Vietnamese American salon owners sue California alleging labor code is discriminatory

Several Vietnamese American-owned nail salons in Orange County have sued California, alleging the state's labor code is discriminating against their businesses.
The lawsuit, filed in U.S. District Court in Santa Ana on Friday, alleges that the state's labor code violates the 14th Amendment's guarantee of equal protection under the law by forcing nail technicians to be classified as employees.
The suit argues that professionals in the beauty industry for years have operated as independent contractors, renting space in a salon and bringing in their own clients. That changed at the beginning of 2025, when nail technicians in the labor code became required to be classified as employees, the lawsuit said.
California Assemblyman Tri Ta (R-Westminster), who represents Little Saigon and surrounding communities, said his office has fielded much concern from Vietnamese American nail salon owners.
"Their lives have turned upside down overnight," Ta said at a news conference Monday morning. "It is not just unfair, it is discrimination."
The switch in labor law came back in 2019, when a sweeping law governing worker classification rules across various industries called Assembly Bill 5 was approved - a law that codified a California Supreme Court decision creating a stricter test to judge whether a worker should be considered an employee rather than an independent contractor.
AB 5 sought to crack down on industries where many workers are misclassified as independent contractors, who are not afforded protections including minimum wage, overtime pay and workers' compensation that employees have access to. But various industries have said AB 5 targets them unfairly, creating an uneven playing field for businesses.
Some professions received carve-outs, including doctors, accountants, real estate agents and hairdressers; while others such as truckers, commercial janitors and physical therapists must abide by the tighter classification rules.
Some implementation of the law was staggered to give industries, including nail technicians, time to adapt.
The lawsuit describes how the nail salon industry in California became dominated by Vietnamese workers in recent decades, when Vietnamese refugees began fleeing to the U.S. in large numbers in 1975 after the fall of Saigon in America's failed military intervention in Southeast Asia.
The industry "has become synonymous with the Vietnamese community," the lawsuit said, with more than 82% of all nail technicians in California being Vietnamese American, and some 85% women.
The businesses that filed suit include multiple locations of Blue Nail Bar, Happy Nails & Spa and Holly and Hudson Nail Lounge.

Bolsonaro is being prosecuted on charges of conspiring to overturn his 2022 election loss. In his order Monday, Justice Alexandre de Moraes ordered the house arrest of Bolsonaro on allegations he violated court-imposed precautionary measures by using the social media accounts of allies, including his three sons, one of whom is a congressman, to post statements online. Moraes described the social media posts as a "continued attempt to coerce the STF and obstruct justice." STF stands for Supremo Tribunal Federal, or Supreme Federal Court, in Portuguese. "The arrest is to be served at Bolsonaro's residence in Brasilia. He will not be allowed to receive visitors, except for his lawyers and other individuals previously authorized by the STF," the order states. "The former president is also prohibited from using a cell phone, either directly or through third parties." A search and seizure of any cell phones in Bolsonaro's possession was also ordered by Moraes, who is overseeing the criminal case. "There is no doubt that Jair Messias Bolsonaro violated the precautionary measures imposed on him, as the defendant produced material for publication on the social media accounts of his three sons and all his followers and political supporters, with clear content encouraging and inciting attacks on the Supreme Federal Court and openly supporting foreign intervention in the Brazilian judiciary," Moraes said. Trump, who has similarly been accused of trying to overturn his own election loss, in 2020, is an ally of Bolsonaro, and has repeatedly used his executive powers to punish those involved in the 70-year-old politician's prosecution, which has prompted accusations of meddling in Brazil's judicial system. Among the measures imposed by the American president are slapping a 40% tariff on Brazilian goods and sanctioning Moraes, as well as revoking his visas and those of his family. The U.S. State Department on Monday night condemned the house arrest order as Moraes' alleged continued use of "Brazil's institutions to silence opposition and threaten democracy." "Putting even more restrictions on Jair Bolsonaro's ability to defend himself in public it not a public service. Let Bolsonaro speak!" the State Department's Bureau of Western Hemisphere Affairs said in both English- and Portuguese-language statements. "The United States condemns Moraes' order imposing house arrest on Bolsonaro and will hold accountable all those aiding and abetting sanctioned conduct." Brazil charged Bolsonaro in February with attempting a coup following his 2022 election loss to current President Luiz Inacio Lula da Silva. According to court documents, his supporters claiming voter fraud stormed Brazil's Congress and other federal facilities on Jan. 8, 2023. The indictment accuses Bolsonaro of spreading debunked claims of fraud in election machines as far back as July 2022 in order to prepare conditions for the coup. As part of the scheme, prosecutors said they even planned the possibility of assassinating Lula. Bolsonaro has denied wrongdoing, while Trump has described the trial as a "witch hunt."

The footage of the Israeli hostages has stirred condemnation. U.N. Secretary-General Antonio Guterres was 'very shocked' by the videos and 'this unacceptable violation of human dignity,' U.N. deputy spokesman Farhan Haq said. The videos were released as international experts say a 'worst-case scenario of famine' is unfolding in the coastal territory, where Israel's offensive has killed tens of thousands of Palestinians and made it nearly impossible to safely deliver food and other humanitarian aid. Images of starving Palestinians have drawn international condemnation of Israel's conduct. Families of the hostages fear that the lack of food threatens the remaining hostages, too. Fewer than half of the 50 remaining hostages are believed to be alive, the rest either killed during the October 2023 attack or while in captivity. Netanyahu said he was shocked by the images of the two hostages and met with the Red Cross to ask that it bring hostages food and medicine — access that the organization says has never been granted by Hamas. 'When I see these, I understand exactly what Hamas wants,' Netanyahu said on Sunday. 'They do not want a deal. They want to break us using these videos of horror.' The International Committee of the Red Cross said it was 'appalled by the harrowing videos' and called for access to the hostages. Hamas said it is ready to respond 'positively' to Red Cross requests to deliver food to hostages, if humanitarian corridors for aid deliveries are opened in a 'regular and permanent manner' in Gaza. It denied starving the hostages, saying they suffer from the same hunger as ordinary Palestinians. Braslavski said that in the video of his son, the captors appear to be well-fed. 'This hunger is on purpose, you can see that,' he said. 'It's not because we're not letting aid go in.' Israel has requested an emergency meeting of the U.N. Security Council on the hostages, which will take place on Tuesday. Israel's Foreign Minister Gideon Saar said he will travel to New York for the meeting. Israel did not allow any food, medicine or other goods to enter Gaza from early March until mid-May, when it eased its blockade on the territory of some 2 million Palestinians. The United Nations says nearly 1,400 Palestinians have been killed while seeking aid since then, mostly by Israeli forces as crowds head toward aid sites run by an Israeli-backed American contractor. The Israeli military says it has only fired warning shots. Gaza's Health Ministry said Monday that five more Palestinian adults died of malnutrition-related causes in the past 24 hours. A total of 87 adults have died of malnutrition-related issues since the ministry started counting such deaths in late June, it said. Ninety-three children have died of malnutrition-related causes since the war in Gaza began, the ministry said. Israel's government has denied that people are starving to death in Gaza. About 1,200 people, mostly civilians, were killed in the Hamas attack on southern Israel that sparked the war, and another 251 were abducted. Israel's retaliatory military offensive has killed more than 60,900 Palestinians, according to Gaza's Health Ministry. The ministry, which doesn't distinguish between civilians and combatants in its count but says women and children make up over half the dead, is part of the Hamas government and staffed by medical professionals. The U.N. and other independent experts view its figures as the most reliable casualty count. Israel has disputed the figures but hasn't provided its own.
