Abu Bakar Jais Appointed As New Court Of Appeal President
KUALA LUMPUR, July 17 (Bernama) -- Federal Court judge Datuk Abu Bakar Jais has been appointed as the new President of the Court of Appeal, replacing Tan Sri Abang Iskandar Abang Hashim who retired on July 3.
Abu Bakar, 63, brings with him over three decades of experience in legal and judicial service.
He began his judicial career as a Judicial Commissioner at the Kuala Lumpur High Court on July 8, 2013. He was then appointed as a High Court Judge on March 21, 2016, and served in both the Kuala Lumpur and Seremban High Courts until 2019.
On Dec 5, 2019, he was elevated to the Court of Appeal, and later to the Federal Court on June 13, 2023.
Born in Muar, Johor, Abu Bakar graduated with a Bachelor of Laws (Hons) from Universiti Malaya (1982–1986) and later obtained a Certificate in Government Legal Advisers Course from the University of London in 1996.
His career spans various roles in the legal and judicial sectors, including stints as a law tutor at the International Islamic University Malaysia (1986-1987), Deputy Public Prosecutor at the Attorney General's Chambers and the Anti-Corruption Agency (1987-1990), Magistrate in Ipoh (1990), and Assistant Director at the Legal Aid Bureau (1991).
Abu Bakar also served as Federal Counsel in the Civil Division of the Attorney General's Chambers (1992-1995) and as Senior Federal Counsel until 2000.
In private practice, he was a litigation partner at Zaid Ibrahim & Co. (2001–2003) and later at Hisham, Sobri & Kadir (2004–2013).
Abu Bakar was part of the Federal Court panel in 2023 that ruled on former Prime Minister Datuk Seri Najib Tun Razak's application for a review of his conviction and 12-year prison sentence over the misappropriation of RM42 million from SRC International Sdn Bhd.

NST Leader: Of CJ and other judges
There was a palpable sigh of relief when on Thursday night the Chief Registrar's Office announced the appointment of Datuk Wan Ahmad Farid Wan Salleh as the new chief justice, Datuk Abu Bakar Jais as the new Court of Appeal president and Datuk Azizah Nawawi as chief judge of Sabah and Sarawak. The sigh of relief is understandable. For months, unease had grown across many segments of society over who would fill the big shoes of Tun Tengku Maimun Tuan Mat. The big shoes were not due to her being the first woman to occupy the seat, but because she was a judge extraordinaire and later, chief justice extraordinaire. On July 2, when she retired, she left behind a legacy of judicial independence that is hard to beat. An extension of the service of a judge of such a calibre would have pleased the country immensely, but it didn't happen. Wishes aren't horses. For avoidance of doubt, the unease — there was even a walk for justice organised by the Malaysian Bar — wasn't about the extension of Tengku Maimun's service, but about perception of all things to do with the judiciary. Perception of justice is a good cause to fight for, but those given to wild allegations, which at places became venomous, made the national unease worse. When it comes to the judiciary, perception ranks high. England's chief justice Lord Hewart gave perception of justice its noble place as long ago as Nov 9, 1923, when he spelt out his dictum in Rex v Sussex Justices: "It is not merely of some importance but of fundamental importance that justice should not only be done, but should manifestly be and undoubtedly be seen to be done." As Malaysians "manifestly" and "undoubtedly" saw justice being done during Tengku Maimun's stewardship of the judiciary, they will now expect the same under the leadership of Wan Ahmad Farid as chief justice. It is clear that he has big shoes to fill. However, he has shown that he has just the "feet" for them as early as 2022, when he recused himself from hearing a matter concerning the admission of Queen's Counsel Jonathan Laidlaw to represent former prime minister Datuk Seri Najib Razak. He did that to avoid any perception that might undermine confidence in the judiciary's independence. Before being appointed a judge, he had been actively involved in politics, even serving as a senator. Malaysian Bar president Mohamad Ezri Abdul Wahab praised the new chief justice for recusing himself: "In doing so, he made several significant statements on the importance of public confidence in the judiciary, stating that the perception of judicial independence must not be placed in doubt and that it is not a matter of trial and error." An independent judiciary is a precious gift to any society, and once it is lost, anarchy reigns, wrote Wan Ahmad Farid as a High Court judge when recusing himself on June 16, 2022. We hope the judiciary under the new chief justice's stewardship will do everything necessary to prevent the precious gift from being lost.

New judges to be sworn in on July 28
Eight judges have been newly appointed to the Court of Appeal. PETALING JAYA : Eight newly appointed Court of Appeal judges and 14 High Court judges are scheduled to be sworn in on July 28. Prime Minister Anwar Ibrahim said the appointment process had gone through the necessary stages, including assessment by the Judicial Appointments Commission, discussions with the Malay rulers, and obtaining the consent of the Yang di-Pertuan Agong, Bernama reported. 'Many have asked me why it was not announced earlier. I cannot answer arbitrarily because the process of appointing judges involves the consent of the Yang di-Pertuan Agong. 'It needs to go through discussions with the rulers and after it is agreed, it will then be brought back to the Agong for consent,' he said when launching the Bumiputera Master Plan, Tunas Madani, and a housing project in Permatang Pauh, Penang, today. He said no judges were removed or dismissed as some parties have portrayed. Rather, the process of selecting new judges must be done carefully and with full respect for the constitutional monarchy system. At the event, organised by the Penang Bumiputera Development Council, Anwar launched the Penang Bumiputera Development Master Plan (PIPBPP) 2026-2035, the Tunas Madani Programme, and the JKP Sdn Bhd housing project to assist the Bumiputera community in Penang. The launch of the PIPBPP 2026-2035 will be the main strategic guide in driving the development of the Bumiputera community in Penang. It was developed in collaboration with Universiti Utara Malaysia, Universiti Sains Malaysia and Universiti Teknologi Mara as consultants and researchers with MPBPP. The Tunas Madani Programme was designed with the specific objective of building the capacity of Bumiputera graduates to be involved in entrepreneurship. The housing project by JKPSB involves the construction of 3,231 residential units in Permatang Pauh at a total development cost of RM1 billion.
