Acquittal of Mashatile's VIP officers 'miscarriage of justice'

Democratic Alliance MP and chairperson of the Portfolio Committee on Police, Ian Cameron, will write to Police Minister Senzo Mchunu to seek clarity on why eight members of Deputy President Paul Mashatile's VIP Protection Unit were cleared of charges by the South African Police Service (Saps) during an internal disciplinary process.
Though members of the VIP Protection Unit have reportedly been cleared during an internal disciplinary process, they are still facing legal proceedings in court.
Shadrack Molekatlane Kojoana, Johannes Matome Mampuru, Posmo Joseph Mofokeng, Harmans Madumetja Ramokhonami, Phineas Molefo Boshielo, Churchill Mpakamaseni Mkhize, Lesiba Aggrie Ramabu and Moses Fhatuwani are currently out of jail on R10 000 bail each.
Charges
The VIP officers are facing 12 legal charges, including pointing a firearm, reckless and negligent driving, malicious damage to property, assault with the intent to cause grievous bodily harm, obstruction of justice, and assault by way of threat.
Cameron expressed shock at Saps's decision to clear the VIP officers of the charges through its internal disciplinary process.
'The acquittal of the members is not only a miscarriage of justice but also puts the name and image of the Saps [South African Police Service]into disrepute. Furthermore, this decision strengthens the public perception of Saps officers being and acting above the law. This decision lacks legal and moral justification and should be reconsidered.
'With the worsening trust deficit between the police and communities, such decisions will further erode the low levels of trust that exist between the police and the people,' Cameron said.

'Rogue officers'
Cameron said the ruling entrenches the long-held committee's view that internal disciplinary mechanisms within Saps are inadequate and rewards rogue officers.
'This decision will further cement the public's perception of a complete disregard of consequence management within the Saps.
The case involving the eight members of Mashatile's VIP presidential protection is before the Randburg Magistrate's Court and will resume on 10 June.

Investigation
Cameron said he will write to Mchunu to demand an explanation on behalf of the nation and for the victims.
'The committee will, for its part, consider legislative reforms to end the abuse of internal processes in Saps and to limit the obstructive role of unions in misconduct cases.
'We cannot accept a Saps that protects thugs in uniform. We will not sit silently while the rule of law is trampled upon behind closed doors,' Cameron said.
National police spokesperson Brigadier Athlenda Mathe told The Citizen the National Police Commissioner will 'study the chairperson's report and consult legal services'.

Thandile Khesa, 43, appeared composed as he stepped into the dock, where he was formally charged with kidnapping and murder. His arrest on Monday morning followed a multi-disciplinary, intelligence-led operation involving the Hawks, the Provincial Anti-Kidnapping Unit and Provincial Organised Crime detectives. State prosecutor Litha Duka told the court that Khesa allegedly used a marked City of Cape Town Law Enforcement vehicle to transport the victim from Bellville to the location where he was assaulted. The victim later died in hospital as a result of his injuries. CCTV footage allegedly captured the movement of the official vehicle from Bellville to Khayelitsha. Khesa has been added as the fifth accused in the case, joining Mogamat Samuels, Thokozani Kamnjunga, Existing Mudivari, and Yasseen Jele. The four co-accused are expected to appear in court on Thursday, 12 June, for a bail application. The State is opposing bail. Reading from the charge sheet, Duka explained: 'The deceased had gone to view a vehicle advertised by Accused 1, Samuels, and was subsequently kidnapped. The accused demanded a ransom of R100,000 from the victim's family. "The family managed to pay R5,000, but the victim was nonetheless assaulted and died of his injuries. Khesa used a marked City of Cape Town Law Enforcement bakkie in the commission of this crime.' Hawks spokesperson Siyabulela Vukubi provided further details, stating that the victim was last seen on 16 May in Kraaifontein by a friend, who said he was headed to Bellville to view a vehicle. A short time later, the victim phoned another friend, reporting that he had been kidnapped and was being assaulted. The suspects allegedly demanded a ransom of R100,000, later reduced to R10,000, of which R5,000 was paid. Investigators tracked the suspects to addresses in Philippi and Kleinvlei, which led to the arrest of the four initial accused. They were later led by one of the suspects to a shallow grave in the dunes between Monwabisi Beach and Macassar, where the victim's body was recovered. 'On 17 May 2025, the team followed all the leads that led them to addresses in Philippi and Kleinvlei which resulted in the arrest of the four accused. "The team was led to an open field on the dunes between Monwabisi beach and Macassar, where one of the accused pointed out a shallow grave where the victim was killed and buried," Vukubi said.

