President renames FC as Federal Constabulary with nationwide powers

ISLAMABAD: President Asif Ali Zardari has issued the Frontier Constabulary Reorganization Ordinance 2025, officially renaming the force as the Federal Constabulary.
According to the ordinance, the jurisdiction of the Federal Constabulary will now extend across the entire country, including all four provinces, Islamabad, Azad Jammu and Kashmir, and Gilgit-Baltistan.
The ordinance follows amendments to the Frontier Constabulary Act of 1915.
The Inspector General of the Federal Constabulary will be appointed by the federal government. Rules for the functioning of the force will be framed, and each division will have a wing commander equivalent to the rank of Deputy Inspector General.
The federal government will also have the authority to recruit a Federal Reserve Force to maintain law and order. The Federal Constabulary will be responsible for riot control, internal security, counter-terrorism, and providing protection.
Under the ordinance, the Federal Constabulary will have a dedicated Security Division and a Federal Reserve Division. Recruitment offices will be established across the country, and the force will be commanded by officers from the Police Service of Pakistan under a reorganization framework.
The ordinance applies to every member of the Federal Constabulary and is effective immediately. The federal government will oversee and control the force and can deploy it as a reserve to support Islamabad Police, provincial police, and other law enforcement agencies.
Additionally, the Federal Constabulary will have powers under the Criminal Procedure Code of 1898, the Anti-Terrorism Act of 1997, and the Police Order of 2002. The government may also grant any member of the force police-like powers and responsibilities under applicable laws.

'In such circumstances, spending public tax money on the government's courtiers is seen as barbaric,' it added. The party also castigated the Punjab government for establishing the Anti-Riot Force and appointing 5,000 personnel for the new force, saying it serves as a clear indication of Maryam Nawaz's authoritarian governance style. 'The brutality displayed by the Punjab Police over the past three years, aimed at carrying out political vendettas and suppressing the PTI, is unprecedented. The creation of the Anti-Riot Force is designed to further oppress the general public, particularly targeting the PTI and enforcing Maryam Nawaz's authoritarian policies in Punjab,' it added. It pointed out that rather than improving institutional performance and prioritising the welfare of the people, public resources are being misused to extend their illegitimate rule and safeguard personal interests, adding that this behaviour is both condemnable and detrimental to national interests. 'No concept of judges' permanent transfer'

The Karachi Bar Association and PTI leader Shoaib Shaheen Advocate have challenged the Supreme Court's order in a case related to transfer of judges to the Islamabad High Court (IHC) and a subsequent change in the IHC judges' seniority list. The petitioners have contended that the June 20 verdict of a constitutional bench of the SC has misinterpreted the Constitution and wrongly inferred the concept of a permanent transfer from the Article 200 of the Constitution. Article 200 of the Constitution deals with the transfer of high court judges. It outlines the process for transferring a judge from one high court to another. According to the article, the president can transfer a judge, but only with their consent and after consultation with the chief justice of Pakistan and the chief justices of both high courts involved. The petitioners have contended there is no provision of a permanent transfer of a superior court judge in the Constitution and only the Judicial Commission of Pakistan (JCP) is entitled to fill vacant positions in high courts and the apex court. The petitions also argue that the president also does not have the authority to determine seniority of judges and urged the SC to revisit its order and declare it null and void. In a majority verdict, an SC constitutional bench on June 20 upheld the transfer of three provincial high court judges to the IHC, noting that these transfers could not be declared new appointments. However, the majority judges partially remanded the matter to the President of Pakistan to determine the seniority of the transferred judges after examining and vetting their service record "as soon as possible, including the question of whether the transfer is on a permanent or temporary basis". Later on June 29, President Asif Ali Zardari named Justice Sardar Muhammad Sarfraz Dogar as the senior-most judge of the IHC, following a determination of judicial seniority.
