Noida: Short-term rentals in high-rise residential societies have come under scrutiny following a spate of complaints about loud parties, drug use, and unauthorised commercial activity. Officials say properties listed on online booking platforms are being used as unregistered guesthouses and party venues, often in violation of housing and excise norms. "If someone is letting out a flat for a day or two, it must comply with the Sarai Act. If liquor is being served, the flat owner must also have a home bar licence under UP excise rules." The Sarai Act, 1867, aims to standardise and regulate the operations of sarais or guesthouses, ensuring they are maintained properly and provide basic amenities to travellers. The Act outlines penalties for violations of its provisions, including fines and potential disqualification for owners. While platforms like Airbnb allow flexible stays, officials say the absence of regulation has allowed some units to become hotspots for disruptive gatherings and, in some cases, illegal drug use. Excise officer Subodh Kumar, who was present at the meeting, said many flat owners and brokers are letting out properties on a daily or weekly basis without any oversight. "These flats are technically residential but are functioning like mini hotels or party spots. This is not just a violation of housing regulations but also a potential threat to law and order," Kumar said. A multi-agency team will now survey residential societies where such listings are common and submit a detailed report to the district administration. Officials told TOI that short-term rentals were mostly operating out of studio apartments in under-construction residential societies without residents welfare association and apartment owners associations, making it difficult for them to track such activities. Typically, these are furnished flats with WI-FI and parking facilities, and charge anywhere between Rs 3,000 and Rs 5,000 a night. Currently, there is no formal regulatory framework for such rentals. Lack of hotels and guesthouses, especially near business and industrial hubs, makes these short-term rentals attractive to people visiting the city for work. The average rent of studio apartments in Noida ranges from Rs 35,000 to Rs 45,000 per month and from Rs 15,000 to Rs 20,000 in Greater Noida. Rajiva Singh, president of the Noida Federation of Apartment Owners' Associations (NOFAA), said no residential society in Noida with a functioning RWA or AOA currently allows short-term rentals. "There was one society in Sector 137 where studio apartments were being rented out on Airbnb a couple of years ago, but that was stopped once the AOA was elected," he said. Singh raised concerns over security. "If new people are coming and going every night, who takes responsibility for the area's safety? Unlike tenants, daily visitors aren't subject to police verification," he added. The DM also called drug abuse in youths a matter of concern. "Drug addiction is not just misleading youth, it's weakening the social fabric. Every department must work together to stop it," he said during the meeting. He also stressed the importance of awareness campaigns involving schools, colleges, hostels, PGs, and RWAs. Surprise inspections will be carried out, and institutions will need to submit affidavits declaring their campuses drug-free. The administration is also planning to publicly recognise educational institutes that actively keep their spaces clean of drug activity.

On Jan 23, a chunk of plaster fell on the car of Pradeep Saxena, a resident of Block L, shattering its roof, window and shield. On July 15, the wall plaster came off the building in Block 16. Over the last few months, there have been several similar incidents where residents narrowly escaped injury due to plaster falls, causing widespread fear within the community. Despite numerous complaints, both written and oral, addressed to the Authority, residents claim no action has been taken. The society RWA said anyone could have been injured and demands accountability, along with immediate and permanent repairs from the civic body. Narottam Sharma, RWA president of Sector 99 LIG Flats, said, "Noida Authority is taking this issue very casually. Approximately 70 flats' leases have already been cancelled, and they are now under the charge of the authority. These flats are locked and in a dilapidated condition. So, they are responsible for any injury or accident caused by these plaster falls from their flats." He demanded immediate inspections of all blocks within 48 hours and the prompt removal of any dangling plaster. The sentiment was echoed by Mohinder Singh, RWA general secretary of Sector 40, who criticised the authority for its lack of oversight. "They appear to be in sleep mode. Although the majority of owners have renovated the Janta flats of F block with additional construction, Singh said that they have outlived their age and are not safe for living. "Noida Authority should build multi-storeyed flats with open spaces so that owners can live safely with modern amenities," said Singh. There were several incidents of plaster collapse in older complexes located in sectors 99, 40, 71, 105, and 119, as well. DGM (Noida Authority) Vijay Rawal told TOI that as per the lease deed, the flat owners have to rectify these types of issues. "Once the authority hands over the building or a flat, its maintenance becomes the responsibility of the residents or AOA or concerned RWA after one year of handover. Just like any other builder apartments, any flats made by the authority are under authority supervision for only one year post-handover. After that, the maintenance, repair, and upkeep of all such buildings or flats is the responsibility of the concerned area RWA residents or AOA," said Rawal. Meanwhile, Noida Authority introduced a redevelopment policy for old residential buildings, offering homeowners larger apartments with at least a 15% increase in carpet area and free new flats, alongside temporary housing or rent during reconstruction on June 14. This policy is applicable to buildings that are over 30 years old or those declared structurally unsafe. Redevelopment requires consent from 70% of leasehold residents.

