‘Hiding Facts Is Fraud On Court': Allahabad HC Rejects PIL, Slaps Rs 15,000 Fine

The Allahabad High Court has dismissed a public interest litigation (PIL) filed by one Manish Kumar, holding that the petitioner concealed crucial information about an earlier identical case and misused the judicial process. The court also imposed a cost of Rs 15,000 on the petitioner.
Justice Kshitij Shailendra noted that Kumar had previously filed a PIL involving the same property and the same respondent (Respondent No. 6), which was withdrawn on May 12, 2025, without seeking liberty to refile. Despite this, Kumar approached the court again with a fresh PIL without disclosing the earlier proceedings.
The high court held that such suppression amounted to a serious misuse of the process of law. 'Non-disclosure of the previously filed writ petition and its result amounts to misuse of process of law," the judge observed.
The objection to the maintainability of the PIL was raised by Anil Kumar Shukla, counsel for Respondent No. 6, who argued that the petition was filed to harass his client. The court found merit in the argument and stated that the circumstances indicated the PIL was likely driven by personal motives rather than genuine public interest.
The bench also noted that both petitions were filed by the same advocate and involved identical parties and property details. It further pointed out that the petitioner had identified himself as a social worker but failed to provide any evidence of actual social work.
Citing precedents from the Supreme Court, including Dalip Singh v. State of U.P. and K.D. Sharma v. Steel Authority of India Ltd., the court said litigants who mislead the court by suppressing facts are not entitled to any relief.
As a consequence, the PIL was dismissed with a cost of Rs 15,000 to be deposited with the Registrar General of the High Court within two weeks. If the petitioner fails to comply, the District Collector of Hathras has been directed to initiate recovery proceedings.
The court ordered that the amount be credited to Tara Sansthan and used solely for the welfare of elderly residents at the Rabindra Nath Gaur Anand Old Age Home in Prayagraj. The institution has been asked to file statements on the use of funds with the Registrar General until the full amount is utilised.

The Maharashtra government on Wednesday appointed five senior IAS officers to monitor and oversee the implementation of development plans for five major Jyotirling pilgrimage sites of the state. According to officials, the appointments were made as per the directions of Chief Minister Devendra Fadnavis and the move is aimed at ensuring time-bound and high-quality execution of the Jyotirlinga development projects at Bhimashankar (Pune), Grishneshwar (Chhatrapati Sambhajinagar), Trimbakeshwar (Nashik), Aundha Nagnath (Hingoli), and Parli Vaijnath (Beed). Each officer will oversee progress and report directly to the Chief Minister's Office. These Jyotirling temples are among the twelve most revered Shaivite shrines in India and attract lakhs of pilgrims annually. The state had earlier approved development master plans for each site through a high-level committee and followed by formal government resolutions allocating funds for it. 'This is the first time senior officers have been designated for direct oversight of religious infrastructure projects at this level. The aim is for coordinated, efficient, and transparent execution,' a senior official from the CMO said. The state government has already allocated funds for the development of these sites. Rs 148.37 crore has been allocated for Bhimashankar, Rs 156.63 crore for Grishneshwar, Rs 275 crore for Trimbakeshwar, Rs 15.21 crore for Aundha Nagnath, and Rs 286.68 crore for Parli Vaijnath in Beed.

Jaipur: Public health engineering department (PHED) has issued notices to six engineers of the department, including a retired engineer, for alleged involvement in a scam of Rs 150 crore. Officials said these engineers reportedly gave Operations and Maintenance (O&M) tenders to two firms for more than 900 tubewells in Jalore district when they were entitled to O&M of only 20 tubewells. "We took up the issue with PHED minister Kanhaiya Lal Choudhary. Following his instructions, we are going to take major steps against these accused engineers. We will also lodge complaints with police in this regard," disclosed a senior PHED official Wednesday. An official of the department claimed that the accused—then executive engineers Umesh Kumar Meena, Shyam Bihari Bairwa, Jitendra Trivedi, Hemant Kumar Bairwa, Ashish Dwivedi (retd), and Hemant Kumar Vaishnav—gave the work orders for O&M of 981 tubewells on Aug 12, 2022, to two firms—MM Construction and MS Raj Enterprise. "In gross violation of norms, the then superintendent engineer of the circle issued this work order for 981 tubewells. The two firms should have got work orders for only 20 tubewells. For the last three years, the department is unnecessarily wasting money on O&M expenditure for such a huge number of additional tubewells. The department has also blacklisted the two firms," the official added. Investigation revealed that PHED bore O&M expenditure for around 3,500 tubewells in Jalore for the last three years, when the actual number of tubewells of the department in the district was only close to 1,500.
