Attorney aims to discredit criminal homicide charge with fatal accident statistics

Jun. 3—WILKES-BARRE — When Louis Weihbrecht was charged with an open count of criminal homicide for what District Attorney Sam Sanguedolce alleged was the deliberate killing of Mark Svadeba in September, Attorney John B. Pike is fostering a defense alternative.
Svadeba's death was simply an accident, Pike fiercely advocated during a motions hearing before Luzerne County Judge Joseph F. Sklarosky Jr. on Tuesday.
Weihbrecht, 56, proprietor of the Outsiders Bar on South Main Street, Wilkes-Barre, was charged by Plains Township police and detectives from the district attorney's office with the open count of criminal homicide, alleging he intentionally ran over Svadeba with his 2007 Chevrolet Silverado truck on Sept. 13, 2024.
Court records say Svadeba was standing next to his Harley-Davidson motorcycle in front of an auto-repair garage on North Main Street, Plains Township, when Weihbrecht showed up in the Chevrolet truck.
Svadeba and Weihbrecht exchanged words when Weihbrecht, court records allege, intentionally ran over Svadeba, dragging him nearly 30 feet. The two men were reportedly in a dispute about a woman.
Following Weihbrecht's arrest on Sept. 16, 2024, Sanguedolce, during a news conference, explained the open count of criminal homicide was filed as investigators believe Weihbrecht intended and deliberately ran over Svadeba.
During Tuesday's motions hearing, Pike used Pennsylvania and Luzerne County statistics of pedestrians killed by a motor vehicle, and none rose to the level of a criminal homicide offense. Pike countered by explaining Svadeba walked in front of Weihbrecht's truck.
"This was a motor vehicle accident versus a pedestrian, that's all this is," Pike argued.
Assistant District Attorney James L. McMonagle responded that there is clear and convincing surveillance footage that shows the two men arguing, and Weihbrecht accelerating his truck to run over Svadeba for nearly 30 feet and backing up the truck to run over Svadeba a second time. McMonagle further argued the parking lot was adequately illuminated by lights.
Pike is advocating Weihbrecht only intended to strike the Harley-Davidson motorcycle when Svadeba walked in front of the truck.
Other issues argued during the motions hearing were to limit the testimony of the prosecution's expert who inspected Weihbrecht's truck and to prohibit any personal opinions about the vehicle, and to prohibit prosecutors from identifying Svadeba as a "victim" before the jury.
Sklarosky said he will issue his rulings at a later date.
Weihbrecht's trial is scheduled for September. He remains jailed without bail at the county correctional facility.

The Detroit Three automakers have criticized a deal that would cut tariffs on British car imports but not on Canada or Mexico production. Trump cited a series of recent investment announcements including GM saying this week that it plans to invest $4 billion in three U.S. plants and move some SUV production from Mexico. He also noted a $21 billion Hyundai investment announced in March including a new U.S. steel plant. "They wouldn't have invested 10 cents if we didn't have tariffs, including for manufacturing American steel, which is doing great," Trump said. Mexico said last month that cars assembled in Mexico and exported to the U.S. will face an average tariff of 15%, not 25% because Washington is giving automakers reductions for the value of U.S. content. Automakers are facing increasing cost pressures stemming from tariffs. In recent weeks, Ford Motor and Subaru of America have hiked prices on some models due to higher costs from Trump's tariffs. In May, Ford estimated tariffs would cost it about $1.5 billion in adjusted earnings. GM said last month it had a current tariff exposure of between $4 billion and $5 billion, including about $2 billion on the more affordable vehicles GM imports from South Korea, where it makes entry-level Chevrolet and Buick models. Reform UK has expelled its candidate in a Sefton council by-election after "unacceptable" comments surfaced on social media. The party confirmed it had removed its support for Irene Davidson, who was due to stand as a candidate in the Blundellsands by-election on 19 June. Davidson's X account has now been deleted. Some of the posts from Davidson's account, seen by the BBC, included a cartoon of King Charles labelled as a traitor, and calls for Islam to be "eradicated" from the UK. Despite being expelled from the party, Davidson will still appear on the ballot paper as Reform UK's candidate as the papers have already been printed. A spokesperson from Reform UK said Davidson had "failed to disclose her social media account to the vetting team". "As a result of her unacceptable comments she was swiftly expelled from the party and support for her candidacy has been withdrawn. "Reform UK is completely opposed to any form of discrimination." MEMPHIS, Tenn. — Police arrested another man on Tuesday after two men were arrested last week in connection with the Mud Island shooting. Hunter Maness, 33, was charged with Accessory after the Fact to wit: Criminal Attempt to wit: First Degree Murder, Accessory after the Fact to wit: Employment of a Firearm During the Commission of a Dangerous Felony, Accessory after the Fact to wit: Theft of Property to wit Motor Vehicle $2,500-$10,000, and Accessory after the Fact to wit: Criminal Attempt to wit: Carjacking. Maness is scheduled to appear in court on Wednesday. On June 2 at 12:45 p.m., officers responded to a shooting at Island Place East and Island Village Drive. Police said the suspects were three men in a red Chevrolet Silverado. They said that the suspects cut the victim off and attempted to steal his 2020 Ford F-150 before they shot him and fled. When the male victim was shot, he tried to get away from the suspects but ended up crashing into a mailbox. That crash caught the attention of a witness, who helped the victim stay awake until paramedics arrived. Arrests made in connection to Mud Island shooting Two other witnesses heard the gunshot, and one of them had video footage that captured the suspects' truck. The male victim was taken to Regional One in critical condition. At last check, he is expected to survive. Violent Crime Investigators arrived at the scene and gathered evidence. They determined that the suspect vehicle was stolen from the 1500 block of Monroe earlier that morning. On June 3, 2025, at 1:30 p.m., officers responded to a suspicious vehicle in the 100 block of East Holmes Road. The red Chevrolet Silverado was recovered and towed to the city lot. On June 5, 2025, DeSoto County investigators reached out and provided information on this case. VCU was advised that when DeSoto County assisted MPD with the arrests of Christopher Skelton, 29, and Justin Furnish, 42, for unrelated charges on June 2, 2025, the red truck was at the scene.
