Penang rules out gazetting Middle Bank Marine Sanctuary to avoid project disruptions

GEORGE TOWN, May 21 — The Penang state government does not plan to gazette the Middle Bank Marine Sanctuary, according to state executive councillor H'ng Mooi Lye.
The state local government, town and country planning committee chairman said the Middle Bank cannot be gazetted as this would classify it as an environmentally sensitive area.
'Any projects implemented within a 500-metre radius of an environmentally sensitive area would require a Second Schedule Environmental Impact Assessment (EIA) report,' he told Malay Mail recently.
He said this could affect planned projects near the area and might also impact the Penang Port expansion project.
H'ng was clarifying his response to a written question by Lee Khai Loon (PKR-Machang Bubuk) at the state legislative assembly regarding the rehabilitation of the Jelutong landfill project. The project involves reclaiming 70 acres (28ha) of the sea, with potential implications for the Middle Bank.
In his reply to Lee, H'ng said the state approved the 70-acre (28ha) sea reclamation to create a work platform for rehabilitation works at the landfill.
'The Jelutong landfill is unsafe because it has long been used as an open dumping ground,' he said.
Lee also asked if the state had an exit clause in case the rehabilitation project failed.
H'ng said the joint development agreement would be cancelled if the project failed to proceed.
'A new tender process would then be initiated through a Request for Proposal (RFP) or open tender procurement procedure,' he said.
However, he noted there was a risk of claims and legal action by the developer against the state government and Penang Development Corporation (PDC).
He added that a new developer would not be able to take over the project until legal procedures were completed, which could take between three and five years.
The Middle Bank Marine Sanctuary spans around 10 square kilometres in the waters of the South Channel between Penang island and the mainland.
It is home to the only seagrass bed in the Straits of Malacca. A study revealed a total of 429 species of seagrass, trees, vegetation, fish, birds, marine mammals, turtles, molluscs, arthropods and echinoderms inhabit the area.
The rehabilitation project has yet to begin as it is still awaiting EIA approval from the Department of Environment (DoE).
The PDC signed a deal with PLB Engineering Bhd in 2020 to rehabilitate and develop the Jelutong landfill at a cost of RM1 billion.
The DoE issued a public notice on its Facebook page on February 12 this year regarding the proposed rehabilitation and reclamation project.

Wee said introducing a new tax – especially with the potential for retrospective application – would seriously disrupt existing contractual obligations, budgets and project timelines. 'Given the critical role the construction industry plays in national development and economic stability, MBAM respectfully appeals to the government to reconsider the imposition of SST on construction services,' said Wee. 'It is essential to maintain a stable, predictable, and sustainable operating environment for the industry to continue supporting Malaysia's growth and development.' Wee said if the implementation of the 6% SST was 'inevitable', MBAM was of the view that the rate be reduced from 6% to 4% due to the large contract values in the industry. He suggested that the SST should only be levied on the service portion of the contract value, with the non-service portion – including building materials and other hardware – to be exempted. Wee also hoped Putrajaya would consider postponing the introduction of the SST on the construction industry as the July 1 implementation date provided insufficient lead time for the industry to respond. He said a reasonable grace period must be granted to allow all stakeholders to make necessary adjustments and financial preparations. The finance ministry yesterday said an expanded sales and service tax would be implemented from July 1, which will see a sales tax of 5%-10% imposed on selected and non-essential goods. The service tax will be expanded to include new services such as construction, rental or leasing, finance, private healthcare, education and beauty.

(99 Speedmart pic) PETALING JAYA : The Employees Provident Fund (EPF) clarified it only bought a 0.07% stake in 99 Speed Mart Retail Holdings Bhd in its latest acquisition last week. In a rather embarrassing development, EPF issued an 'amended announcement' in a filing with Bursa Malaysia today stating it bought six million shares in the minimart chain operator on June 4. In its bourse filing yesterday, the provident fund announced it acquired 421.79 million shares, or a 5.02% stake, on June 4. Today's filing implies that EPF had previously accumulated a total of 4.95% equity interest in the country's largest operator of grocery stores. The acquisitions were made through Citigroup Nominees (Tempatan) Sdn Bhd. The latest purchase of 0.07% upped its stake to 5.02%, beyond the 5% threshold, thus making EPF a substantial shareholder. 99 Speed Mart's single largest shareholder is its founder and CEO Lee Thiam Wah, who controls 79.68% equity interest in the company. The group was granted a waiver from the Securities Commission Malaysia from having to meet the minimum 25% public spread requirement for its listing exercise. 99 Speed Mart ended the day up 9 sen or 4.3% at RM2.19, valuing it at RM18.4 billion. Its shares have dropped 11% year to date. Despite that, the stock has jumped almost 33% since the company was listed last September at an IPO price of RM1.65. The listing was Malaysia's largest in seven years and catapulted the wheelchair-bound Lee to billionaire status. Forbes ranks him at No 8 in its Malaysia's 50 Richest list, with a net worth of US$4.1 billion (RM17.37 billion). Lee, 61, who contracted polio as an infant, started his entrepreneurial journey by selling snacks by the roadside as a teenager. 99 Speed Mart kicked off its first quarter ended March 31 (Q1 FY2025) with a robust 7.5% rise in net profit to RM143.18 million despite rising uncertainty in the Malaysian economy. Its revenue grew at a similar pace, rising 7.7% to RM2.61 billion from RM2.43 billion in Q1 FY2024, driven by stronger retail sales and network expansion.

KUALA LUMPUR: Umno president Datuk Seri Dr Ahmad Zahid Hamidi said he is on good terms with Tengku Datuk Seri Zafrul Abdul Aziz, despite the latter's departure from the party. Zahid, who is also the deputy prime minister, said that while they now represent different political parties, such differences must be set aside in a professional manner. Asked if his relationship with Tengku Zafrul was good, Zahid indicated that it was. "There's just no kissing," he said in jest to reporters after attending the 2025 Women in Export Forum here today. He added that both parties understand the clear boundary that political considerations must be set aside when it comes to managing organisations and, more importantly, governing the nation, particularly in matters of the economy and trade. Meanwhile, in his earlier speech, Zahid said that differing political views must now be set aside, emphasising that what matters most is the national agenda and the agenda for women. "When I was instructed by Tan Sri Sharizat to attend today's event, I had no choice but to come. "When she asked me whether this programme should proceed, given that the investment, trade and industry minister is no longer from the same party as me, my response was spontaneous… Party affiliation is a separate matter and we must set it aside. "We must act professionally... put aside politics, set aside differences," he said. On May 30, Tengku Zafrul said he had submitted his resignation from all posts in Umno, along with his membership in the party, and had expressed an intention to join PKR.
