NEW YORK — Blake Lively is willing to drop her emotional distress claim against her 'It Ends With Us' director and co-star Justin Baldoni, who she alleges sexually harassed her on-set and subsequently launched a smear campaign. Baldoni's lawyer Bryan Freedman told TMZ that the 'Gossip Girl' star, 37, is on board so that she won't have to release requested medical records to the 'Jane the Virgin' alum's legal team. Now, the Baldoni-Wayfarer camp is asking New York federal Judge Lewis J. Liman to either order Lively to send over all requested documentation or dismiss the claims with prejudice, which would prevent her from refiling in the future. Lively's legal team on Monday asked Liman to oppose such a motion, dismissing the move as a 'false and plainly improper public relations stunt,' and requests to withdraw the claims without prejudice, which would enable her to eventually refile if she so chooses, according to a filing shared with the Daily News. They described Lively's willingness to withdraw the claim as a 'good faith' desire to 'streamline her case' and dismissed allegations that she ''refused' to disclose medical and mental health information,' as that would only be relevant to the claims she's willing to withdraw. 'We are doing what trial lawyers do: preparing our case for trial by streamlining and focusing it; they are doing what they do: desperately seeking another tired round of tabloid coverage,' Lively's lawyers, Esra Hudson and Mike Gottlieb, said in a statement shared with The News. Lively in late December filed a complaint and lawsuit accusing Baldoni of sexual harassment and launching an alleged online hate campaign. Denying Lively's accusations, Baldoni filed a $400 million defamation lawsuit against the actress, husband Ryan Reynolds and publicist Leslie Sloane. The case is slated to head to trial in New York in March 2026.

Last month, Baldoni's legal team withdrew a high-profile subpoena that would have required singer Taylor Swift to testify in the case. The trial is currently scheduled to begin on March 9, 2026.

To defend Blake Lively, 'It Ends With Us' director's counsel sought 'Gossip Girl' actress' consent to access her medical and mental health records, Variety reported citing court filing. 'Instead of complying with the Medical RFPs, Ms. Lively's counsel recently advised us, in writing, that Ms. Lively is withdrawing her [infliction of emotional distress] Claims,' the court filing stated. After Blake Lively accused Justin Baldoni of misconduct and imposed infliction of emotional distress allegations in her December 2024 lawsuit, 'Jane the Virgin' star's attorneys sought the actress' permission to access her medical records. Baldoni's legal team had argued that these medical records were vital in the case to establish Blake Lively's claims. Notably, a signature on a HIPAA release was required to access therapy notes and other relevant information about her medical history. Blake Lively's refusal to provide access to medical records was met with indignation as Baldoni's team stated, 'Ms. Lively has refused the Wayfarer Parties' reasonable request that the withdrawal of such claims be with prejudice. She is only willing to withdraw her claims without prejudice. In other words, Ms. Lively wants to simultaneously: (a) refuse to disclose the information and documents needed to disprove that she suffered any emotional distress and/or that the Wayfarer Parties were the cause; and (b) maintain the right to re-file her IED Claims at an unknown time in this or some other court after the discovery window has closed.' The actress in her complaint had claimed that she suffered 'severe emotional distress and pain, humiliation, embarrassment, belittlement, frustration and mental anguish.' Meanwhile, Blake Lively's lawyers suggested that her request was 'a routine part of the litigation process that is being used as a press stunt,' Page Six reported.

She accused him of creating a hostile work environment and causing her 'severe emotional distress' during filming. New details have emerged in the Blake Lively and Justin Baldoni cause. After Taylor Swift was subpoenaed as a witness by the 'Jane the Virgin' star's legal team earlier this month, Baldoni's side has dropped the filing in a bombshell move, according to People. 'The Baldoni and Wayfarer team have tried to put Taylor Swift, a woman who has been an inspiration for tens of millions across the globe, at the center of this case since day one,' the spokesperson continued. 'Exploiting Taylor Swift's celebrity was the original plan in Melissa Nathan's scenario planning document, and it continues to this day. Faced with having to justify themselves in federal court, they folded. At some point they will run out of distractions from the actual claims of sexual harassment and retaliation they are facing.' In the letter, Freedman claimed he was told by an anonymous source that Lively's lead lawyer, Michael Gottlieb, allegedly threatened to release Swift's text messages if the artist didn't publicly support Lively. Lively also accused Baldoni of creating a smear campaign against her. Both parties have denied the allegations against them, and their trial date is set for March 2026.
