
Telcos get temporary relief in ₹141-crore spam penalty case

The telecom tribunal, at a hearing Thursday, adjourned the matter till August 8, and asked the
Telecom Regulatory Authority of India
(
Trai
) to submit an affidavit on the matter.
During the hearing, both sides presented their arguments. As Trai has to share further information, the tribunal asked the counsel for the regulator to file an affidavit containing the requisite details.
The regulator had levied penalties on all three private telcos -
Reliance Jio
,
Bharti Airtel
and
Vodafone Idea
as well as state-run Bharat Sanchar Nigam Ltd. (BSNL) - for failing to control spam. However, the operators had challenged the penalties, arguing that the regulator should not have levied the penalties when an anti-spam platform was still in the process of development. TDSAT had stayed the Trai's penalties in January.
The fines were levied as part of the
Telecom Commercial Communications Customer Preference Regulations
, 2018 (TCCCPR). The telcos argue that the delays in implementation of spam control measures were caused due to Covid and they were not responsible for the delay.
To support their point, the telcos submitted details to the TDSAT stating that when Trai imposed the penalties, the digital consent acquisition (DCA) platform was still being deployed.
While staying the penalties in its January 28 order, the TDSAT had observed that telecom firms were not responsible for the delay in implementation of the regulations, including the DCA.
'Thus, it is unfair and arbitrary on the part of the respondent to impose financial disincentives on the appellants (telcos) for something which was beyond their control,' TDSAT said in the January order.
The levying of penalties on telecom firms as part of the TCCCPR has been a bone of contention between the regulators and telcos. While the regulator has been imposing penalties on telcos, it has not realised any money as operators contended that they should not be held accountable for something which they don't control or perpetuate.
Failing to get the amount itself, the regulator had even asked the Department of Telecommunications (DoT) to encash the bank guarantees of the companies to recover the amount. But the DoT has not agreed to the request of Trai.
The regulator has been strengthening the TCCCPR rules, but the telcos argue that since key stakeholders like telemarketers, over the top (OTT) have been kept out of the purview of the rules, there won't be desired results to curb spam.

Sulajja Firodia Motwani, Founder and CEO of Kinetic Green , has called for government intervention in the rare-earth materials issue, stating that while the Indian electric vehicle (EV) sector has managed to cope in the short term, it will face significant challenges ahead, as "it's not easy to change your product design and supply chain." Kinetic Green founder emphasised that it could take at least two to three years for the players in the automobile sector to localise the supply chain or adopt alternative technologies. "It will impact the industry if it's not solved because it's not easy to change your product design and supply chain. The EV sector is scrambling somehow to manage for the short run. But I think there has to be a government-to-government solution very soon in the medium term. Because it will take two to three years to try to localise the supply chain or change the technology altogether. So I think it's important that this is resolved," Sulajja Firodia Motwsaid during the unveiling event of the company's electric Luxury Golf & Lifestyle Cart in partnership with Tonino Lamborghini SpA of Italy. She further added, "We faced a similar situation in COVID on semiconductors; if you remember, the government did follow through and resolve it. I'm hopeful that something will emerge from this." She added that until the issue is solved, the company is working on developing alternative technologies to mitigate the adverse impact of such restrictions arising from global geopolitical moves. "But in the meantime, we are finding alternatives so that the business can continue, but it's not ideal to do that, and also maybe not everybody can. So it (restrictions on rare-earth material by China) will impact the sector," she added. The central government has earmarked ₹1,345 crore to incentivise rare earth magnets production in India. For context, early this April, China announced a decision to implement export controls on certain rare earth-related items, pushing a supply shortage across the world, including India. Meanwhile, India is in touch with the Chinese side, seeking predictability in the supply of rare earth metals -- which had been put under the export controls regime by the Xi administration. China's overwhelming control of global rare earth processing - commanding over 90 per cent of the world's magnet production capacity - has created significant vulnerabilities for industries worldwide. These materials are critical across multiple sectors, including automobiles, home appliances, and clean energy China, there are only a few alternative suppliers of critical minerals. The Union Cabinet in January 2025 approved the launch of the National Critical Mineral Mission (NCMM) with an expenditure of Rs 16,300 crore and an expected investment of Rs 18,000 crore by Public Sector Undertakings. Recently, Union Minister for Coal and Mines G Kishan Reddy said the central government is actively encouraging private companies to mine and explore critical minerals overseas and bring them back into the country to serve the needs of the domestic industry. Speaking on the incentives to the industry, Motwani said, "The government has to continue supporting the adoption of EVs. Once we come to, today we are at about 7-8 per cent EV. Once we come to 25-30 per cent EV, then we'll have critical mass on supply chain, on scale, and on ecosystem. "We have begun well, but we are far from done. The government must continue supporting the adoption of electric vehicles," she added. She further noted the resistance from traditional internal combustion engine (ICE) players who have vested interests in maintaining the status quo. "There is a large counterforce from existing ICE manufacturers who naturally want to protect their investments and may not wish to see EVs succeed. However, it's encouraging that the government remains focused. Schemes like EMPS and the PM-eBus Sewa, lower GST rates, ecosystem support, and a strong Make-in-India push should continue to drive demand and adoption," Kinetic Green founder asserted.