One of the officers from Deputy President Paul Mashatile's protection team told the VIP incident management officer that a speeding VW Polo driver was trying to get close to the main car the day the VIP officers allegedly assaulted a motorist. Sgt Goodwill Rikhotso, an incident management officer at the VIP police unit, revealed this at the Randburg magistrate's court on Tuesday. He testified in the case of the eight VIP protection unit officers from Mashatile's protection team who allegedly assaulted a motorist on the N1 highway in Johannesburg in July 2023. Rikhotso, who writes accident and incident reports in the VIP unit, testified that one of the accused officers, W/O Phineas Boshielo, reported to him about the July 2 2023 incident. However, the incident report didn't mention anything about an assault incident. 'W/O Boshielo reported that at about 16:00 bravo convoy were run on the N1 north road from Soweto when a blue Polo driving behind the convoy, trying to get close to the main car,' Rikhotso read from the report he compiled during the examination in chief. The state led the evidence of Rikhotso, who testified that they were speaking in Tswana when Boshielo called him, and there was no miscommunication between them. 'They first backup shielded the main car against driver of the Polo. They ordered the driver to reduce speed but instead he continue to race with the convoy and they end up forcing him out the road,' Rikhotso read the report. Rikhotso testified that Boshielo reported that: 'They stopped him [driver] and inside the Polo there were three males and one female, smashed on the windows trying to run away but the first backup managed to catch them and they searched them and the vehicle as well but they did not find any weapons in the vehicle. 'Later the first backup joined the convoy, and Capt Lepota was informed about the incident.' Shadrack Kojoana, Johannes Mampuru, Pomso Mofokeng, Harmans Ramokhonami, Phineas Boshielo, Churchill Mkhize, Lesibana Rambau and Moses Tshidada face 12 counts, including assault, malicious damage to property, pointing of a firearm, contravening the Road Traffic Act, reckless and negligent driving and attempting to defeat the ends of justice. The case was adjourned to Wednesday for the defence lawyer, Mswazi Makhubele, to consult the accused before cross-examining Rikhotso.

Having joined the South African Police Service (SAPS) in 2022, Kgomotso as affectionately known, believes that with an abundance of careers in the Service, one needs just potential and commitment to contribute immensely towards creating a safe and secure environment for the people of South Africa. Monnamorwa who was born and brought up in Mokasa II village, Taung, has been part of the SAPS family for the last three years following her recruitment on 1 April 2022. Ordinarily, working at Public Order Police (POP) has its own challenges, considering that the Unit is primarily responsible for combating crime and maintaining public order. Nevertheless, that did not discourage Monnamorwa to accept with both hands her permanent placement at the POP Unit. When she is not performing crowd management duties or combating crime in the field, the resourceful officer is responsible for the Loss Management and Moveable Government Property duties in the Supply Chain Management (SCM) Section. Her duties include but not limited to ensuring that the Unit has enough resources and that the available ones are used optimally and in an accountable manner. Monnamorwa who is also known as 'Momo', obtained her BA Degree in Psychology and Sociology, which she completed in 2019 at North West University. With her determination to equipping herself academically, the member is considering pursuing a career in the Psychology field. She believes that there is so much to learn and is passionately committed about developing herself within the Service and uplifting her fellow members. Having been in the SAPS for three years, Monnamorwa's message to the youth is that: 'There are so many career opportunities within the SAPS; you just need to realise your true potential, study and work smart towards achieving your aspirations. The SAPS does not tie you to the field of work only, but allows you to be in charge of your future while continuing to ensure the safety and security of the community.
