Modack to be sentenced next month

Alleged underworld crime boss Nafiz Modack was found guilty of corruption charges at the Cape Town Regional court on Friday.
The case was postponed to July 8 for Modack to be sentenced.
The conviction comes in the wake of a sentence that was handed down to former top cop Brigadier Kolindren Govender after he entered into a plea agreement with the State after he admitted that he had a corrupt relationship with Modack.
Hawks spokesperson Warrant Officer Zinzi Hani said: 'It was reported that during November 2011, Modack acted with a common purpose by paying gratification in a total amount of R146 000 to Govender in return for special treatment.
'He was also convicted of defeating the ends of justice by preventing his colleagues from performing their duties'
Subsequently, Govender also admitted that during December 2012 he intervened and stopped the recovery by police of a Mercedes Benz.
In doing so he prevented cooperation between an officer from the SAPS Paarl Vehicle Identification Section and the investigating officer in the matter based at the Cape Town Central police station.

Hani added: 'As a result of Govender's action the Mercedes Benz was not seized.'
'The former top cop Kolindren Govender pleaded guilty to 51 charges of corruption that relate to a corrupt relationship he had with alleged underworld figure Nafiz Modack.
"Govender was handed five-years imprisonment of which four and a half years were suspended, on condition that he was not convicted of corruption.'
The court ordered that the sentence would run concurrently with the six-year sentence that was handed down on a different matter.
Meanwhile, the alleged underworld figure faces over 100 charges alongside fourteen other accused in the Charl Kinnear murder trial which has been placed on hold until October.
Former Anti-Gang Unit detective top cop Kinnear was gunned down outside of his house in Bishop Lavis in September 2020.
Modack has two other pending matters including the 'Tax Matter' where he was arrested by the Hawks in 2020 accused of defrauding SARS out of R46 million.
His other matter at a High Court in Gauteng sees Modack facing firearm-related charges.

Image: Doctor Ngcobo / Independent Newspapers The Durban High Court said it was left with no choice but to postpone the R320 million Durban Solid Waste (DSW) tender fraud case involving Zandile Gumede on Wednesday morning, due to the State not being able to access audit reports from the eThekwini Municipality. Gumede, the former mayor of eThekwini, is on trial with 21 others for numerous charges, including money laundering, racketeering, fraud, corruption, and contravention of the Municipal Finance Management Act and the Municipal Systems Act, relating to the R320 million DSW tender. The State, which is currently leading evidence from a new witness, was on Tuesday ordered to obtain the audit report regarding the household numbers that needed to be serviced in the 2016/17 financial year. This came after Gumede's counsel, advocate Jay Naidoo SC, objected while the witness, who cannot be named, was leading evidence. Naidoo stated they would like to access the reports to ensure they were consistent with the witness's oral evidence. The witness told the court earlier this week that in a report submitted to the Bid Adjudication Committee (BAC) on December 19, 2017, the number of formal and informal households that needed to be serviced was doubled, while some had been tripled. The Solid Waste Unit went to the BAC on December 14, 2017, to seek authority to invite quotations from experienced service providers for waste collection and illegal dumping services in the city. In a report, the unit had also included that this was an emergency, as there would be no one to collect waste in January 2018. On December 19, the BAC approved those quotations. The fourth accused, Robert Allan Abbu, served as the deputy head of the unit at the time. The witness, who said she was on leave during this time, said she sent an email to Abbu in February 2018. She stated that she would not be able to defend the number of households that went to the BAC, to the auditors. 'The contract value is misaligned, I am afraid I won't be able to defend this with auditors,' she read her email to the court. On Wednesday, counsel appointed by the National Prosecuting Authority, advocate Viwe Notshe SC, told the court that they had made enquiries with the municipality on Tuesday, and the box with the audit report was found. 'We are unable to get them today to be able to proceed,' he said. Notshe asked for the matter to be remanded until Thursday. 'It seems there is no choice; we have to adjourn till tomorrow (Thursday),' said Judge Sharmaine Balton. On Tuesday, the matter was also adjourned early to allow the State to obtain the audit reports. [email protected]

