Contempt case: Kunal excused from appearing before HC

Kolkata: Calcutta High Court on Monday dispensed with the personal appearance of Kunal Ghosh and other accused in a contempt of court case concerning a ruckus in front of chambers of high court lawyers at Old Post Office Street and Kiran Shankar Roy Road on April 25.
The division bench of justices Arijit Banerjee, Sabyasachi Bhattacharyya and Rajarshi Bharadwaj excused the personal appearance upon an undertaking that the alleged contemnors would appear as and when directed by the court.
Senior counsel for the accused, Kalyan Bandyopadhyay, opened his argument by pleading that the bench didn't have the jurisdiction to issue a contempt rule. "The CJ on his administrative side assigned the matter to the special bench.
It was not a judicial order," he argued.
Citing rules under the Calcutta High Court Contempt of Courts Act, 1975, Bandyopadhyay pleaded that the HC could issue a contempt rule on "its own motion" after hearing petitions of contempt that were moved before the bench.
Bandyopadhyay pointed out that no such petition had been moved before the division bench of CJ TS Sivagnanam and Justice Chaitali Chatterjee (Das) a day after the incident.

Kolkata: With rain on mind, which can slow down traffic on July 21, Kolkata Police will deploy 5,500 cops at the city centre, and thousands more will be posted from the city's fringes to the Maidan for smooth commuting, officers said. Calcutta High Court sets ‘office hour' curbs for Mamata's July 21 rally
The Calcutta High Court on Friday (July 18, 2025) directed that all processions heading to the Trinamool Congress's rally at Central Kolkata's Dharmatala on July 21 must reach the venue by 8 a.m. or after 11 a.m., to ensure the smooth flow of traffic through Central Kolkata during rush hour. The single bench of Justice Tirthankar Ghosh directed that processions will be allowed until 8 a.m. and will be given until 9 a.m. to settle down. Processions will be allowed to resume only after 11 a.m. to prevent traffic congestion in Kolkata's central business district between 9 a.m. and 11 a.m., the court said. 'From 9.00 a.m. to 11.00 a.m., the police authorities would ensure that there is no traffic congestion through the routes which will lead to the High Court at Calcutta or within a fringe of 5 kilometers where the Offices are situated at the Central Kolkata… Commissioner of Police, Kolkata would ensure that deployment of police force be adequately maintained to ensure smooth traffic movement,' the Court's July 18 order reads. The Trinamool Congress has been hosting a massive Martyrs' Day rally in Central Kolkata on July 21 for the last two decades in remembrance of 13 people killed in a police firing during a protest movement by the West Bengal Youth Congress on 21 July 1993, according to the party's official website. Justice Tirthankar Ghosh, on Thursday, in a verbal observation, also urged the Trinamool Congress to choose a different venue for the Martyrs' Day rally from next year, such as Shahid Minar, the Brigade Parade Ground, or the Salt Lake Stadium. ‘Fake permission': Delhi forest dept to Supreme Court on tree felling in Ridge area; forged document used for Vasant Kunj housing project
NEW DELHI: The Delhi forest department has informed the Supreme Court that a 'fake permission' was fraudulently issued in the name of the deputy conservator of forests, allowing tree felling in the ecologically sensitive Ridge area of Vasant Kunj for a housing project. The disclosure came in an affidavit submitted in response to a petition filed by environmental activist Bhavreen Kandhari. The plea alleges that the land falls within a morphological ridge protected under the Supreme Court's May 9, 1996 order, which mandates prior permission for any tree felling or land diversion. "It is pertinent to mention that it had come to the attention of the answering respondent that a fake permission was issued for tree felling in the name of the office of the deputy conservator of forests/tree officer West Forest Division, which was found issued to Rakesh Kumar Sharma...," the affidavit stated. The affidavit, filed by the deputy conservator of forests (West Division), said a letter was written on December 13 to the Station House Officer of Vasant Kunj Police Station, seeking registration of an FIR over the alleged forgery. On May 7, the apex court issued a show-cause notice to relevant authorities, questioning why contempt proceedings under the Contempt of Courts Act, 1971, should not be initiated for the alleged violation of its 1996 order. The matter is scheduled to be heard on July 21 by a bench led by Justice Surya Kant.
