Supreme Court says it feels 'ashamed' over rising crimes against women

The Supreme Court (SC) on Monday said it feels "ashamed" seeing so many cases of violence against women, reported LiveLaw.
The oral observation was made by Justices Surya Kant and Justice Joymalya Bagchi while hearing a writ petition filed by the Supreme Court Women Lawyers Association, calling for stronger implementation of laws meant to protect women from sexual offences, the report added.
While addressing Additional Solicitor General Aishwarya Bhati during the hearing, Justice Kant said, Justice Kant said: "Just examine possible solutions-which are comprehensive directions which can be effectively issued to make sure the impact we want to leave should be there...so many voiceless people in remote areas, see what we can could for them. Wide publicity may not work out for them, let's accept these ground realities. what is the modicum for them?"
He also suggested that educated people could be trained as paralegal workers to help those with limited access to justice. He said that since women are now elected as sarpanch under panchayat reservations, they could take up these roles as well, according to LiveLaw.
He also said that it is only after a tragedy occurs that efforts are made to find solutions. "This is what is inherently wrong in the system", he added, as quoted by LiveLaw.
What does the petition demand?
The petition seeks a set of 'Pan-India Safety Guidelines, Reforms and Measures for Protection of Women', according to LiveLaw.
"It is also urged that every convict u/s 376 IPC and Section 63 BNS, 2023 shall be punished with life imprisonment and permanent castration in cases of horrendous rape and murder of female and child victims," it demanded,
It also sought the creation of a National Sex Offenders Registry that should be accessible online to all women, enabling them to identify repeat sexual offenders and take necessary precautions.
It also urged the Court to apply the parens patriae doctrine to protect the fundamental rights of women, children, and the third gender, particularly their right to safety and a secure environment. It claimed that offenders in such cases have no fear because of the corruption, apathy, and lack of commitment among police and administrative bodies, because of which the laws are not implemented effectively.
The Court has posted the matter for further hearing on July 29.

BCD warns advocates against online, YouTube solicitation

New Delhi, Aug 6 (UNI) The Bar Council of Delhi has issued a stern notice cautioning advocates against advertising or soliciting legal work through social media platforms. The regulatory body has flagged the increasing trend of lawyers and self-proclaimed 'legal influencers' posting promotional videos, client interactions, and other content online, which it deemed unethical and in violation of Rule 36 of the Bar Council of India Rules. While issuing a notice, BCD Chairman Surya Prakash Khatri emphasised the seriousness of the matter and stated that such conduct undermines the dignity and sanctity of the legal profession and poses a risk of spreading misinformation, particularly when done by individuals who lack proper legal qualifications or licensing. The Council's notice directs all advocates currently engaged in such activities to take down their content with immediate effect. Failure to comply, it warned, could invite disciplinary action under Section 35 of the Advocates Act, 1961, including suspension or cancellation of their license to practice law. The Bar Council reaffirmed its commitment to upholding the ethical standards of the legal profession and cautioned members of the Bar to refrain from indulging in direct or indirect forms of advertisement or self-promotion that could erode public trust in the legal system. Under HC lens, Punjab govt puts land pooling policy on hold for a day

Chandigarh: The Punjab govt on Wednesday informed the Punjab and Haryana high court that its contentious Land Pooling Policy 2025 would be kept on hold and no further steps taken until the next hearing on Thursday. The state govt's decision came in response to a petition challenging the policy, which aims to acquire thousands of acres of land for developing residential and industrial zones. When the matter came up for hearing, the advocate general, Punjab, requested time to address the contentions in the petition challenging the policy. A bench, headed by Justice Anupinder Singh Grewal, directed the Punjab govt to clarify whether the policy includes provisions for the rehabilitation of landless labourers and others dependent on the land for their livelihood. The bench further questioned the state on whether a social impact assessment was conducted before the policy was notified. It also referred to a Supreme Court verdict in a case of Residents' Welfare Association and another versus Union Territory of Chandigarh emphasising the need for an environmental impact assessment before urban development. The petition was filed by Gurdeep Singh, a 72-year-old resident of Ludhiana, who claimed to have inherited six acres of agricultural land. He argued that the policy is illegal and violates fundamental rights by bypassing mandatory procedures under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (LARR Act). Singh's plea stated that the land notified for the policy is multi-cropped and irrigated, and that the state failed to follow the necessary provisions of the LARR Act. MSID:: 123143951 413 |

2 days after wife was found hanging merchant navy officer is arrested

Lucknow: Two days after Madhu Singh, 26, wife of the merchant navy officer, was found hanging at her apartment in Gomtinagar Extension, Police on Wednesday arrested her husband, Anurag Singh, 31. The arrest came after the victim's father lodged an FIR, accusing the husband of subjecting his daughter to mental and physical torture for dowry and pressuring her to terminate her pregnancy. The accused, Anurag Singh, son of Avdhesh Singh and a resident of Omaxe Waterscape in Sushant Golf City, was taken into custody by a team from the local police station following a detailed probe, said DCP South Nipun Agarwal. The FIR has been registered under sections 85 (cruelty by husband or his relatives), 89 (causing miscarriage without consent), and 80(2) (dowry death) of the Bharatiya Nyaya Sanhita (BNS), along with Sections 3 and 4 of the Dowry Prohibition Act, 1961. "During interrogation, Anurag admitted to having frequent disputes with his wife. He was arrested from his residence and produced before the court after completing legal formalities," said DCP Agarwal. The victim's father, Fateh Bahadur Singh, alleged that his daughter was regularly harassed for dowry. A major altercation reportedly occurred on the night of Aug 3, after which the woman was found dead under suspicious circumstances. Anurag Singh is employed as a second officer with a merchant navy company.
