Howard Levitt: Even the most desultory employee can find favour with the courts
As Justice R. Lee Akazaki of the Ontario Superior Court described in a recent case:
'At the time of his dismissal as a salesperson at Brandt Tractor, (the plaintiff) was 56 years old and had worked there for 18 years. He never made it easy for himself. Several times during his career, members of the public complained about his driving. He crashed the company truck. He injured himself at least once, while demonstrating a tractor attachment to a client. Brandt kept him on, and he was successful enough as a sales producer.'
But all strokes of good fortune (or employer beneficence) eventually come to an end. In this case, the employee's final straw was a serious customer complaint about multiple varieties of bad service and allegedly inappropriate conduct. The company seized upon this incident — on top of his earlier record — to anchor the dismissal.
The risk in using a final incident as an excuse to terminate a worker is that you must show the event was worthy of discipline. If not, the case for cause fails.
At trial, the employer relied on an email written at the time by a manager who received the call in which the customer detailed his litany of complaints.
According to the judge's ruling, '(The plaintiff) did not help himself very much in giving evidence. My impression … was that he lacked credibility. There was a record of work-related incidents and discipline under three different managers. He declined to accept he needed additional training or that he really deserved to be disciplined. Thus, if Brandt established that (the plaintiff's) encounter with his final customer was worthy of discipline, the employer would have proven just cause.'
But the employee (or his lawyer) made a fatal mistake. They did not call the customer as a witness. Therefore, all the evidence was hearsay. The problem with hearsay — and the reason why it is generally inadmissible — is that the other side has no opportunity to cross-examine the relevant witness as to precisely what occurred.
As the court noted: 'A negative credibility assessment of (the plaintiff's) evidence and version of events does not amount to proof that the encounter went precisely as the customer claimed it did. The court had no means of testing the credibility of the customer's account as related by the manager who wrote the email.'
So, even though the court was disinclined to believe the employee, it had no cogent admissible evidence that he had committed the misconduct complained of. It found that the final incident on which the termination rested was not proven, and therefore there was not cause for dismissal.
I experience this problem regularly with employer clients. They do not, for obvious reasons, want to involve their customers in a legal proceeding and will instead try to find a way to win the case without them.
I tell these clients that unless the customer testifies at trial the misconduct cannot be proved, and if the company is relying on the customer's complaint to justify the dismissal for cause, it simply cannot win. Those employers inclined to second-guess me now have a judicial finding to cure them of any doubt.
In determining wrongful dismissal damages, the court concluded that if the plaintiff had been offered 12 to 15 months' severance, he would likely have taken it. Such reasonable expectations are generally what should determine the appropriate damages. However, the judge added, 'Employment law … recognizes the special role of employment in an individual's identity and life,' and instead increased the amount awarded to 17 months' pay.
Following his dismissal, the employee accepted a job driving a parts truck at a much lower salary. He testified that he wanted to find a less stressful job. One might have thought that this admission would be viewed as a failure to mitigate and lead to a reduction in his damages. But the company did not establish that its former employee could have found comparable work if he had looked for it, so his wrongful dismissal damages were not reduced.
To add insult to apparent injury, the court did not even reduce his damages by the amount that he earned in his new job. In this, the judge relied on a court of appeal decision that employees who are forced to take lesser jobs after being fired will not have the income from that job deducted, as income from new employment will normally be deducted in assessing wrongful dismissal damages.

This case is a cautionary one for employers and shows the extent to which our courts will go in finding in favour of employees. It is also an open invitation to even the most desultory employee to not take an allegation of cause seriously.

