After autopsy, UPSI releases names of all 15 students killed in Gerik collision
IPOH, June 10 — The identities of all 15 Universiti Pendidikan Sultan Idris (UPSI) students who were killed in a horrific crash at KM53 of the East-West Highway (JRTB) near Tasik Banding in Gerik early this morning have been confirmed.
In a statement, UPSI's Corporate Communications Division said the deceased included Sufea Adela Maslihaizan, 21, from Kampung Air Terjun, Jertih; Mohammad Aqil Taqiudin, 21, (Kampung Gong Bayor, Besut); Anis Soffiyya Md Zaidi, 20, (Kampung Rahmat, Chalok, Setiu); and Nur Ainul Qistina Mat Ali, 21, (Lorong Tapah, Kampung Anak Ikan, Jertih).
The others who died included Fakhrul Arif Rosdi, 20, from Kampung Kerandang, Jertih; Nurul Fatihah Abu Setaman, 22, (Kampung Gong Duek, Besut); Nur Dalila Farhana Mohamad Isma, 21, (Kampung Bharu Tok Dor, Jertih); Nurul Izyanti Muhamad Azahar, 21, (Kampung Padang Luas, Jertih); and Nur Amni Nadiah Nik Nor Zabir, 21, (Kampung Paya Rawa, Besut).
The statement also identified Muhammad Mustaqim Rosde, 21, (Kampung Telaga Nibong, Jertih); Nor Ayuni Maslan, 21, (Felda Tenang, Jertih); Nurly Sahirah Azman, 23, (Kampung Gong Pasir Kerandang, Besut); and Fatin Nasrien Fadli, 22, (Kampung Kerandang, Besut) as among those who perished.
The post-mortems for these victims were conducted at the Forensics Department of Hospital Raja Permaisuri Bainun (HRPB) here.
Two other victims, whose post-mortems were carried out at Hospital Gerik, were Muhammad Adib Hazim Halim, 21, from Kampung Pasir Badak, Jertih; and Wan Nur Suhaila Wan Muhammad, 22, from Jalan Gong Maksom, Kampung Amer, Besut.
Perak police chief Datuk Noor Hisam Nordin said that post-mortems for all the victims were completed yesterday afternoon.
Meanwhile, a convoy of vans transporting the students' remains began leaving the HRPB Forensics Department for Jertih, Terengganu, at around 8.55 pm.
It is understood that upon arrival in Jertih, the 13 bodies will be taken to Masjid Hadhari for prayers before being laid to rest in their respective village cemeteries.
The remains are being transported to Terengganu via the JRTB with escorts from the Perak and Kelantan police contingents.
The students were travelling in a chartered bus from Jertih to their campus in Tanjung Malim, Perak, when it collided with a multi-purpose vehicle between 12.30 am and 1 am. — Bernama

JERTIH: The Terengganu Islamic Religious and Malay Customs Council (MAIDAM) has channelled RM49,500 in aid to the families and students from Universiti Pendidikan Sultan Idris (UPSI) who were affected by the tragic road accident on the East-West Highway (JRTB) near Tasik Banding in Gerik, Perak, on Monday. MAIDAM chief executive officer Assoc Prof Datuk Dr Ahmad Azrin Adnan said the families of the 15 students who perished will each receive RM1,500, while the 27 injured students will each receive RM1,000. 'This assistance is hoped to ease their burden, as the majority of the students involved come from families who are recipients of MAIDAM's aid for the poor and needy. 'In addition, our visit today is also to gather information on any further assistance the families may require,' he told reporters after presenting the contribution to Maslan Abdul Rahman, 58, the father of Nor Ayuni, 21, who died in the accident, at their home in Felda Tenang, here. Ahmad Azrin said 13 of the students who perished were from families receiving aid under MAIDAM's hardcore poor and poor (asnaf fakir and miskin) categories. 'Of the 27 injured students, 13 are also from zakat-recipient families under the same categories. Meanwhile, 16 of the students involved in the crash were recipients of MAIDAM's Higher Education Early Assistance,' he said. On Monday, 15 UPSI students were killed when a chartered bus carrying them from Jertih to the main UPSI campus in Tanjung Malim, Perak, overturned in an accident involving a Perodua Alza on the JRTB. The accident also left 33 others injured, including the bus driver and co-driver, as well as the driver and three passengers of the Perodua Alza.

