Calcutta HC orders resumption of MGNREGA in West Bengal from Aug 1
Kolkata, June 18 (UNI) In a major boost to the West Bengal government, the Calcutta High Court on Wednesday directed the Central government to resume the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) scheme in West Bengal from August 1.
The court emphasised that while the Centre is within its rights to impose safeguards or conditions to prevent corruption, it cannot indefinitely halt a public welfare scheme that serves millions.
A division bench comprising Chief Justice TS Sivagnanam and Justice Chaitali Chattopadhyay delivered the order, stressing that the suspension of the 100-day rural job scheme — ongoing for three years — was unjustified despite allegations of financial irregularities.
The Central government which funds the scheme entirely had suspended MGNREGA funding to West Bengal in March 2022, citing large-scale misappropriation.
The court observed that the grievances of genuine workers cannot be ignored on account of administrative or political concerns marking a major development in the long-standing deadlock over the rural employment programme.
Additional Solicitor General Ashok Kumar Chakraborty, representing the Centre, said that Central investigation teams uncovered irregularities in districts like Hooghly, East Bardhaman, Malda, and Darjeeling, involving embezzlement of over Rs 50 crore. A broader audit revealed anomalies amounting to Rs 613 crores, of which Rs 2.1 crores had been recovered by the state as of 2024.
'All the allegations are from before 2022. You are free to take any action regarding those. But the project must be started now,' Chief Justice Sivagnanam observed in response during the hearing. The court further clarified that MGNREGA, as legislated, does not allow for its indefinite suspension even in the face of corruption charges, and that any such action violates the spirit of the Act.
The court was hearing a public interest litigation filed by the Paschim Banga Khet Majur Samiti, during which it observed that poor rural labourers should not be made to suffer wage losses and livelihood disruptions due to systemic failures.
The bench further suggested that the scheme could be resumed in districts not affected by the alleged irregularities, while investigations continue in the four districts under scrutiny.
West Bengal received Rs 7,507.80 crore under MGNREGA in the 2021-22 financial year. However, since then, no funds have been disbursed. The Centre had justified its actions by citing inconsistencies found in 31 out of 63 inspected worksites, according to RTI replies.
In earlier observations also, the High Court had noted that the Centre's decision to withhold MGNREGA funds to West Bengal was unprecedented. While several other states had also reported financial irregularities under the scheme, none had faced complete suspension of funds over multiple years. The move, it said, had led to distress migration, financial instability, and stalling of rural development projects in Bengal.
In a separate case, leader of the Opposition Suvendu Adhikari also sought a CBI investigation into alleged embezzlement of MGNREGA funds in the state.

Vijayawada: Minister Nara Lokesh on Wednesday urged Union minister for law and justice Arjun Ram Meghwal to help set up a high court bench at Kurnool. Lokesh met Meghwal on Wednesday as part of his Delhi tour and explained the necessity for a high court bench in view of the long-pending demand and practical difficulties faced by people from the Rayalaseema region. Lokesh also met several union ministers on the first day of his two-day visit to the national capital. In the meeting with Union minister for education Dharmendra Pradhan, Lokesh explained the structural reforms being brought for the Andhra model of education, with a special focus on learning outcomes. To bring transparency into the system, legislation was introduced for teacher transfers, and star ratings are being given to schools based on performance. Lokesh said the state govt is planning to bring unified legislation for strengthening higher education in universities. He said that with the effective implementation of Swayam, Swayam+ Samarth programs, the gross enrolment ratio increased from 36% to 50% in higher education. The AI University, sports university, and international law university, which are to be set up, will further strengthen higher education in AP, he said. Lokesh also sought the Centre's cooperation in setting up food processing industries in the Rayalaseema region. In the meeting with the Union minister for food processing Chirag Paswan he explained that the Rayalaseema region is suitable for horticulture crops. Large cultivation of mango, tomato, banana, and other horticultural crops is done in the region, but farmers often find themselves at the losing end in the absence of processing units. Paswan promised to visit the region to explore opportunities for setting up new industries. Lokesh also met Vice President Jagdeep Dhankhar and Union home minister Amit Shah and discussed various issues pertaining to the state.

In-laws told to provide woman accommodation or pay her rent
New Delhi: Directing the in-laws of a woman to either arrange accommodation for her or pay the rent for her separate stay, a court has observed that an aggrieved person under Protection of Women from Domestic Violence Act has the right to reside in the shared household even in the absence of actual residence in it. Citing a Supreme Court ruling, the court of additional sessions judge Sharad Gupta said in his June 6 order that a woman couldn't be excluded from the shared household even if she didn't actually reside there. The petitioner, Shalini Chauhan, alleged that after her marriage in 2021 in Faridabad, she was subjected to domestic violence, following which she decided to live separately. The court was hearing her appeal against an order of a magisterial court in Sept 2023, which did not issue directions on the issue of accommodation. Vineet Chauhan, her husband who is absconding, didn't give interim maintenance to her since Jan 2023. The appellant, through her advocate Archana Sharma, said she was facing financial difficulties as her husband had filed a plea claiming he wasn't involved in any violence and not liable to pay maintenance. "Rather, as per record, the respondent no. 1 has abandoned his parents as well as his wife. Thus, considering that the appellant was living in the matrimonial home prior to the breakdown of relationships, the respondents would have to provide some shelter or rent to the appellant for a reasonable period of time," the judge said.

Delhi Police tighten drug crackdown, shows data
NEW DELHI The Delhi Police has registered 1,096 cases under the Narcotic Drugs and Psychotropic Substances (NDPS) Act and arrested 1,353 persons until May, according to data accessed by HT, with enforcement well on its course to ensure record seizures by the year-end. According to the data, in theentirety of 2024, 1,789 cases were registered and 2,290 persons were arrested, while the respective numbers were 1,325 and 1,736 for 2023, 1,179 and 1,499 for 2022, and 566 and 857 for 2021. Officers said that while the 2024 numbers were a record, enforcement action has been more stringent this year, given the growing drug smuggling networks. 'With synthetic and prescription drugs being increasingly used, enforcement agencies are recalibrating their strategies to target manufacturing and supply chains more effectively, so that the narcotics trafficking networks could be completely dismantled in the national capital. The Delhi Police continues to work in coordination with other central agencies to address the growing complexity of the drug trade in the capital,' special commissioner of police (crime) Devesh Chandra Srivastava said. Police said that marijuana continues to be the most commonly seized narcotic in terms of volume, with over 2,695 kilograms already seized this year. In 2024, 4,921.8kg of the drug was seized. They also highlighted increased opium smuggling, citing seizures to the volume of 212kg in the first five months of the year—over double the quantity of 104.88kg seized in the whole of 2024. Police also raised the red flag over cocaine recoveries, citing seizures of 1,296.6kg in 2024, which was sharply up from 15.31kg seized in 2023. This year, 0.74kg has been seized until May. According to the data, police also seized 300,000 tablets and 34,616 capsules of pharmaceutical drugs illegally manufactured, counterfeited or intended for misuse,and 173 bottles of prescription cough syrups. In 2024, 828,000 tablets and 3,561 injections were seized. Since December 2022, police said they have incinerated substances weighing over 42,000kg and worth over ₹10,000 crore seized under the NDPS Act. 'Drug destruction events reflect Delhi Police's zero-tolerance stance against narcotics. All events were conducted with strict environmental compliance at designated incineration facilities,' Srivastava said.
