Marriage declared null & void, but wife can still claim maintenance under Domestic Violence Act: Bombay HC

This reaffirms that annulment does not dilute a woman's rights under protective legislation.
Justice Urmila Joshi-Phalke dismissed a criminal revision plea filed by a Jaripatka-based private sector employee, who challenged the lower courts' decision ordering him to pay ₹5,000 in monthly maintenance, ₹2,000 in house rent, and ₹50,000 as compensation to his estranged wife. The man contended that since his marriage was annulled ex parte by a family court in 2017, the woman ceased to be his wife and was therefore not entitled to maintenance.
Rejecting this argument, the court observed that the family court's decree of nullity was passed without the wife's presence and was based entirely on unsubstantiated claims made by the petitioner. "When a husband levels serious allegations of such a nature, the onus on him is very heavy," Justice Joshi-Phalke noted, adding, "in ex parte proceedings, the plaintiff retains the burden of proof".
The man alleged that the woman concealed a prior relationship before marriage on November 6, 2016, and used this claim as basis for annulment.
However, the court found his statements vague and without corroboration. "He neither examined any witnesses nor produced any solid proof. His evidence is not specific," the judge remarked.
The woman had moved a complaint under the Domestic Violence (DV) Act in Katol magistrate court, citing mental abuse, insult, and restrictions imposed on her communication with her parents. She said she was forced to leave the matrimonial home and return to her parental house due to mistreatment, and since no provision for her maintenance was made by her husband, she was entitled to relief under DV Act.

The high court affirmed the earlier rulings of the magistrate and sessions courts, upholding her entitlement to maintenance despite the annulment. "Considering the fact the wife has no source of income to lead her life, the family court granted compensation. I do not find any illegality in the order," Justice Joshi-Phalke concluded.
Key Takeaways from Bombay High Court Ruling:
Ex parte annulment based solely on vague or unsubstantiated claims carries limited legal weight
Burden of proof lies on husband in such cases, particularly when making serious allegations
Relief under Domestic Violence Act is not contingent on legal status of marriage
Protective legislation remains applicable if evidence of abuse or abandonment is credible

JeM Terror Recruitment Module Busted In Jammu And Kashmir; 10 Detained
A terror recruitment and financing module operated by Jaish-e-Mohammed (JeM) commander Abdullah Ghazi, alias Shaukat Ali, from Rawalpindi, Pakistan, has been busted. Ten individuals have been detained for questioning. The Counter-Intelligence Kashmir (CIK) traced suspicious technical signatures through a specific encrypted messaging application widely used by terrorists and their handlers for coordinating, financing, and executing terror activities during today's raids. The investigation revealed that Ghazi was in continuous contact with local Kashmiri youth, attempting to radicalise them for recruitment into JeM and Lashkar-e-Taiba (LeT). Raids were conducted at 10 locations with a focus on disrupting a terrorist sleeper cell and recruitment module. Sleeper cells consist of individuals who blend into society, often without the knowledge of family or friends and engage in covert activities such as target killings, grenade attacks, or distributing terrorist propaganda. During the raids, several documents and digital devices, including mobile phones, were seized, providing critical evidence to unravel the terror network. Ten suspects were detained for allegedly using encrypted apps to coordinate with handlers across the border. The operation highlighted a shift in terror strategy toward 'Cyber Jihad,' where Pakistan-based operatives use encrypted apps, proxy numbers (including Indian ones), and virtual identities to radicalize youth. The process involves identifying vulnerable individuals on public platforms, then shifting to encrypted apps for mission assignments such as surveillance, arms transport, target selection and luring them with promises of financial rewards and religious justification. This is the fifth major digital terror module dismantled by CIK, following similar operations against Pakistan-based terrorist handlers. With declining local recruitment, Pakistan-based terror groups like JeM and LeT have increasingly relied on digital platforms for radicalising and recruiting Kashmiri youth into terror organisations.

Watchman held for growing cannabis in vacant plot in Hyderabad
A 45-year-old man working as a watchman at an apartment complex in Vittalwadi was arrested by the Narayanguda police for cultivating cannabis in a vacant plot adjacent to the building. The cannabis plants were spotted when some police officers took shelter near the plot during the rain on Saturday, July 19. The accused, identified as Kailash Joshi, had been employed as a watchman at Neeraj Villa Apartment. An officer from Narayanguda police said he had been growing the plants in an open plot situated between Neeraj Villa and Kirti Enclave, which had remained unoccupied for nearly a decade due to ownership disputes. Following a tip-off, a police team led by Sub-Inspector Nagaraju, conducted a raid on the site with the assistance of the clues team. Joshi was found digging near the cannabis plants and attempted to flee when he saw the officers, but was apprehended and taken into custody. During questioning, Joshi reportedly confessed to having a long-standing habit of consuming cannabis by boiling it in milk. 'Facing difficulty in sourcing it, he decided to cultivate the drug himself using the unused plot behind the apartment where he worked,' said the officer, adding that he brought cannabis seeds from his hometown in Uttarakhand and sowed them among pumpkin plants to avoid suspicion. A total of 15 cannabis plants weighing 4.2 kilograms were seized, along with a digging tool and a mobile phone. Joshi, a resident of King Koti Road in Himayathnagar, was booked under relevant sections of the NDPS Act. Further investigation is underway.
