Waqf law: Strong case needed to stay law, says SC

New Delhi, May 20, (UNI) In a significant hearing on Tuesday, the Supreme Court examined petitions challenging the Waqf (Amendment) Act, 2025 for over three hours, focusing primarily on the issue of interim relief.
A bench comprising Chief Justice of India BR Gavai and Justice AG Masih heard arguments centred on whether to grant a stay on the amended law.
During the session, CJI Gavai emphasised that a "very strong and glaring case" must be made out for any statute to be stayed. 'There is a presumption of constitutionality in favour of every statute. For interim relief, a very strong case is required. Otherwise, this presumption will prevail,' the CJI observed.
Senior advocate Kapil Sibal, appearing for the petitioners, asserted that the 2025 amendments posed an imminent threat of "irreparable injury" if implemented. He claimed the petitioners had a solid prima facie case against the amendments.
Solicitor General Tushar Mehta, representing the Union government, requested the court to limit the hearing to three specific issues, as identified by the previous bench on April 16. He noted that the petitioners' written submissions exceeded this scope.
'The court had confined the hearing to three issues. We submitted our response accordingly. However, the petitioners have now broadened the scope. My affidavit addresses only those three issues,' SG Mehta argued.
In response, senior advocates Kapil Sibal and Dr. Abhishek Manu Singhvi opposed any narrowing of the hearing.
Sibal contended that no such restriction was placed by the court in its earlier order, stating that the nature of the challenge required a comprehensive hearing.
CJI Gavai remarked that the bench would proceed based on the court record and invited Sibal to begin his submissions.
Opening his arguments, Sibal strongly criticized the 2025 amendments, stating that they were intended to "capture Waqfs" by granting government officers quasi-judicial powers.
He objected to the provision that allows a government official to decide whether Waqf land is encroaching on state property a move he called unconstitutional.
He further argued that the amendments nullified the principle of 'once a Waqf, always a Waqf.' Under earlier laws, non-registration of Waqf properties did not affect their validity, and only resulted in penalties for the caretaker (Muttawalli). But under the new law, non-registration could strip a property of its Waqf status entirely.
The bench noted this submission, stating, "From 1913 to 2023, though registration of Waqf was mandated, no serious consequences followed except removal of the Muttawalli. The 2025 amendments depart from this framework."
Sibal also highlighted challenges surrounding Waqf-by-user, noting that requiring identification of the original creator is problematic, particularly for centuries-old properties. If the creator's details are not provided, the Muttawalli now faces up to six months' imprisonment.
Another contentious issue raised was the amendment's impact on religious structures declared as protected monuments under the AMASR Act.
Sibal argued that the law invalidates Waqf declarations for such properties, violating fundamental rights under Articles 14, 25, and 26 of the Constitution. Citing the Delhi Jama Masjid as an example, he said the mosque continues to function as a Waqf despite being a protected monument.
The hearing will continue on Wednesday, with further arguments expected from both sides.

LUCKNOW The National Green Tribunal (NGT) has granted the UP government four weeks to respond to a case regarding the proposed relocation of Lucknow Zoo to Kukrail and the construction of a night safari in the same area. The tribunal has listed the case for next hearing on August 21. Seeking to remove roadblocks in the ambitious Kukrail night safari project, the UP government had filed an impleadment application in the Supreme Court on April 8, seeking permission to establish the safari and relocate the Lucknow zoo to the Kukrail forest area. The plea is yet to come up for hearing. Lucknow-based social activist Alok Singh filed this case in the NGT. He raised concerns over the night safari project at the Kukrail reserve forest, for which around 1500 trees were proposed to be felled. He also moved the SC on April 11, 2025, on this issue. The Supreme Court has given July 15 as the tentative date for next hearing of the case. A detailed project report (DPR) of the night safari, coming up on a 900-acre maple leaf design in the 2027.46-hectare Kukrail forest, was presented before chief minister Yogi Adityanath on November 19, 2024, roughly two years after its digital survey in December 2022. However, the project got stuck due to the apex court's February 19, 2024 order restraining the central and state governments across the country to establish zoos and safaris in forest areas (other than protected areas) without approval of the top court. This order was passed by a three-judge bench headed by former CJI Justice Dhananjay Y Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra.

Kochi: High court has sought instructions from the state and Travancore, Cochin and Malabar devaswom boards on a petition seeking a declaration that the Religious Institutions (Prevention of Misuse) Act, 1988, applies to all religious institutions located within the jurisdictional limits of these boards, irrespective of whether the institutions are under their management. The petition was filed by N Prakash of Maradu, Ernakulam, who cited certain alleged incidents during the festival at Indilayappan Temple, Avanavanchery, Attingal, in April. According to the petitioner, singer Aloshi performed political songs during a 'Ghazal Night' event, and the play 'Ningalenne Communistakki' was staged on the temple premises on another day. Prakash submitted that a case was registered against Aloshi by police for allegedly singing political songs at the temple. He contended that these incidents had hurt the religious sentiments of devotees and sought action against the temple advisory committee, although the temple is not under the control of any devaswom board. He further alleged that slogans of the Communist Party were raised during a marriage ceremony at the Kailasa Mandapam of the Thali Maha Kshetram in Kozhikode. In a separate petition relating to political songs performed by Aloshi during the festival at the Kadakkal Devi Temple in Kollam, HC had earlier directed the Travancore Devaswom Board (TDB) to ensure that no political activities are permitted within the premises of temples under its management. The present petition seeks a similar directive to cover temples not administered by any devaswom board. HC has adjourned the matter for further consideration after two weeks.

Hyderabad, June 9 (UNI) Union Minister for Agriculture and Farmers Welfare, Shivraj Singh Chouhan, participated in a direct interaction programme with farmers at Mangalapalli in Rangareddy Rural district as part of the ongoing Viksit Krishi Sankalp Abhiyan. Addressing the gathering, the Minister underscored the importance of agricultural self-sufficiency in realising the dream of a developed India. 'For the dream of a developed India to come true, there must be developed work—meaning self-sufficiency in agriculture,' he said. Highlighting the record-level food grain production this year, he credited the resilience and hard work of Indian farmers and emphasided that Viksit Krishi Sankalp Abhiyan was launched with a vision to ensure long-term sustainability and prosperity in farming. Chouhan stressed that agriculture cannot be managed solely from offices and research institutes. 'Our government reaches wherever agriculture happens—wherever farmers innovate and cultivate. We aim to solve problems by connecting directly with farmers at the field level,' he added. He affirmed the Centre's commitment to supporting farmers not only in cultivation but also in marketing their produce. 'Agriculture is not just about vegetables and grains, but also includes avenues like beekeeping which can enhance farmers' incomes,' he said. During the event, the Telangana Farmers' Union, on behalf of the BJP Kisan Morcha, presented a symbolic plough to the Minister as a mark of respect. He was accompanied by Union Minister of State for Agriculture Bhagiratha Choudhary, who was also warmly welcomed by the Kisan Morcha.