If you don't currently have that cushion, Orman suggests that now — while markets are up — may be a smart time to build it. "Being able to cover your living costs without touching stocks when they are how you sleep soundly in retirement," she explains. Powell is costing the US by not lowering rates, says Trump. Here's what he may mean
Source: CNN As part of his campaign to get rid of Jerome Powell, President Donald Trump has blamed the Federal Reserve chair for costing the country 'hundreds of billions of dollars' by not slashing interest rates. 'You have cost the USA a fortune and continue to do so,' Trump wrote in a handwritten note to Powell that he posted on Truth Social last month. 'You should lower that rate by a lot. Hundreds of billions of dollars are being lost.' In the same post, Trump blamed the Fed board, saying, 'If they were doing their job properly, our Country would be saving Trillions of Dollars in Interest Cost … We should be paying 1% Interest, or better!' Trump's focus on interest costs comes at a time of renewed attention on the nation's skyrocketing interest payments on its ever-growing federal debt. Interest payments this fiscal year are nearing $1 trillion for the first time in the nation's history. The president just signed the 'big, beautiful bill,' which is expected to add more than $3 trillion to the deficit over the next decade and push interest rates even higher. And Moody's recently downgraded the US debt in part because of the increase in government debt and interest payment ratios. But even if Trump succeeds in pressuring the Fed to reduce rates, it may not significantly lighten the nation's interest payment burden, experts said. The federal funds rate is only one of the factors that influences the interest rates on the federal debt, which is made up of a mix of short-term, medium-length and longer-duration Treasury securities. 'It seems to be an easier lever to pull for those who want to impact either interest costs on the federal debt or economic growth,' said Shai Akabas, vice president of economic policy at the Bipartisan Policy Center. 'But it doesn't mean that action by the Fed will result in the outcome the president or others may want.' What's indisputable is that America's interest costs have soared in recent years, in part because of the nation's growing debt and in part because interest rates rose after a period of super-low rates as the nation combatted high inflation earlier in the decade. The US shelled out $346 billion in interest payments in fiscal 2020. That figure has jumped to a projected $952 billion for the current fiscal year and is expected to exceed $1 trillion in the coming year, according to the Congressional Budget Office. Interest payments are now the second-largest spending category in the federal budget, surpassing Medicare and defense in fiscal year 2024 and trailing only Social Security. Currently, roughly 18 cents of every dollar in tax revenue goes to paying interest on the debt, Akabas said. By the end of the next decade, that figure will jump to about 25 cents. While cutting the federal funds rate may lower rates on shorter-term securities, it may not reduce rates on 10-year or 30-year Treasury bonds. In fact, a sharp cut may increase longer-term rates for several reasons, including that a steep rate cut could spur inflation or could prompt investors to shift to longer-term securities to lock in higher rates, said Marc Goldwein, senior policy director at the Committee for a Responsible Federal Budget. 'The Federal Reserve only has so much power to lower those interest rates,' he said of the rates on longer duration Treasury bonds. 'There's no guarantee that the Fed cutting rates will reduce interest payments at all.' If Trump were truly interested in reducing interest payments, there is a more efficient way to do that, experts said. He could work to lower the annual deficit — though that would likely involve some politically unpalatable changes to taxes and spending, they said. While Trump's agenda package will make historic reductions to federal spending on the nation's safety net, its hefty tax cuts far surpass the savings and widen the annual deficit. 'If your concern is the hundreds of billions of dollars we're adding to the deficit from higher interest costs, the solution is to enact policies that are deficit reducing, not deficit increasing' Goldwein said. ICE arrests illegal immigrant accused of decapitating Illinois woman after judge set him free
Immigration authorities in Chicago arrested a Mexican illegal immigrant accused of decapitating a missing Illinois woman and storing her body in a storage container filled with bleach. Jose Luis Mendoza-Gonzalez, 52, of Waukegan, Illinois, was arrested in April and charged with concealing a corpse, abusing a corpse and obstruction of justice, according to the Department of Homeland Security (DHS). Immediately after his first court appearance, Lake County Judge Randie Bruno released Mendoza-Gonzalez from custody. He was arrested again Saturday afternoon at a market in Chicago by Immigration and Customs Enforcement (ICE) agents and remains in ICE custody, according to DHS. In April, police in Waukegan, Illinois, found the body of 37-year-old Megan Bos, who was reported missing March 9, in a container in Mendoza-Gonzalez's yard. She disappeared in February, according to family members. Mendoza-Gonzalez was accused of keeping Bos' body in his yard for nearly two months and abusing her corpse. DHS officials told FOX News Bos' body had been decapitated, and she was found in a bleach-filled storage container. "It is absolutely repulsive this monster walked free on Illinois' streets after allegedly committing such a heinous crime," a DHS spokesperson told Fox News. "Megan Bos and her family will have justice." After Mendoza-Gonzalez's release in April, Antioch Mayor Scott Gartner criticized laws that allowed the suspected criminal alien to be released, according to a report from affiliate FOX 32 Chicago. "I was shocked to find out literally the next day that the person that they had arrested for this had been released from prison under the SAFE-T Act less than, detained less, I think, than 48 hours," Gartner said. "There's other extenuating circumstances in this case. Not only the type of crime, how long the crime was concealed, the fact that the person that was arrested for this is not a U.S. citizen, and, you know, can maybe [flee] the country." Mendoza-Gonzalez allegedly told authorities Bos overdosed at his house and, instead of calling 911, he broke her phone and kept her body in the basement for two days before moving it outside, according to the report. Republican state Rep. Tom Weber expressed concern about Mendoza-Gonzalez's release in April. "Someone that hid their body in a garbage can for 51 days after leaving it in the basement for two days, after not calling 911 [and] breaking a phone. Is this a non-detainable offense?" Weber said. "Should we not find out, wait for a toxicology report, anything?"
