Kinahan boss Sean McGovern appears in Special Criminal Court after Dubai extradition

Kinahan cartel boss Sean McGovern is due to arrive in Ireland on Thursday evening to face murder and gangland charges, having been extradited from Dubai on Wednesday night. McGovern - described by United States authorities as Daniel Kinahan's closest confidant - is being flown back to Ireland from Dubai in the United Arab Emirates by the Air Corps and accompanied by Gardaí. The Air Corps' €120 million Casa C295 maritime surveillance plane left Dubai at approximately 8.30pm Irish time on Wednesday evening. The crew, accompanied by Gardaí, are understood to have left Ireland in recent days on the aircraft, before reaching Dubai on Tuesday evening after a 6,000km flight. Dubai cops handed McGovern over to Gardaí on Wednesday before the long flight back to Ireland, which stopped off in Larnaca in Cyprus and Marseille in France before its scheduled arrival at Air Corps HQ in Baldonnel. McGovern, from Crumlin, is expected to appear at the non-jury Special Criminal Court shortly after the C295 lands in Dublin. Gardaí will arrest him as soon as he lands and he will then be charged and brought to court. The dramatic move follows Dubai's arrest of McGovern, 38, in the desert oil state last October. That was on foot of an extradition request from Irish authorities. The request was made after the Director of Public Prosecutions ordered that McGovern be charged with two offences linked to the Kinahan Hutch feud, a war that left up to 18 men dead. McGovern is to be charged with the December 2016 murder in Clondalkin in the west of the capital of Noel Kirwan. Gardaí have also been authorised to charge McGovern - who was one of seven people including Daniel, Christopher and Christy Kinahan - to be formally sanctioned by America in April 2022, for directing a crime gang. That is a rarely-used law that can see anyone convicted for life - which is also the penalty for someone found guilty of murder. McGovern has been in custody in Dubai since October, but he was fighting the extradition request. But he lost that fight and is now being brought back to Ireland - where he will now face justice. Ireland had no extradition treaty with Dubai at the time, but former Justice Minister Helen McEntee and Garda Commissioner Drew Harris both lobbied UAE authorities to get McGovern arrested. Ireland and the UAE have now agreed a deal and that is sure to be bad news for the three Kinahan men - who are also holed up in the UAE. Sean McGovern made no reply when he was formally charged with murder and four gangland offences in a Dublin court on Thursday night. Mr McGovern, 39, spoke only once to confirm his identity during a 15-minute hearing at the non-jury Special Criminal Court. 'Yes,' he replied when he was asked if he was Sean McGovern. Wearing a grey T-shirt, grey sweatpants, white socks and black sliders, Mr McGovern stood as the charges were read out to him. He then sat back down in the dock without comment after the charges were put to him. He is charged with the murder of Christoper, aka Noel, Kirwan at St Ronan's Drive in Clondalkin in west Dublin on December 22, 2016. Mr Kirwan, 62, was shot dead in the driveway of his home. He was targeted by the Kinahan cartel after he was spotted with Gerry 'the Monk' Hutch at the funeral of his brother Eddie Hutch in Dublin in February 2016. Mr McGovern, who appears to have shaved his head, is also charged with four gangland offences. It is alleged that between October 20, 2016 and December 22, 2016, he directed the activities of the criminal gang that murdered Mr Kirwan. It is also alleged that between the same dates he facilitated the crime gang's murder of Mr Kirwan. He faces a further two charges in relation to a murder attempt on James 'Maggo' Gately, 36, a leading figure in the Hutch organised crime gang. It is alleged that between October 17, 2015 and April 6, 2017, he directed a criminal organisation in relation to the monitoring of the activity of Mr Gately. It is further alleged that between the same dates, he facilitated a conspiracy to murder Mr Gately. Earlier, Detective Sergeant Donal O'Daly of the Garda Drugs and Organised Crime Bureau told the three judges - Karen O'Connor, Elma Sheahan and Grainne Malone – that he arrested Mr McGovern at 6.38pm at Casement Aerodrome in Baldonnel, south Dublin, the HQ of the Air Corps. Mr McGovern had moments earlier landed there in an Air Corps Casa C295 plane that brought him from Dubai on Wednesday evening. McGovern, alleged to be the right-hand man of mob boss Daniel Kinahan, 48, had been in custody in the desert city since October last year. His extradition followed a request by Irish authorities. Detective Sergeant O'Daly said he charged McGovern with all five offences in the precincts of Criminal Courts of Justice complex, where the Special Criminal Court is based, at 7.27pm. He also said he handed Mr McGovern a true copy of the charges and that he read over the charges to him in ordinary language. McGovern had arrived at the CCJ at 7.11pm – under tight Garda security. He entered the court at 7.40pm, 13 minutes after he was charged. The court heard that the Director of Public Prosecutions had directed the case be heard at the Special Criminal Court, which has no jury. Defence barrister Olan Callanan BL told the court that he was reserving his position on the lawfulness of the arrest of Mr McGovern and the jurisdiction of the Special Criminal Court. There was no bail application. Mr Callanan requested that the case be remanded to June 5, via video link from Portlaoise Prison. McGovern was then remanded in custody to Portlaoise Prison to June 5.

The flight is expected to arrive in Dublin late this afternoon after covering a distance of approximately 6,000 kilometers. The Air Corps crew and gardai left Ireland several days ago to pick up McGovern in Dubai and are now making the long return journey. Upon landing, McGovern, aged 38 and from Crumlin, will be arrested immediately and is expected to appear before the non-jury Special Criminal Court to face murder and gangland charges. It has taken off from Dubai International Airport in the last 15 minutes. Sources tell us he is now on board an Air Corps' €120 million Casa C295 maritime surveillance plane. The crew, accompanied by Gardai, are understood to have left Ireland in recent days on the aircraft, before reaching Dubai on Tuesday evening after a 6,000km flight. Gardaí believe the Kinahan cartel murdered the innocent Mr Kirwan simply because he had been seen in the company of Gerry 'The Monk' Hutch, 62, at the funeral of his brother Eddie. Eddie, 58, was shot dead by the cartel in February 2016 - three days after the Hutch gang's murderous attack on the Regency Airport Hotel that killed Kinahan ally David Byrne, 34. McGovern was also injured in that attack, which was an attempt to murder Daniel Kinahan. McGovern refused to cooperate with Gardaí after the shooting.