Noida: Accusing it of deliberately defying Supreme Court orders mandating the registration of flats, the apartment owners association (AOA) of Lotus 300, a condominium in Noida's Sector 107, has served a legal notice to Noida Authority. AOA officials told TOI that despite the issuance of occupancy certificate (OC) and completion certificate (CC) for four towers comprising 228 flats on April 22, the registration process remains stalled. This has prompted the AOA to warn of contempt proceedings to protect homebuyers' rights, they said. AOA president Bhuwan Chaturvedi said that the first batch of 25 flat owners, out of the 228 flats in towers 3 to 6, have already purchased and deposited the requisite stamp fee totalling Rs 5 crore with the Noida Authority for registration on April 28. Techno Mag Learn More Undo The legal notice, issued on Wednesday to Noida Authority CEO Lokesh M, mentioned repeated requests from the AOA—including letters sent on eight different dates between April and July—and over 20 visits by AOA representatives to the Authority's office. The AOA argued this inaction amounts to "deliberate and wilful" contempt, harming genuine homebuyers. It has warned that continued non-compliance may force them to initiate contempt proceedings in the Supreme Court. The legal battle stems from a decade-long struggle for the registration of 330 flats across six towers in Lotus 300 Society, developed by Hacienda Project Private Limited (HPPL). In March 2010, the Authority had allotted 17 acres of land to HPPL, and the developer launched the project with a promised completion timeline of 39 months, which was later extended to July 2017. However, the developer completed only four of the towers, handed over partial possession, and failed to deliver promised amenities, leading to legal action by homebuyers. In 2018, homebuyers filed an FIR with the Economic Offences Wing of Delhi Police against HPPL directors, alleging cheating, criminal breach of trust, and criminal conspiracy. In 2019, the Noida Authority issued a recovery notice for Rs 64 crore against the developers, which the company challenged. In Feb 2024, the Allahabad high court ordered an Enforcement Directorate (ED) investigation into alleged money laundering and fund diversion by the developers. It also directed the Authority to issue OC/CCs and execute flat registrations without insisting on payment of dues from the developers. The ED investigation order was challenged by the former promoters in the Supreme Court. While the court partially stayed the ED probe, it allowed legal action against the former promoters in accordance with the law. In the same order, and in a petition filed by the Authority, the Supreme Court repeatedly directed the Authority to expedite flat registrations. In its order dated Sept 27, 2024, the court mandated the appointment of a nodal officer to coordinate with the AOA and the Resolution Professional overseeing HPPL, which has been under insolvency proceedings since Nov 2022. The court also instructed the Authority to complete registrations for towers 1 and 2 within four weeks, leading to 92 out of 102 flats being registered starting Oct 2024. Noida Authority officials said that they are yet to receive the legal notice, but added that they have not stopped the registry process. "Details of the builder-buyer agreement and other documents of the buyers were sought from the IRP so that only genuine buyers are able to register their flats," a senior official said.
