
Labour rebel forces Commons vote amid fears of housebuilding reforms ‘wreckage'
MPs voted to reject the amendment, with 180 in favour, 307 against, majority 127.
Mr Hinchliff told the Commons that the fund was a 'kernel of a good idea', but added: 'The weight of evidence against how it has been drafted is overwhelming.'
The money will help Natural England set up new environmental delivery plans (EDPs), which Mr Hinchliff said should come with a timeline for their implementation.
He said the proposal will give 'ministers the opportunity to rescue something positive from the wreckage of this legislation, ensuring environmental delivery plans serve their purpose without allowing developers to pay cash to destroy nature'.
He added: 'It would ensure conservation takes place before damage, so endangered species aren't pushed close to extinction before replacement habitats are established, and it outlines that conservation must result in improvements to the specific feature harmed, protecting irreplaceable habitats like chalk streams.'
Mr Hinchliff had also called for a residents' right of appeal against green-lit large developments, if they are not on sites which a council has set aside for building, and new town hall powers to block developers' plans, if they have failed to finish their previous projects.
Mr Pennycook had earlier said the 'status quo' for the environment and development was not working, and instead proposed reforms which he described as a 'win-win' for both.
He said: 'The Nature Restoration Fund will do exactly as its name suggests. It will restore, not harm nature. It is a smart planning reform designed to unlock and accelerate housing and infrastructure delivery while improving the state of nature across the country.'
He later told MPs: 'I feel obliged to tackle a number of the most flagrant misconceptions head on.
'First, some have claimed that driven by a belief that development must come at the expense of the environment, the Government is creating a licence for developers to pay to pollute. A cash-to-trash model, as some have dubbed it. In reality, the nature and restoration fund will do the precise opposite.
'I have been consistently clear that building new homes and critical infrastructure should not, and need not, come at the expense of the environment. It is plainly nonsense to suggest the Nature Restoration Fund would allow developers to simply pay Government and then wantonly harm nature.'
Mr Pennycook said the money would be given to Natural England, which is set to get powers to acquire land compulsorily to put its EDPs into practice.
Labour MP Neil Duncan-Jordan criticised the Government's rhetoric, and argued it was 'too simplistic to argue that this is a debate of builders versus blockers'.
He said 'there's no amount of killing badgers or red tape bonfires which is going to fix' what he described as a 'developer-led model' of planning, when housebuilders 'drip feed developments into the system, prioritising properties which maximise profit and are far from affordable for local people'.
The Conservatives accused the Government of 'greenwashing'.
Conservative shadow housing minister Paul Holmes said: 'While developers may cheer the ability to pay into a Nature Restoration Fund instead of taking direct responsibility for mitigations, we should ask, is this really restoration, or is it greenwashing?'

Mr Pennycook said the new laws were needed to 'speed up and streamline' Labour's housing target of 1.5 million homes, clean energy goals and aim to approve at least 150 'major economic infrastructure projects'.
Several MPs had called for swift bricks – hollow bricks where small birds can make their nests – in new builds, in amendments drafted by Labour's Jenny Riddell-Carpenter (Suffolk Coastal) and Barry Gardiner (Brent West), and Liberal Democrat housing spokesman Gideon Amos.
At the despatch box, Mr Pennycook said that 'changing national planning policy is the more effective route to securing swift bricks as a standard feature of the vast majority of new builds', through a regularly updated set of planning rules.
'We are specifically giving consideration to using a new suite of national policies for decision making to require swift bricks to be incorporated into new buildings unless there are compelling reasons which preclude their use, or which would make them ineffective,' the minister said.
'This would significantly strengthen the planning policy expectations already in place, meaning for example that we would expect to see at least one swift brick in all new brick-built houses.'

