispute between the bloc and the US. "The agreement will be a headline framework agreement," he said, adding that there will be detailed discussions afterwards in respect of many products. "I know there are intensive discussions ongoing and the reason for the intensity of those negotiations is to try to tie up as much as we can, and get certainty around the sectoral tariffs," said Mr Martin. "The European Union is not anxious for a retaliatory scenario, is not anxious to engage in a trade conflict with the United States." A 'critical moment' Tánaiste Simon Harris has said the EU and US have reached a "critical moment" in terms of their trade and tariffs talks. While saying he remains "cautiously optimistic that a deal can be reached", the Minister for Foreign Affairs and Trade said we are now at a "critical" stage and that it is "long past time to strike a deal". In a statement, the Tanaiste said: "Over recent weeks, the EU has been engaged in intensive negotiations with the US to try and bring about an outcome that avoids unnecessary trade barriers. "We have been calm and measured in our response and as we approach the deadline for the talks I will continue to engage with the European Commission and other member states. "EU unity at this moment is critical as is reaching a deal that allows for the mutually beneficial trading relationship with the US to continue. €300m for water infrastructre projects The European Investment Bank is to provide a new €300m loan for water infrastructure projects in Ireland. The announcement was made this morning after a meeting between the Taoiseach and President of the EIB Nadia Calviño in Luxembourg. Mr Martin, attending a signing ceremony for the new loan at the EIB, said the bank was a "key partner for transformational investment across Ireland". He said the new investment will help Uisce Éireann to upgrade vital water infrastructure and that the loan aligned with the Government's new National Development Plan, announced earlier this week. The loan, signed in cooperation with the National Treasury Management Agency, is designed to enhance water security by extending water supply infrastructure and upgrading wastewater treatment plants. It also includes investments in stormwater drainage facilities to future-proof against more extreme periods of rainfall. Chris McCarthy, the chief financial officer of Uisce Éireann, said the investment will accelerate the development of Ireland's critical water services infrastructure. In recent years, the EIB has provided approximately €1 billion annually for public and private investment in water, housing and energy projects in Ireland.
