‘Over giving quote to media': Bombay HC revokes suspension issued by IIT, reinstates research student

The Bombay High Court has ordered that the suspension of an Indian Institute of Technology (IIT)-Bombay research scholar, issued on April 28 for allegedly giving a quote to the media, will cease to be effective from July 25, reinstating him as research student.
Akshay M Sawant, a PhD student in the Department of Humanities and Social Sciences at the IIT Bombay and a member of the Ambedkar Periyar Phule Study Circle (APPSC), an informal student collective active on campus, was suspended in April this year following allegations that he gave an 'unauthorised' statement to a news outlet in February regarding his department's initiative to make arrangements for Ramadan.
Sawant moved the Bombay High Court against the suspension order issued by the institute which stated that he is suspended until December 31, 2025, an action taken as per the recommendations by the disciplinary action committee.
Sawant's plea stated that he had addressed a detailed written communication to the IIT-Bombay explaining how charges levelled against him were unfounded but the Institute's Fact-Finding and Disciplinary Action Committees failed to consider the same. Aarguing that the suspension would have a 'severe and adverse impact' on his academic and career prospects, the petition, sought from the court that the 'arbitrary' April 28 suspension order be quashed and set aside and the Institute be directed to revoke the suspension and restore his entitlements as a student with effect from April 28.
On July 15, the petitioner gave an undertaking to the high court that he would abide by all institute Rules and Regulations, including the Interim Guidelines for students of November 2023 related to holding of events at IIT-Bombay.
'In view of the above undertakings, the suspension will cease to have effect from 25th July 2025,' the HC noted.
Hearing his plea on July 15 against the suspension, a division bench of Justices Makarand S Karnik and Nitin R Borkar stated that 'the period of suspension undergone by him will not be treated as stigmatic or have a bearing on the record of the petitioner'. The order was made available on Friday.
This came after senior advocate Mihir Desai and advocate Lara Jesani for the petitioner submitted that he was willing to put it on record with the IIT-Bombay that he did not make the statements referred to the article in question as an authorised representative of the institute, but the same were made in his individual capacity.
Disposing of the plea, the bench further clarified that the order was passed 'in the peculiar facts and circumstances of the case so that the academic career of the petitioner should not be jeopardised'.
There is no response from the IIT-Bombay administration on the matter.
The APPSC on Friday issued a statement in solidarity. 'This case is not an isolated incident. It reflects a broader, systemic pattern of targeted actions against student community in general and particularly more harsh towards those who engage in critical discourse around student rights, institutional accountability, and the rights of SCs, STs, OBCs, minorities, workers' right inside campus and other marginalised communities to build moral pressure on the administration. It is in this context that we must view the administration's increasingly repressive measures, including the Interim Guidelines on Holding Events at IIT Bombay,' read the statement, demanding withdrawal of the guidelines.
The guidelines issued in November 2023 made it mandatory that public events organised by the faculty should be approved by the head of the academic unit, while for events organised by students, official permission is needed from the administration. It also announced that an approval from an 'external speaker review committee' will be mandatory to invite an outside speaker to the institute.
The guidelines included a stern warning that disciplinary action will be taken against anyone, including students, who violate defamation rules or indulge in any form of indiscipline.

Over five months after it reserved verdict on death confirmation pleas filed by the state and appeals by the accused against their conviction in the 7/11 train blasts case of 2006, the Bombay High Court will pronounce the judgement Monday. After conducting hearings over six months, special bench of Justices Anil S Kilor and Shyam C Chandak on January 31 this year reserved its verdict on pleas filed in the high court. In 2015, the special court convicted the accused who have been in jail for over 18 years. On July 11, 2006, a series of bombs ripped through seven western suburban coaches of a train, killing 189 commuters and injuring 824. After an over eight-year trial, a special court under the Maharashtra Control of Organised Crimes Act (MCOCA) in October 2015 awarded death penalty to five of the convicts and life terms to seven others. Death row convicts Kamal Ansari from Bihar, Mohammad Faisal Ataur Rahman Shaikh from Mumbai, Ehtesham Qutubuddin Siddiqui from Thane, Naveed Hussain Khan from Secunderabad and Asif Khan from Jalgaon in Maharashtra were found guilty of planting the bombs. Those awarded life term were Tanveer Ahmed Mohammed Ibrahim Ansari, Mohammed Majid Mohammed Shafi, Shaikh Mohammed Ali Alam Shaikh, Mohammed Sajid Margub Ansari, Muzammil Ataur Rahman Shaikh, Suhail Mehmood Shaikh and Zameer Ahmed Latiur Rehman Shaikh. One of the accused, Wahid Shaikh, was acquitted by the trial court after nine years in jail. The Maharashtra government in 2015 approached the HC with pleas seeking confirmation of death penalty granted to five convicts. On the other hand, the convicts filed appeals challenging the special court order. Ansari, one of the convicts on death row, died due to Covid-19 in Nagpur prison in 2021. As the accused sought speedy disposal of the matter, the HC in July 2023, constituted a special bench led by Justice Kilor, which conducted regular hearings through more than 75 sittings. The lawyers representing the convicts argued that their 'extra-judicial confessional statements' obtained by the Maharashtra Anti-Terrorism Squad (ATS) through 'torture' were inadmissible under the law. They also argued that the accused were falsely implicated, innocent and were languishing in jail for 18 years without substantial evidence and their prime years were gone in incarceration. The appellants said that the trial court erred in convicting them and therefore the said order be set aside. The Maharashtra government opposed the appeals by convicts and claimed that the probing agency had provided sufficient evidence to establish it was 'rarest of the rare' case to sentence the accused to death penalty.

Panaji : The Goa Information Technology Development Corporation (GITDC) intends to set up new citizen service centres (CSC) in Dharbandora, Sanquelim, Panaji and Bicholim. The corporation will spend close to 90 lakh to setup the facilities, which will enable citizens to get access to different govt services from one location. CSC is a single-window facilty that provides govt services to the citizen in a time-bound manner. These facilities cater to all online and offline citizen services provided by various departments for a fee. The major benefits of CSCs are that it provides a single window counter to avail the services and citizen need not visit multiple govt offices. Interestingly, while govt has been pushing for CSCs as a means to make it simple for citizens to access govt services, the CSC operators and village-linked entrepreneurs (VLEs) who serve as gramin mitras, are struggling with delays and flawed integration with Goa's digital services. A delegation of CSC and VLE representatives met chief minister Pramod Sawant at Ravindra Bhavan, Sanquelim on Sunday to draw his attention to concerns such as delayed incentives, loan scheme implementation, pending bills, and integration into Goa's digital services. Sawant assured them that he would resolve their concerns. The CSCs also provide status updates of the application via SMS to the applicant. The GITDC wants the new CSCs to be ready within four months once the contractor is appointed. The contractor for the project will have to provide a defect liability period for three years after the date of completion According to the GEL, govt currently has CSCs at Mapusa bus stand, Pernem, Honda KTC bus stand, at Margao's Matanhy Saldanha Administrative Complex, Canacona KTC bus stand, Quepem govt office complex, Sanguem govt office building and Ponda KTC bus stand.