Experts are creating an AI-driven crime map of England and Wales that aims to stop criminals before they strike. The Government today announced a £4million investment in the futuristic project, which will use official data to identify local areas that are likely to see criminal activity, such as knife offences and anti-social behaviour. Police will then target these locations with extra resources, including patrols and visits to the homes of convicted criminals, in the hope of intervening before any offences take place. Peter Kyle, Science and Technology Secretary, said the project would draw on data from police, councils and social services, including criminal records, previous offence reports and the behavioural patterns of known offenders. The Concentrations of Crime Data Challenge will see experts from universities and businesses tasked with creating the model with the aim of making it operational across England and Wales by 2030. 'We want to identify areas that have a higher probability of experiencing crime,' Mr Kyle told the Daily Mail during a visit to the Met's central communications command centre. 'That means police can ensure officers are in the area and are able to prevent these crimes happening in the first place or respond before they escalate. 'The Met and other forces have an enormous amount of data on historic and emerging crime. By using that - and incorporating data from other authorities such as local councils - the model can become more accurate as time passes.' AI can identify patterns and links in evidence and sift through data more quickly than humans. Civil liberties campaigners have previously raised ethical concerns about the use of algorithms to try to predict crimes in advance. But Mr Kyle said the government's crime map would only use official data and not information from private sources, such as social media. He insisted any interventions police make based on the map's findings would be subject to 'human oversight' and insisted the system was merely an extension of traditional policing methods. 'Police forces throughout history have always looked at individuals who are committing crime and patterns of behaviour that indicate they will commit crime again - this is not new,' he said. 'But in an era where we are able to use digital technology and data to assist in that process we can't ignore the power of that technology to keep us all safe. 'This will be one tool alongside many others that crime fighters use. Human oversight and respect for the experience of senior officers will always remain at the forefront. 'We will not be using digital technology to blindly identify individuals on a vague probability. That is not what we are talking about.' The initial £4m investment aims to deliver a series of initial prototypes by April 2026. My Kyle spoke to the Daily Mail on a visit to the Met's Central Command Communications Centre in Lambeth, where he also viewed other tech innovations including 'first responder' drones. The gadgets, which will be deployed in London in October, can be sent to the scene of emergency incidents in minutes to give officers an overview of the situation and gather evidence. The Mail also saw a demonstration of a smaller device that can be used to search buildings for hazards, such as improvised explosive devices (IEDs), before they are raided by armed police. Mr Kyle also viewed a van fitted with facial recognition cameras, which are already used in London and are now being rolled out across seven police forces – Greater Manchester, West Yorkshire, Bedfordshire, Surrey, Sussex, Thames Valley and Hampshire. According to officials, the technology has already been used to make 580 arrests in London over the last year, including 52 registered sex offenders. Campaign group Big Brother Watch claimed the move 'represents a significant expansion of the surveillance state.' But the government maintains the technology will only be used to catch 'high–harm' offenders with rules to ensure 'safeguards and oversight'. 'What we are doing is ensuring that those people who are known perpetrators of crime are found, identified and brought to justice so they can't commit more crimes,' said Mr Kyle. 'People should be reassured that we keep people's digital information safe and secure and always act appropriately. Anyone who is not identified by these cameras has their data immediately and permanently deleted. 'There are criminals out there using data and digital technology to commit crimes. It would be absurd to suggest we don't use this technology to keep people safe.' This week, the Home Office said every community across England and Wales had now been assigned a 'named, contactable' officer to handle reports of crimes such as anti-social behaviour. Their details will be made available for residents on their local force's website, it is understood. The pledge was made as part of the Government's previously announced Neighbourhood Policing Guarantee, under which forces have committed to respond to neighbourhood queries within 72 hours.

Large drop in number of pupils studying Welsh at A-level since 2005, data shows
More than 500 fewer students studied Welsh to a high level this year than in 2005, the latest data shows. The drop has come despite the Welsh Government having set a target of one million Welsh speakers by 2050. Around 538,000 people can speak the language in Wales. Data examined by the PA news agency shows some 372 students took Welsh as a first or second language at A-level this year, down from 927 in 2005. The lowest year on record was 2023, when just 353 pupils took the subject. This year has been the lowest year for people taking Welsh as a first language, with 185 entries, compared with 260 in 2020. Some 187 pupils took the subject as a second language, with 209 having taken it in 2020. Efa Gruffudd Jones, the Welsh Language Commissioner – an officer appointed by the Welsh Government to oversee an independent body aiming to promote the use of the Welsh language – described the drop as a 'matter of concern'. Speaking to PA, Ms Gruffudd Jones said she supported calls from the Coleg Cymraeg Cenedlaethol (Welsh National College) for Welsh to become a protected subject. She said: '(This would) make sure that every educational institution post-16 offers the course. 'What I hear from people who get in touch with my office, if only you know three or four people want to study it, then schools don't offer the subject at all. 'I believe they need 12 before they decide to run the course. I don't think that's right. 'I think it should be offered at every educational institution post-16.' Ms Gruffudd Jones also said the qualification itself is under review, and the content needs to be made more attractive and relevant to students. She added: 'The other thing is that you can study many more courses through the medium of Welsh now than you used to be able to. 'You can study psychology, criminology, etc, through the medium of Welsh. 'Maybe people in the past who would have wanted to study through the medium of Welsh chose Welsh, but now they have a wider range of choice.' The commissioner stressed that Welsh is not the only language to have seen a decline, with many European languages having seen a drop across the UK. Total entries for French, German, and Spanish were down by 20% from 443 to 352 in Wales this year, with Ruth Cocks, director of British Council Wales, describing the drop in interest in international languages as a 'concerning story'. Ms Gruffudd Jones said the reason for the move away from studying languages was unclear, but may be due to pupils being encouraged to study more Stem subjects. 'I understand that we need people with technical ability, but I would argue that you also need linguistic ability in order to communicate with people in workplaces, to articulate yourself well in future,' she said. 'I would argue that literature gives you some insight into the world. 'I don't think really that it should be either or. 'What's important is that it doesn't go any lower, and we continue to make efforts to attract people to learn Welsh to a high standard.' The Welsh Government's aim to have one million Welsh speakers by 2050 was first set out in 2017. Earlier this year, a new five-year plan was unveiled by the commissioner to help achieve the goal. And the Welsh Language and Education (Wales) Bill, which aims to close the gap in Welsh speaking ability among pupils from different schools, passed in the Senedd. Figures from the 2021 census showed a decline in the number of people who can speak Welsh compared with a decade earlier. Around 538,000 people in Wales – roughly 17% of the population – said they could speak Welsh, compared with 562,000 in 2011, around 19% of the population. Recent years have seen Welsh place names take prominence over English as the default, with Eryri replacing Snowdonia on official communications from the national park authority. In response to the decline in A-level entries, a Welsh Government spokesperson said: 'We would like more learners to take Welsh as a subject. 'A consultation is taking place to look at creating new Welsh AS and A-levels, making them engaging and attractive to learners. 'We see the Welsh Language and Education (Wales) Act 2025 as a means to provide more children and young people with access to the language within the education sector than ever before. 'We want all young people to leave school with better Welsh skills, regardless of whether they do A-level Welsh or not.'
