(Bernama pic) PETALING JAYA : A farmer was fined RM15,000 by the Sepang sessions court today for making and transmitting an offensive communication regarding a 3R (religion, race and royalty) issue via his Facebook page last February. Judge Ahmad Fuad Othman imposed the fine on Faisal Yusof, 37, after he changed his plea to guilty when the case was called up for mention, Bernama reported. Before meting out the sentence, the judge warned Faisal to be more cautious when using social media. 'You deleted the comment, but look what has happened, it persists even after deletion. You're still young, you need to think long and hard,' he was quoted as saying. Faisal was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998 for making and transmitting the offensive communication via his Facebook account 'Mohd Faisal Yusof' with the intention of causing annoyance to others. The posting, made at 12.40am on Feb 9, was subsequently deleted but was still detected by the Malaysian Communications and Multimedia Commission at 1.40pm on the same day. The offence carries a maximum fine of RM50,000 or up to one year in jail, or both, with additional daily fines if the offence continues after conviction.

SEPANG: An Indian national has pleaded guilty in the Sessions Court here to a charge of attempting to smuggle out 2,578 red-eared turtles at the KL International Airport Terminal 1. Sathaiyan Alagusundaram made the plea yesterday after the charge was read out to him in Tamil before judge Ahmad Fuad Othman, who then set Sept 19 for mention for sentencing. No bail was granted for the accused, who was unrepresented, Bernama reported. Deputy public prosecutor Mas Izzaty Lokman appeared for the prosecution. Sathaiyan was charged with attempting to smuggle 2,578 turtles, which are controlled species under the Fifth Schedule of the Wildlife Conservation Act 2010 (Act 716), at Gate G8, KLIA Terminal 1, here at 10.05pm on Aug 5. He was charged under Section 117(1) of the Wildlife Conservation Act 2010, read with Section 511 of the Penal Code. The accused faces a fine not exceeding RM30,000 or a maximum imprisonment of one year, or both, upon conviction.

Mohammad Faisal was charged with knowingly making and initiating the transmission of offensive comments with the intention of annoying others using the Facebook account 'Mohd Faisal Yusof'. The posting was made at 12.40 am on Feb 9 and was seen by the Malaysian Communications and Multimedia Commission (MCMC) at 1.40 pm the same day at MCMC Tower 1, Jalan Impact, Cyber 6, Cyberjaya. The charge, under Section 233 (1) (a) of the Communications and Multimedia Act 1998, provides a maximum fine of RM50,000 or imprisonment not exceeding one year or both and may be further fined RM1,000 for each day the offence continues after conviction.