Trump wants to cut deficits. Powell-bashing, stablecoins, and T-bills could help.
President Trump has been waging a campaign to oust Federal Reserve Chair Jerome Powell. What do President Donald Trump's campaign to oust Federal Reserve Chair Jerome Powell, legislation to regulate digital stablecoins, and the Treasury's debt-management practices have to do with one another? All relate to holding down the rise of the interest cost on federal government debt, a major factor boosting the budget deficit from the recently passed Big Beautiful Bill. Trump recently posted on Truth Social that if the Federal Reserve would slash its key federal-funds policy rate, now set in a range of 4.25% to 4.5%, by multiple percentage points, it could save the government billions in interest costs. The yield on Treasury debt has turned higher as notes from the near-zero-interest-rate eras following the 2008-09 financial crisis and the Covid pandemic mature. They will be replaced with notes yielding nearly 4% or higher. It's true, T-bills could be sold at lower rates if Powell & Co. would acquiesce to Trump's wishes. Meanwhile, BNP Paribas rate strategists Guneet Dhingra, Sebastian Mauleon, and Timothy High wrote recently that the Treasury should take a 'T-bill and chill" tack. That would produce a 'significant cost saving" for the Treasury. It wouldn't reduce the deficit, but it would reduce the government's interest expense, which is already running at over a $1 trillion annual rate and exceeding the U.S. military budget, as I've noted previously. The Treasury has kept T-bills to about 15% to 20% of its total issuance, but the BNP strategists argue that the department should think about upping that to 20% to 25%. Demand from money-market funds and overseas investors (buyers of some $336 billion of bills in the latest 12 months) should absorb the increased supply. Fewer notes and bonds, they note, should tend to reduce intermediate- and long-term yields. Former Treasury Secretary Janet Yellen was criticized for tilting the government's securities sales toward shorter maturities starting in late 2022. One of those critics was Scott Bessent, her successor, who hasn't changed the Treasury's financing mix since taking over this year. However, Powell has said that the Treasury's financing costs don't enter into the Fed's interest-rate decisions. This past week, Kevin Warsh, widely viewed as a candidate to replace Powell, posited that the Treasury and Fed should coordinate their debt-management policies. 'We need a new Treasury-Fed accord, like we did in 1951 after another period where we built up our nation's debt and we were stuck with a central bank that was working at cross-purposes with the Treasury," he told CNBC. Tilting Treasury borrowing to the short end is 'stealth QE," according to Dario Perkins, managing director for Global Macro. Quantitative easing describes central bank buying of securities to inject liquidity into the financial system. The idea behind QE is to reduce the supply of long-term government paper available to investors and force them to buy corporate and mortgage debt to stimulate the economy, as former Fed Chair Ben Bernanke explained back in 2010. QE has mainly served to boost financial markets, Warsh said, as the S&P 500 index and Nasdaq Composite hit records again last week, corporate credit spreads historically narrowed, and initial public offerings picked up. On Main Street, however, credit is tight, owing to the level of short-term rates. (Small businesses borrowing from banks typically pay some spread over the posted prime rate, currently 7.5%.) Now comes the crypto connection to all of this. The passage this week of the so-called Genius bill sets standards for stablecoins, which are digital currencies pegged to the dollar or another actual currency. Stablecoins would have to be fully collateralized by safe assets, notably U.S. government debt. That would boost demand for Treasury bills, Torsten Sløk, Apollo Global Management's chief economist, wrote recently. He cites a recent Bank for International Settlements paper that estimates that an aggregate $3.5 billion flowing in stablecoins lowers the three-month T-bill rate by 2.5 basis points in 10 days and five basis points in 20 days. The Treasury is due to announce its quarterly financing plans that morning, while the Federal Open Market Committee will announce its rate decision that afternoon, followed by Powell's news conference. The fed-funds futures market on Friday puts a 95% probability of no interest rate change then, according to the CME FedWatch tool, but Fed Gov. Christopher Waller late on Thursday argued for a quarter-point cut then. That may make him the new front-runner in the race to replace Powell, says Washington watcher Greg Valliere, chief U.S. policy strategist for AGF Investments, although he trails Warsh, Bessent, and Kevin Hassett, head of the National Economic Council, in the Polymarket betting. Speaking for the likely majority, Fed Gov. Adriana Kugler this past week said no rate reduction is appropriate now, given that the economy is near full employment, inflation remains above the Fed's 2% goal, and tariffs are exerting upward price pressures.