Permit for bus operator in Gerik crash revoked, says Loke

(Bernama pic) KUALA LUMPUR : The transport ministry has revoked the permit for the bus operator involved in the crash in Gerik, Perak, that killed 15 students from Universiti Pendidikan Sultan Idris (UPSI). Transport minister Loke Siew Fook said a preliminary investigation found that the operator had breached several key conditions, including illegally leasing its permit to a third party, and failing to activate the vehicle's GPS tracking system. 'I have instructed the Land Public Transport Agency (Apad) to revoke the operator's permit immediately once the show-cause period ends,' he told a press conference after a Cabinet meeting today. 'All operating licences issued to the company, including for other buses under its fleet, will also be cancelled. 'Although the company has the right to appeal, the ministry will not consider any appeals in this case.' According to Loke, the bus operator had leased its permit to a third party in Kelantan for RM500 a month. 'When asked to produce GPS data, they couldn't provide it because the tracking system had not been activated. This is a clear violation of the permit conditions,' he said. The bus operator, Kenari Utara, previously claimed the vehicle had undergone maintenance last month. The bus driver, who was on loan from another company, was said to be experienced and familiar with the Gerik-Jeli route. On a claim that the driver told authorities the brakes had failed before the crash, Loke said a detailed investigation would be carried out. 'That's just his statement. We will conduct a full forensic analysis to determine whether the claim is accurate. 'However, based on dashcam footage from other road users, it's clear that the bus was speeding and overtaking before it lost control and crashed,' he said. Loke also announced that the ministry will develop a centralised database of bus drivers through Apad to address driver negligence more comprehensively. 'Any driver with a prior record can be blacklisted through this system,' he said, adding that it would serve as a key reference for companies looking to hire drivers.

Housing developer loses libel suit against CTOS
The Kuala Lumpur High Court dismissed a suit brought by Bagan Kurnia Development against CTOS Data Systems Sdn Bhd for defamation, negligence and breach of statutory duty with costs of RM50,000. KUALA LUMPUR : The High Court has dismissed a suit brought by a housing developer against credit ratings agency CTOS Data Systems Sdn Bhd for defamation, negligence and breach of statutory duty. Justice Roz Mawar Rozain said the plaintiff, Bagan Kurnia Development (BKD), had failed to discharge the burden of proving each element of its pleaded claim on a balance of probabilities. Roz Mawar said BKD had failed to establish that the trade reference inserted by a third party against the company was defamatory. She described the insertion as a neutral factual assertion which had originated from Lye Yoon Hon Construction Sdn Bhd (LYHC) and was reflected in an ongoing contractual dispute. She also said there was no cogent evidence before the court that CTOS had published the statement. 'There is no proof that CTOS provided or disseminated it to Public Bank Berhad or any other external party,' she said. The judge also ruled that the claim for breach of statutory duty under the Credit Reporting Agencies Act 2010 (CRA) was unsupported by evidence or law. 'The CRA does not impose an obligation on CTOS to independently verify the accuracy of trade references received from its subscribers unless a formal dispute mechanism is invoked, which was not done in this case,' she said in her 14-page judgment. Roz Mawar also ruled that the plaintiff's claim of negligence was untenable in law. She said its claim for RM2 million due to the rejection of a facility, and an additional RM7.3 million in profits, was speculative and had not been proven. She said the fact that CTOS was a credit reporting agency carrying out a statutorily regulated role further underscored the need for courts to scrutinise carefully any attempt to impose liability on such entities. 'A finding of liability in the absence of clear evidence and legal foundation risks undermining the utility of regulated credit reporting and chilling the legitimate functions of licensed agencies,' she said, awarding costs of RM50,000 to CTOS. In its suit, BKD had contended that a trade reference entered by LYHC into CTOS's database in connection with an alleged RM1.1 million debt owed to LYHC by BKD was false and defamatory. The plaintiff further asserted that CTOS, the database operator, had failed to verify the accuracy of the information and had wrongfully allowed it to be published, thereby causing reputational and financial harm. CTOS maintained that as a licensed credit reporting agency, it had operated within the legal parameters of the CRA. It said the subscriber's uploading of the impugned trade reference complied with its standard procedures. Lawyer M Kamalam appeared for the company, while Ashok Kandiah and Mishand Patmanathan represented CTOS.