New Brighton shop owner kidnapped, Hawks investigation under way
The Hawks are investigating a kidnapping that took place in New Brighton on Tuesday evening, with 'law-enforcement agencies on the ground'. A 38-year-old man was kidnapped outside his business in New Brighton, Gqeberha, on Tuesday evening – the latest in a disturbing trend of abductions across the Nelson Mandela Bay metro. According to Hawks spokesperson Ndiphiwe Mhlakuvana the incident took place on Tuesday evening just as the victim was preparing to close his shop. He was ambushed by a group of unidentified suspects who forced him into his Suzuki sedan and drove off. Minutes later, the kidnappers issued a ransom demand, Mhlakuvana said. 'There have been no further updates at this stage. Law enforcement agencies are on the ground and the investigation is ongoing.' Troubling pattern Over the past 12 months at least nine kidnappings – primarily motivated by ransom – have taken place in Nelson Mandela Bay: A 45-year-old teacher was kidnapped in March 2025 outside Happydale Special School in Algoa Park. Armed men dragged her from her Toyota Fortuner shortly after she arrived. She was reunited with her family three days later. It is unclear if a ransom was paid; Josh Sullivan, an American missionary, was abducted in April 2025 during a church service in Motherwell. He was rescued in KwaMagxaki five days later during a police operation in which three suspects were killed; Ebrahim Moosa, a businessman from Kruisrivier near Kariega, was kidnapped in February from his business premises. He was rescued by police a week later. Two people were arrested; Two foreign nationals were kidnapped in mid-February 2025 in an undisclosed part of Nelson Mandela Bay. Police have confirmed the case but provided few details. Investigations are ongoing; A Dutch tourist couple were hijacked and kidnapped in December 2024 near the R335, between Jeffreys Bay and Addo. They were robbed and later released unharmed; A Somali was abducted in Gelvandale in November 2024, held for ransom and released three days later with minor injuries. His kidnappers remain at large; Qays Mohaned Hersi Mohamoud, a Somali student, was kidnapped in Gelvandale in November 2024. He was later released unharmed; Kelvin Naidoo, the deputy president of the Nelson Mandela Bay Business Chamber, was abducted in July 2024 and released six days later. The case sparked widespread public concern and condemnation from business leaders; and A 56-year-old man was lured to his gate in Nemato, Port Alfred, in May 2024, where he was abducted by a woman and a group of accomplices. He was rescued by police in Gqeberha. One suspect was arrested. In 2024, after Naidoo was abducted, the Nelson Mandela Bay Civil Society Coalition wrote to President Cyril Ramaphosa to ask for urgent intervention in the metro to deal with 'alarming and escalating levels of crime'. 'This metro used to be one of the safer metros in the country, but due to the systematic breakdown of law and order enforcement, this has become an exceptionally dangerous place for its citizens and communities. The alarming crime statistics, which include high levels of brutal shootings, robberies, hijackings, kidnappings, cybercrimes and vandalism of public and private infrastructure, cannot proceed unabated. 'These crimes have severe consequences upon the safety and security of people, especially vulnerable communities, and have serious economic ramifications in terms of the retention of much-needed investment and employment in our metro, which is in a province which now has more people unemployed than employed,' the coalition's Mongameli Peter wrote. Mpumalanga cops caught with dagga worth millions to appear in court
Three police officers, caught allegedly transporting dagga worth millions in Mpumalanga, are set to appear in the Nelspruit Magistrate's Court on Thursday, 12 June. The trio, while in full uniform, were on duty and were found driving a marked police vehicle loaded with 107 bags of dagga. The officers, attached to the White River Flying Squad and SAPS, and two others were nabbed on the N4 Road near Matsulu T-junction, on Tuesday, 10 June. Members of Matsulu SAPS received information about the dodgy activity and responded. The accused face charges of corrupt activities and defeating the ends of justice. According to a statement from SAPS additional charges could also be added as the drug related investigation continues. In addition, internal disciplinary actions will also be instituted against the officers. Meanwhile, the two others are facing separate charges of dealing in the drugs. The Acting Provincial Commissioner of the SAPS in Mpumalanga, Major General Dr Zeph Mkhwanazi commented on the dagga bust and said justice must prevail. 'If any member is found to have been on the other side of the law, regardless of whether they are police officers or any law enforcement agencies, the law will have to take his cause without any fear or favour.' Major General Dr Mkhwanazi also emphasised that there is no one that is above the law. This is not the first incident where an officer was caught doing dodgy dealings. The arrest comes a day after a City of Cape Town Law Enforcement officer was arrested by the Hawks. The 43-year-old officer was arrested on charges of murder, kidnapping, and extortion. The provincial spokesperson for the Hawks, Lieutenant Colonel Siyabulela Vukubi, said the kidnapping is alleged to have taken place on May 16 in Kraaifontein. 'The victim was last seen by a friend who reported that the victim went to Bellville to view a vehicle he intended to purchase and never came back. Instead, another friend of the victim received a call from the victim reporting that he had been kidnapped and was being assaulted,' Vukubi said.
