Novartis offers payment plan for high-cost heart medicine
Mumbai: In a first-of-its-kind pricing strategy in the pharmaceutical industry, Swiss drug major Novartis has introduced a financing scheme for its cholesterol lowering drug brand Sybrava (inclisiran) in India, as the company looks to expand the adoption of the new generation heart drug that has so far been restricted due to its high pricing. Novartis has tied up with Indian payment technology company Pine Labs to offer a monthly instalment scheme for the twice-a-year treatment of the injectable drug used to reduce levels of low-density lipoprotein cholesterol (LDL-C), commonly called bad cholesterol. "We have recently launched a zero-interest EMI scheme with Pine Labs so that this treatment can be accessible to more patients," Amitabh Dube, country president & MD, Novartis India, said in an exclusive interview with ET. Each instalment is priced at Rs 15,000-16,000. "The first is a loading dose and the second dose is after 90 days, and then after 180 days. It will be a rolling cycle," said Dube. As per cardiologists, Novartis has come up with a one-on-one scheme where the second injection will be free on purchase of the first dose. However, a patient has to pay full value of the first dosage through equated monthly instalment. The drug was priced at Rs 1.2 lakh per injection when it was launched in January 2024. In the US, sold under brand Leqvio, it is priced at $3,373.4 per dose (about Rs 2.9 lakh). More than 3,000 patients have currently been put on the drug in India. To expand the reach for inclisiran, Novartis has also entered into marketing tie-ups with Mankind Pharma , JB Pharma and Lupin . Mankind, which sells inclisiran under brand Crenzlo, is also evaluating possibilities in terms of patient assistance programmes that can make the drug more affordable to the eligible patients in India, said Atish Majumdar, senior president-sales and marketing. Lupin has launched the drug under Tilpazan, while JB Pharma's brand is Izirize. Lupin and JB Pharma did not respond to ET's query until press time on Monday. In the one year since April 2024, inclisiran recorded sales of Rs 7.7 crore among all three partners, according to data from PharmaTrac. Inclisiran is not a replacement for statins, the most commonly used class of medications to lower cholesterol, but can be recommended as a line of treatment when statins do not work or if a person is statin intolerant. However, top cardiologists are divided over the widespread prescribing of the drug. Some opine it is another addition to their armament of treatment. "It is a very important drug that has come into the market. It has the potential to be a very big game changer for blockages," said Dr Nihar Mehta, associate director, Department of Structural Heart Diseases, Jaslok Hospital & Research Centre. However, others said its usage will be for a limited number of patients. Dr Ganesh Kumar AV, director of cardiology at LH Hiranandani Hospital Powai in Mumbai, said: "The medicine is good but it is being overused. With the right usage there are not many patients who need it. My usage of inclisiran has not been much over the last one year; maybe less than 10 out of the about 2,000 patients with coronary artery diseases I treated".

The Aziz-Dube saga: A sleight of copyright?
Artist Anita Dube recently found herself in the middle of a controversy after she used lines from activist and poet Aamir Aziz's poem, Sab Yaad Rakha Jayega, in her art without his permission. The Patna-born poet alleged that the lines were used without his 'knowledge, consent, credit, or compensation' by Dube and exhibited at the Vadehra Art Gallery in Delhi. The poem and the artwork both fall under the purview of copyright law in India, governed by the Copyright Act of 1957. A wide range of creative works are protected under this legislation, which does not extend to ideas, themes, or plots but only to the particular form in which those ideas are expressed. The author is typically the first owner of copyright. Independent contractors may retain ownership unless a contract specifies otherwise. When work is created under a contract of service (employee-employer relationship), the employer is generally the first owner. Copyright arises automatically upon creation of an original work, and registration provides evidentiary support in disputes. The Aziz–Dube matter highlights enduring ethical and legal questions about adapting the works of both living and deceased artists, in terms of consent, attribution, and commercialisation. In India, the general rule for original literary, dramatic, musical, and artistic works is that copyright protection endures for the author's lifetime plus 60 years. For other categories of work such as cinematographic films the period of protection is 60 years from the date of first publication. Indian copyright law grants copyright owners the exclusive right to create derivative works, which include adaptations, translations, and other modifications. Adaptation, a subset of derivative works, usually involves changing the format or medium of the essence of the original work is retained, but it is presented differently to reach new audiences or serve new purposes. Derivative works are also protected and copyright in the derivative work vests with the adapter to the extent of the new, original contributions — subject to the subsisting rights in the original work. The right to adapt a work is one of the exclusive rights conferred upon the copyright owner. In the absence of a licence from the from the copyright owner, the adapter may be exposed to legal consequences for copyright infringement. Unauthorised derivative works typically constitute infringement. However, the fair dealing doctrine allows limited use of copyrighted material without permission. There are specific exceptions for purposes such as criticism, review, reporting of current events, and private use including research. Fair dealing seeks to strike a balance between protecting intellectual property and facilitating access to knowledge. While some political expression may intersect with public interest, there are limits to this doctrine. Moral rights protect an author's personal and reputational interests in their work, distinct from their economic rights. These rights survive the assignment of economic rights and are often described as inalienable. A legal claim by an author against unauthorised modifications to their work must succeed in establishing that the treatment of the work has been prejudicial to their reputation. In her public statement, Dube acknowledged an 'ethical lapse' in not seeking Aziz's permission, although she had credited him. She also clarified that the artwork has since been withdrawn from sale. Aziz, for his part, objects to the manner in which his poem was used. Dube also invoked the spirit of the commons and 'copyleft', referencing frameworks the Creative Commons framework, which encourage the free sharing of copyrighted material provided all derivative versions are shared under the same terms. The incident has reignited a discourse on the commercial appropriation of politically resonant and marginalised voices in art. Using the work in a commercial context without consent may be seen as a modification that violates the integrity rights of the author irrespective of any assignment of economic rights. Former world junior hockey player tears up at ex-teammates' sex assault trial

A former member of Canada's world junior hockey team briefly broke down in tears Thursday at the sexual assault trial of five of his ex-teammates as he faced questions over texts he sent a week after the encounter at the heart of the case. Brett Howden teared up as he described feeling scared and nervous after learning Hockey Canada had launched an investigation into the June 19, 2018, encounter and realizing he would have to explain the situation to his parents and his girlfriend, now his wife. Howden was being questioned during a voir-dire — essentially a trial within a trial — over a text conversation he had with another then-teammate, Taylor Raddysh, on June 26, 2018. In the exchange, Howden recounts some of the events of that night, including a moment when he said one of the accused, Dillon Dube, slapped the complainant on the buttocks. Howden said he saw Formenton head toward the bathroom with the woman but didn't see them go in. He also mentioned Dube 'spanking' the woman, but said he couldn't remember if he'd seen it. The Crown is seeking to introduce as evidence texts sent to Raddysh about that specific allegation. 'Dude, I'm so happy I left when all the s–t went down haha,' the message reads. 'When I was leaving, Duber (Dube) was smacking this girl's a– so hard, like it looked like it hurt so bad.'
