State seeks extension in R3 million corruption trial of former eThekwini officials

The Durban Commercial Crimes Court had to postpone the corruption case involving over R3 million involving former eThekwini officials on Friday because the State requested additional time to prepare a comprehensive defence, raising concerns about the selection of a forensic firm that looked into the alleged corruption.
Nhlakanipho Ziphozinhle Mthembu, Inhlanzi Catering and Events (PTY) LTD, Sandile Ngcobo, his wife, Vuyiswa Ngcobo, and Mndeni Mkhize are charged with fraud, corruption, conspiracy to commit corruption, and money laundering.
The forensic company, Integrity Forensic Solutions CC (IFS), was appointed by eThekwini's City Integrity and Investigations Unit (CIIU) to probe the Durban Solid Waste (DSW) tender irregularities after it received a stack of documents anonymously alleging irregularities.
As the IFS was conducting the DSW investigation, it also came across tender irregularities of more than R3 million.

The DSW investigation resulted in the arrest of 22 individuals, including the former mayor of eThekwini Municipality, Zandile Gumede.
The five accused are currently on trial and have filed a compelling application for the State to provide them with a Masama report, which found that the appointment of the IFS was unlawful.
In Gumede's trial, the Durban High Court learned that the Masama report was compiled by Masama Consulting, which was hired by the municipality to investigate the appointment of the IFS after a whistle-blower's report.
During the court proceedings on this matter, State prosecutor advocate Bongi Mbambo told the court that the State was supposed to respond to the defence's application, but it needed more time.
Mbambo said there were a lot of allegations.
'The State would have to have consultations to prepare a thorough response,' she added.
She asked for the matter to be postponed to August 21 and said the State would respond to the defence on August 8.
In this matter, the State is alleging that the accused failed to disclose a conflict of interest. It said emergencies were created by Ngcobo and Mkhize, which allowed for the circumvention of the formal procurement processes.
The State alleged that Mthembu and Inhlanzi Catering were awarded the tender due to a cover quote by Mkhize, and it was approved by Ngcobo, who was the deputy head of Supply Chain Management and the chairperson of the Bid Adjudication Committee.
However, he has recently been dismissed by the municipality. Ngcobo is also an accused in the Gumede case.
Sources claim Mkhize is still employed by the city. Additionally, the State alleges that Ngcobo and his wife, Vuyiswa, accepted a gratification of R100,000. At the time, Vuyiswa was a principal clerk in the city.
The case was postponed to August 21.

On September 15, 2022 Khuzwayo was gunned down. Evidence led by the State senior prosecutor advocate Elvis Gcweka revealed that the fingerprints of Ngiba were found in Khuzwayo's car. Cellphone data also placed Ngiba at the crime scene during the time of the killing. The court also learned that Ngiba used a Silver VW Polo Sedan as a getaway vehicle. In a victim impact statement, Peaceful Thuleleni Khuzwayo, the wife of Khuzwayo, said the death of her husband brought unimaginable pain for her and their children. She said she lived in fear as she did not know who killed him, and the Khuzwayo family accused her of the murder. It was a hurtful ordeal, but I had to swallow that and be strong for my children as they were still young and needed my support,' she said. Peaceful added that the quality of life improved in her family when Khuzwayo got a permanent job at the iLembe municipality, but that was short-lived as he was killed. She described Khuzwayo as a loving and responsible father. 'We lived happily and peacefully,' she said. She said after his death, she had to go and look for a job, but indicated that she was still not coping with losing her husband, who was their pillar of strength and protector. 'I have been trying to be strong. Fear is part of my life, and some days I cannot sleep,' she added. The elder brother of Khuzwayo, Sifiso Khuzwayo, said the family was happy with the sentence, but they wished for investigations to continue, so that other people could be prosecuted. 'We still want to know what happened because that man (Ngiba) was not alone in this,' he said. Ngiba is also charged with the murders of Siyabonga Mkhize, an ANC ward candidate in Ward 101 in Durban, and Mzukisi Nyanga, who was an ANC activist. Both Nyanga and Mkhize were shot and killed in 2021. Their murder trial is set to resume at the Durban High Court in November.

2 killed as deadly fire rips through Durban informal settlement
A devastating fire tore through Durban's Kennedy Road informal settlement in the early hours of Saturday, claiming the lives of a woman in her 30s and a one-year-old baby. The Witness reports that the deadly blaze comes barely a month after another inferno destroyed 40 shacks in the same settlement. At this stage, the cause of the fire that destroyed over 100 shacks remains unknown. Resident and community leader Vusi Doncabe said he was woken up by the noise from the neighbours and when he walked out to check what was happening, the fire was too close to his own shack to save his belongings. 'I'm left with nothing. I could not throw out any of my belongings because the fire was too close to my shack when I woke up,' said Doncabe. I was in a state of panic and in fact everyone was in that state because the fire was uncontrollable. When the fire fighters and emergency services arrived, the blaze had done the damage. He said the one-year-old baby belonged to another woman who had left her in the care of the friend for the night. 'People are saying the baby was left with the friend who died in the same shack they were sleeping in. It is not clear where the baby's mother was,' he said. Relief organisation, Gift of the Givers said they had responded and provided assistance to the affected residents. Community liaison officer Bilaal Jeewa said about 120 people, including children were left homeless. He said in the interim they provided the victims with beanies and blankets, and meals will be provided. 'The eThekwini disaster management is doing the assessment, and once all is done, we will see what further assistance we can provide for the affected families. Obviously other NGOs will also lend a hand to assist the affected.' 'We estimate about 80 to 100 shacks have burnt down. Thus far, we have provided the people with teabags, bread, peanut butter, the beanies etc, because it was cold. It was raining but now it's cold,' said Jeewa. Attorney of woman accused of killing Pretty Mahlangu says he advised her not to apologise immediately after the incident
JOHANNESBURG -The attorney of the woman accused of running over a crowd of girls and killing one of them said he advised his client not to reach out to apologise immediately after the incident. Kineil Muthray said it was too soon, and he did not want to further aggrieve the family. His client, 68-year-old Martha van der Walt, is facing charges of culpable homicide; she was released on R5,000 bail on Friday by the Germiston Magistrates Court. The Germiston Magistrates Court heard how the State still needed to get a post-mortem report and download the video footage which captured the incident. Pretty Mahlangu's family expressed disappointment when they saw the woman walk free, saying she had no remorse as she still had not apologised. "I advise that it's an open wound, it's really difficult and it's not going to feature very well if they are going to reach out to the family at this stage. I did request that the investigating officer facilitate this during the first matter that wasn't enrolled. He said that he would do that, but he also said it would be difficult." He added that the accused also wanted to help with financial support for the young girl's family.
