
Congress: SC report can't be used for impeachment of Justice Verma
NEW DELHI: Amid speculations that the Supreme Court inquiry into Justice Yashwant Verma may form the basis for the impeachment proceedings, Congress MP Vivek Tankha Thursday shot off a letter to Rajya Sabha Chairman Jagdeep Dhankhar flagging that the SC's inhouse report cannot be used for impeachment, and that due process under the Judges Inquiry Act would be required.

The view among the legal eagles in Congress is that moving on the SC probe would not stand the test of legality, contrary to the arguments that the use of the SC report would expedite the process of dismissing the judge. The view is also likely to be conveyed by the Congress to the government.
Senior lawyer and Congress MP Abhishek Singhvi said that investigation report of the apex court is merely the institution's practice in cases of professional misconduct, and cannot substitute the legal processes.
Singhvi said setting up a three-member inquiry committee, comprising a member of the Supreme Court, a high court chief justice and a distinguished jurist, is required under the Judges Inquiry Act. "The statutory three-member committee is a must. The in-house investigation is not statutory though it is must by the practice of SC. But it is a purely SC mechanism," he told TOI.
Tankha wrote to Dhankhar, "Impeachment is a very serious matter where we have to clearly spell out charges and, therefore, it cannot be based on TV debates, social media narratives or unverified clippings.
As an eminent legal luminary yourself, we are confident that you share our concern for the sanctity of the constitutional procedures."
While the govt has announced an intent to remove Verma through impeachment in the monsoon session and is consulting the political parties, the opposition or the Parliamentarians have not yet submitted a motion on the issue. This is unlike the case of Justice Shekhar Yadav of Allahabad High Court, who triggered a controversy by making "hate speech" over the uniform civil code.

55 opposition MPs from Rajya Sabha submitted a notice for his impeachment on December 13, 2024, but the RS is still to decide on it.
Tankha said he is not sure if the government wants to help Justice Verma or impeach him by initiating the impeachment process on the basis of the SC's inhouse probe report. "The SC inquiry was for the benefit of the Chief Justice of India and the court judges. But it does not form the legal material for the Parliamentarians to move the motion for impeachment," he argued.

Liquor scam: ED attaches Congress office in Chhattisgarh, assets of ex-minister
A Congress office in Chhattisgarh apart from assets of its former minister Kawasi Lakhma and his son have been attached as part of a money laundering investigation linked to an alleged Rs 2,100 crore worth liquor scam that took place in the state during the previous government, the ED said Friday. A provisional order for attaching these properties has been issued under the PMLA. The ED said in a statement that the attached assets include Congress Bhawan at Sukma district headquarters, which is in the name of Chhattisgarh PCC, a residential house at Raipur in the name of Kawasi Lakhma and a house at Sukma in the name of his son Harish Kawasi. The value of these three assets is `6.15 crore, it said. This is the first time that the federal probe agency has attached assets of a political party under the anti-money laundering law. A Congress spokesperson said in Raipur that the ED action was 'part of BJP's political conspiracy' and added that the party will furnish records of 'each and every' penny used for the construction of the office at Sukma.

ED attaches assets of former Rajasthan minister in JJM case
Assets worth over Rs 47 crore of various persons, including Congress leader and former Rajasthan minister Mahesh Joshi, have been attached in the money laundering case linked to alleged irregularities in the Jal Jeevan Mission in Rajasthan, the ED said on Friday. A provisional order was issued on Wednesday (June 11) under the Prevention of Money Laundering Act (PMLA) to attach the properties belonging to Padamchand Jain, Mahesh Mittal, Sanjay Badaya, Mahesh Joshi, Vishal Saxena and their family members/associate firms, the probe agency said in a statement. The agency did not specify the value of attachment for these persons separately. It said that the attached assets include agricultural lands, residential flats and houses. Joshi, 70, was arrested by the ED in this case in April. Sanjay Badaya, an alleged middleman, Mahesh Mittal, proprietor of Shree Ganpati Tubewell Company and Padamchand Jain, proprietor of Shree Shyam Tubewell Company, were arrested earlier in this case, along with one person named Piyush Jain. The money laundering case stems from an FIR of the state anti-corruption bureau (ACB) wherein it was alleged that Jain, Mittal and others were allegedly involved in giving 'bribes' to public servants to obtain illegal protection, get tenders and bills sanctioned and for covering up irregularities in respect of work executed by them in various tenders received by them from the PHE department. Joshi was a minister of the Public Health and Engineering Department in the previous Ashok Gehlot-led government. The JJM scheme was being implemented by this department.

AAP gets maximum notices for violation of model code
Ludhiana: Ahead of the West bypoll on June 19, election authorities have issued 41 notices for violations of the model code of conduct (MCC). Most of these notices have been directed at the ruling Aam Aadmi Party (AAP), officials confirmed on Wednesday. According to a senior election official, by June 12, AAP had received 24 notices, followed by Congress with nine, Shiromani Akali Dal (SAD) with five, and Bharatiya Janata Party (BJP) with two. The notices were issued after verifying complaints and conducting ground-level checks. The violations primarily involved unauthorised hoardings and banners on government and private properties, public meetings without permission, and alleged corrupt practices such as voter bribery and intimidation. An official from the election office said that while 665 complaints had been received by June 12, most were found to be factually incorrect upon verification. Enforcement in Action Returning officer/additional deputy commissioner Rupinder Pal Singh said that over 10,000 posters had been removed in the past two days alone, with the cost added to the respective candidates' expenditure accounts. "All parties are equally responsible for MCC violations," he said. To monitor and enforce compliance, the administration has deployed 34 teams, including 21 Flying Squad Teams (FSTs), 9 static surveillance teams (SSTs), and 10 video surveillance teams. Each team comprises a cameraman, a police officer, and an executive officer. These teams reportedly remove around 5,000 defacement materials daily. Rapid complaint resolution Expenditure observer Indana Ashok Kumar told TOI that 17 cases of defacement had been registered in connection with the bypoll. Of the 699 complaints received via the cVigil app, most were resolved within 100 minutes. He added that additional teams formed by the Ludhiana Municipal Corporation are working round the clock to remove defacements from both public and private properties.
