High court hears DA's case against employment equity amendment in critical examination of transformation

The DA's case against Labour Minister Nomakhosazana Meth and the Employment Equity Amendment Act is under way in the Gauteng Division of the High Court, with the DA opening the door for the entire bill to be declared invalid.
'Leave good enough alone.' This was the Democratic Alliance's (DA) argument in the Gauteng Division of the High Court on Tuesday, 6 May 2025, as the party challenged the constitutionality of the new draft employment equity targets proposed in the recently gazetted Employment Equity Amendment Act.
The courtroom was filled with members of the public, including prominent individuals like DA MP Willie Aucamp and Cosatu Secretary-General Solly Phetoe.
The DA's legal representative, Ismail Jamie, told the court that the previous iteration of the Employment Equity Act struck an appropriate balance between fostering transformation and protecting the rights of undesignated groups in that it was flexible, prohibited quotas, and gave employers the power to set their own targets based on their specific circumstances.
Jamie argued that the amended act violated Section 9 of the Constitution because it 'replaces a nuanced, flexible system with one that is blunt and rigid'.
In April, the Department of Employment and Labour gazetted the amendment act, which introduced five-year numerical targets for the top four occupational levels (junior, middle, senior and top management) across 18 sectors, ranging from finance to manufacturing.
'Rights violated'
While the party's main argument was that Section 15a of the amended act violated the rights of coloureds, Indians and white people, another key argument was that the draft law was tagged incorrectly, therefore making it invalid.
Jamie argued that the amendment bill was passed under Section 75 (which excluded provinces) of the Constitution instead of Section 76 (which governs legislation on a national level). Section 76 governs how bills affecting provinces must be passed, and its focus was to ensure that provincial interests were considered.
The party's representative maintained that if the court found that Section 15A of the amended act was indeed invalid because it had been tagged incorrectly, then a natural consequence of the finding would be that the entire amended act be deemed invalid on a technicality.
The DA also claims that:
Section 15A violates Section 9 of the Constitution by enabling discrimination based on race.
The minister's discretion under Section 15a lacks clear legal standards, contravening the Dawood principle of administrative law.
The implementation of demographic targets disproportionately prejudices coloured and Indian communities in certain provinces, particularly the Western Cape and KwaZulu-Natal.
Exemptions for small businesses and the government's settlement in the Solidarity case suggest an acknowledgement of the potential economic harm of the quotas.
Drama unfolds
While the proceedings were relatively calm, they were unceremoniously interrupted by two unidentified individuals, who said that they were aggrieved parties who deserved to submit to the court.
In a dramatic turn, the men told the judge that they would consider the case a mistrial if the judge refused to hear them, as Parliament had ignored their interests when drafting a law that worked against their interests.
The judge refused to hear them and summarily dismissed the pair.
The case is ongoing with the Department of Employment and Labour's representatives presenting the State's argument. DM

The DA is challenging the Malatsi rejected suggestions that the regulations were aimed at paving the way for Elon Musk's Starlink to operate in South Africa, as critics have suggested. Starlink has failed to get an operating licence because South African-born Musk refused to meet broad-based BEE ownership requirements. South Africa's drive for transformation stands in contrast to the US's rollback of diversity, equity and inclusion measures, which puts at risk global policy coherence ahead of the G20 presidency handover between the two countries later this year. Although it has been widely criticised for only benefiting the politically-connected and being riddled with corruption, Ramaphosa praised broad-based BEE for creating black industrialists and changing management control and patterns of ownership in companies. 'The progress we have made is undeniable. We have seen real changes in ownership patterns, including more businesses owned by women. We have seen changes in management control, enterprise development and skills development,' he wrote in the newsletter. He noted that, according to Statistics South Africa, from 2006 to 2023, black African households experienced real income growth of 46%, coloured households of 29% and Indian households of 19%. 'Despite this progress, the average income of white households is still nearly five times higher than that of black African households. This is the gulf we must close through deliberate and sustained efforts to expand opportunity,' Ramaphosa added. He highlighted the 'poly-crisis' of global conflict, economic stagnation, mistrust in institutions and climate change as the challenge to government efficiency. The Institute of Race Relations has criticised broad-based BEE, arguing instead for ' Ramaphosa said transformation would continue as a guiding principle for the government's infrastructure programmes, new industries in the green transition, localisation efforts and reindustrialisation. 'The transformation we seek is not about ticking boxes. It is about building a resilient, just economy for generations to come,' he wrote in the newsletter.

This is according to political analyst Dr Levy Ndou who spoke with IOL News on Tuesday. Ndou said Zille must prove she resides in Johannesburg by obtaining a local address, registering to vote in the area, and securing proof of residence. This comes after Zille's indicated she was contemplating running for mayor of Johannesburg. The former Western Cape premier said she feels a deep connection to the city where she was born. "I have been approached to put my hat in the ring for mayor. I am still considering it and consulting my family," Zille previously said in an interview with IOL News. However, Ndou clarified that legally, Zille can run for the position if she meets the following requirements: - Be a South African citizen - Be at least over 18 years old - Be a registered voter in the City of Johannesburg - Not be disqualified under the Municipal Structures Act 117 of 1998 (e.g., due to criminal convictions) The candidates must also be nominated by a political party or, if running independently, by a group of registered voters in the metro. 'She would qualify. The only thing she needs to do is have residency in Johannesburg. She can buy a house or rent a flat and register to vote in the area,' Ndou said. He added that the law is not as strict as many people think, but those minimum criteria must be met. While Zille's eligibility is not in question, Ndou said her potential candidacy could raise internal tensions within the DA. 'There's nothing wrong with her contesting the position,' he said. 'But it could send the message that the DA lacks capable leaders in Johannesburg, which might be interpreted as a vote of no confidence in the local party structures.' Ndou also questioned whether Zille's bid might blur the line between party leadership and governance. 'She occupies a strategic role in the DA. Why not focus on that? If she says she has 'unfinished business' in Johannesburg, what exactly is it, and couldn't someone else in the party take that forward?' He warned that such a move might discourage other party members who aspire to leadership positions. 'This creates the impression that Zille is bigger than the party. Deploying herself could backfire. The DA should have carefully calculated the political cost of this move,' he said. Meanwhile, according to the Municipal Structures Act 117 of 1998, a municipal mayor is elected by the municipal council from among its members. The election follows a specific procedure outlined in Schedule 3 of the Act. A mayor serves for the duration of their term as a member of the executive committee unless they resign, are removed, or lose their seat.
