It was issued without judicious application of mind, and the mandatory twin test safeguard required by law was not scrupulously followed, the court said.
The judge analysed Section 45 of the Unlawful Activities (Prevention) Act (UAPA), which outlines procedural safeguards. Section 45(1) requires valid sanction from the Centre or state govt to prosecute any terror offence under the Act. Section 45(2) mandates an independent review of the evidence by an authority appointed by the govt.
Lt Col Prasad Purohit, through his counsel Shrikant Shivade (who passed away in 2022) and later advocate Viral Babar, had consistently argued that the UAPA sanction was flawed. Other accused also challenged the validity of the Jan 2009 sanction and another issued in 2011 by the additional chief secretary (home). The trial court held both sanctions to be "defective."
While the prosecution claimed it had followed the twin test, the court said there was no evidence it was done as mandated under Section 45(2).

"The sanction is not a curable defect. So, all the provisions of UAPA will not be invoked," the judge ruled.
Advocates Ranjeet Sangle (for Sudhakar Dwivedi) and J P Mishra (for Sadhvi Pragya Singh) also argued that the first sanction bypassed the statutory safeguard under Section 45(2), and that the absence of such review invalidated the trial court's cognisance of UAPA charges.
Special public prosecutor Avinash Rasal had contended that the sanction's validity could only be decided during the trial, a view echoed by the Supreme Court in 2018.
However, the special judge reviewed the sanctioning procedure and found that UAPA charges could not be sustained due to the faulty sanction. Shivade had also pointed out that the authority did not comply with the mandatory safeguard of an additional review committee required under law since Dec 31, 2008.
The prosecution argued that since the crime occurred in Sept 2008, the earlier 2004 provision-without the second review-was applicable. But the Supreme Court clarified in 2023 that the UAPA's procedural safeguards during sanction are mandatory.

Driving licences to be delivered at applicants' doorstep: Govt
Bhopal: Driving licences in Madhya Pradesh will now be dispatched directly to the homes of applicants, transport minister Udai Pratap Singh told the state assembly on Wednesday. Responding to a debate on the MP Motor Vehicle Taxation (Amendment) Act, Singh said the transport dept was focused not just on tax collection but also on improving public services. "Most jobs done at RTOs have an online facility now thereby saving people from making rounds of RTO and only when a photo of a person has to be clicked, he has to go to the RTO office," the minister said. "Be it applying for a licence or a permit or paying a penalty, everything can be done online and the department now proposes to dispatch smart licence cards to the home address of the applicants," he said. Earlier, BJP MLA Vhgwandas Sabnani requested the minister to give smart card-like licences to people so that it was easily preserved and also send the licences to the home address of the applicant as the passport offices do.

Goa govt absorbed expenditure of Rs 65cr under zero water bill scheme
Porvorim: During the period for which the PWD implemented the Zero Water Bill Scheme, from Sep 1, 2021, to April 30, 2025, it issued 41.9 lakh zero bills to domestic consumers. The total bill amount of Rs 65.5 crore was waived under the scheme, stated the reply tabled in the assembly by chief minister Pramod Sawant to a question by Velim MLA Cruz Silva. Goa govt officially ended its zero-bill scheme on May 1. The scheme allowed the drinking water bill to be waived for families who limited their usage to less than 16,000 litres of water per month. The idea behind the scheme was to encourage the judicious use of drinking water resources. However, the CM said that earlier this year, the scheme of free water to consumers had to be stopped due to the misuse of water to wash cars or sustain gardens. He said govt is already supplying treated water to consumers by bearing a loss of Rs 16 per litre. Sawant said that the total water demand for domestic, commercial, and industrial uses is 695MLD — with system losses being factored in. The CM told the House that the highest demand for water at 146.5MLD is in Salcete taluka, followed by 123MLD in Bardez, and 94MLD in Tiswadi. The CM said these problems are attended to within the shortest possible time. 'In such eventualities, tanker supply is resorted to as a short-term measure. However, as a long-term measure, govt is investing in upgrading and modernising water treatment facilities, distribution networks, and storage systems,' he said. Sawant stated that 11 projects for new water treatment plants or augmentation of the capacity of existing plants are under process. He said that three plants — at Ganjem, Tuem, and Siolim — will be commissioned in Dec 2025.
