New Delhi, May 8 (PTI) Activist Sharjeel Imam, accused in a February 2020 riots case, on Thursday argued in the Delhi High Court that he was 'completely disconnected' with the place, time and co-accused, including Umar Khalid.
'This boy has spent more than five years in continuous custody. He is the (family's) breadwinner. He has an old ailing mother and no father,' said Imam's counsel.
The counsel reiterated that he was not even in the capital post January 15, 2020 and was arrested by the police from his hometown in Bihar on January 28, 2020 in a separate case. He contended Imam, as a result, did not part take in any of the 'conspiratorial' meetings with others.
While the prosecution's conspiracy case was based on messages exchanged among the accused persons, Imam's counsel denied chatting with them saying he was not in purported main WhatsApp group where chakka jams (traffic disruptions) were discussed.
The WhatsApp group Imam was a part of, had no messages that even 'remotely incite violence', the lawyer said.
'There is not a single message shown to show one community was pitted against another..One evidence of violence versus 40 evidence of non-violence demolish the case of the prosecution,' the counsel added.
The lawyer argued though a witness had alleged that he was 'related to Umar Khalid and some other accused', Imam had no such connection.
Imam's lawyer said his client was already facing prosecution in separate cases alleging sedition and hate speech, in which he was granted bail.
There were judicial pronouncements that found there was no consequent violence following his speeches, he added.
With respect to the police's case that he raised the Shaheen Bagh protest site, the lawyer argued Imam distanced himself from the site on January 2, 2020 apprehending involvement of miscreants and the present case ought not to be 'mixed' with violence that broke earlier in Jamia Milia Islamia in December 2019.
Umar Khalid, Imam and several others have been booked under Unlawful Activities (Prevention) Act (UAPA) and provisions of the Indian Penal Code for allegedly being the 'masterminds' of the February 2020 riots, which had left 53 people dead and over 700 injured.
The violence erupted during the protests against the CAA and NRC.
Imam was arrested in the case on August 25, 2020.

He further alleged that slogans of the Communist Party were raised during a marriage ceremony at the Kailasa Mandapam of the Thali Maha Kshetram in Kozhikode. In a separate petition relating to political songs performed by Aloshi during the festival at the Kadakkal Devi Temple in Kollam, HC had earlier directed the Travancore Devaswom Board (TDB) to ensure that no political activities are permitted within the premises of temples under its management. The present petition seeks a similar directive to cover temples not administered by any devaswom board. HC has adjourned the matter for further consideration after two weeks.

Meghalaya murder: One of the accused took people to man's funeral in Indore
Last Updated: Indore, Jun 9 (PTI) One of the persons arrested for alleged involvement in the murder of Indore-based Raja Raghuvanshi in Meghalaya had taken people to the latter's funeral here, an eyewitness said on Monday. The murder took a sensational turn when Raghuvanshi's wife Sonam was held by Meghalaya police along with her three alleged aides Akash Rajput (19), Vishal Singh Chauhan (22), and Raj Singh Kushwaha (21). 'When Raja's body arrived here, Sonam's family, whose home is in Govind Nagar Kharcha area, had arranged four -five vehicles for people to attend the funeral. Kushwaha was driving the four-wheeler in which I went, though we did not talk. Only after seeing his photograph in the media post his arrest, I recollected this episode," said Lakshman Singh Rathore. Raja Raghuvanshi, was found dead in a gorge near Weisawdong Falls in East Khasi Hills district on June 2, ten days after the couple went missing. Raja and Sonam, who got married on May 11 in Indore, went to Meghalaya on their honeymoon. The husband and wife disappeared on May 23, hours after they checked out of a homestay at Nongriat village, 20 km from where his body was found. 'The first person arrested was Rajput from Lalitpur, Uttar Pradesh. The second was Chauhan from Indore, Madhya Pradesh. The third was Kushwaha, also from Indore," East Khasi Hills SP Vivek Syiem said at a press conference in Shillong on Monday. The three were allegedly hired by Sonam, who surrendered before the Nandganj Police Station in Uttar Pradesh's Ghazipur, police there said. Meanwhile, Sonam's father Devi Singh Raghuvanshi claimed Kushwaha's name was being wrongly linked to his daughter and threatened to send a legal notice to Meghalaya police. Outside Raja Raghuvanshi's house in Sahakar Nagar, Indore, locals burnt Sonam's photo and expressed anger over the murder. Telangana High Court to pronounce Gali bail plea order
Justice K. Lakshman of Telangana High Court on Monday reserved orders in the bail petition filed by Karnataka legislator Gali Janardhan Reddy who was recently awarded seven-year imprisonment by CBI special court in Obulapuram Mining Case. The judge would pronounce the order on Tuesday. The main criminal petition appealing against the verdict of the CBI special court and seeking suspension of the sentence would be heard from August 11. Senior counsel S. Nagamuthu, appearing for the convict Gali Janardhan Reddy, said that Mr. Reddy already served nearly half of the awarded jail term as remand prisoner having been arrested by the CBI in the OMC case. Citing Supreme Court verdicts, the senior counsel contended that convicts who served half of the jail term can be set free on bail. While the case registered by the CBI against Mr. Reddy was related to charges of illegal mining beyond the parcels of lands leased out to OMC, the investigating agency did not focus on the point in its charge-sheet, the counsel said. Though the special law, the Mines and Minerals (Development and Regulation) Act was invoked in the case, the CBI did not mention specific evidence against the accused in the case. CBI counsel Srinivas Kapatia, opposing bail to the convict, contended that there were no compelling circumstances to grant relief to Mr. Reddy. The convict's contention that the jail term would harm his political career and that he had lost rights to represent and serve people of the constituency cannot be grounds for granting bail. Mr. Reddy, who won as MLA from Gangawati constituency in Karnataka in 2023 having formed Kalyana Rajya Pragathi party, joined BJP during the time of 2024 general election. The Karnataka Assembly disqualified him as MLA following his conviction and awarding of seven-year jail term in the case.
