Erik Menendez's Grave Illness Should Lead to Immediate Furlough, Family Says
Erik Menendez's Grave Illness Should Lead to Immediate Furlough, Family Says originally appeared on L.A. Mag. Erik Menendez, 54, is in the hospital and has been diagnosed with a serious medical condition, his family and attorney confirmed, and should be immediately furloughed rather than wait for a state parole board hearing scheduled for him and his older brother Lyle, 57, next month. Mark Geragos, who has spent years battling to get the Menendez brothers released based on new evidence that calls their 1989 conviction and life sentence into question, said Erik's health condition should lead to an immediate furlough. In May, Los Angeles Superior Court Judge Michael Jessic resentenced the brothers last week to 50 years to life in prison, which makes them eligible for parole at hearings currently scheduled for August 21 and 22. Earlier this month, a second Superior Court Judge, William Ryan, ordered Los Angeles County District Attorney Nathan Hochman to explain why exculpatory evidence was kept from the jury in the second trial of Erik and Lyle Menendez regarding their claims of sexual abuse. Ryan ruled that two new pieces of evidence would, more likely than not, have changed the outcome of their convictions - a letter from Erik Menendez to his cousin Andy Cano, which the defense "allege corroborates Cano's testimony and the sexual abuse allegations," the brothers made at trial. The second piece of new evidence is a declaration from Roy Rossello, a member of the band Menudo who says he was raped by José governor discussed the case Sunday with "Monsters" dramatic series creator Ryan Murphy on his podcast, "This is Gavin Newsom," saying he would decide by Labor Day on whether to release the brothers after more than 35 years behind bars. Evidence presented to Jesic portrayed the brothers as having participated in extensive rehabilitation efforts.[Geragos is the co-owner of Engine Vision Media, the parent company of Los Angeles] This story was originally reported by L.A. His attorney, Mark Geragos, appeared on TMZ calling for Erik Menendez's immediate release. "It's a serious condition," Geragos told TMZ. Erik Menendez hospitalized with ‘serious condition,' may not return to prison
Convicted killer Erik Menendez is in the hospital after being diagnosed with a serious medical condition, his family said Tuesday. Menendez has reportedly been undergoing treatment for kidney stones at an outside medical facility since Friday, according to TMZ. Sources told the outlet that California Gov. Gavin Newsom is currently reviewing the change in medical status to determine if a 'prison furlough' is appropriate. Menendez's attorney Mark Geragos said the condition is so serious that he's calling for his client's immediate release ahead of a parole hearing next month. 'I just think he should be parole furloughed,' Geragos told TMZ. 'He could be medically furloughed in advance of the hearing so that he can work with the parole attorney and get up to speed and be ready and do it and give it his best shot. I think that it's the only fair and equitable thing to do.' Menendez, 54, and brother Lyle Menendez, 57, were initially sentenced to life without the possibility for parole after two high-profile trials for the 1989 murder of their parents, Jose and Kitty Menendez, at their Beverly Hills, California, home. The brothers said they feared for their lives following years of sexual abuse by their father, who they allege threatened to kill them if they revealed the abuse. After serving 35 years behind bars, a judge in May reduced the brothers' sentences to 50 years to life. Under California state law, they became immediately eligible for release because they committed the crime when they were under the age of 26. A parole hearing is scheduled for Aug. 21 and 22, though the process could be expedited for Erik Menendez, depending on what the governor decides about his medical condition. It's unclear how long a furlough would last, though it could mean Menendez would not return to prison given that the hearing is only a month away. During their resentencing, Judge Michael Jesic said he was impressed with the brothers' behavior while behind bars at the Richard J. Donovan Correctional Facility in San Diego. 'Life without parole gives an inmate no hope, no reason to do anything good,' Jesic said. 'I give them a lot of credit. It's remarkable what they did when they had no hope of getting out.' Newsom previously indicted he was open to granting the brothers clemency, but wouldn't make a decision until after the parole hearing is complete. _____

Erik Menendez hospitalized with kidney stones as attorney demands release before parole decision
Erik Menendez, one of two Beverly Hills brothers convicted of killing their parents decades ago, has been hospitalized, according to media reports. Menendez was undergoing treatment for kidney stones, TMZ reported on Tuesday. His attorney is now calling for him to be released ahead of an August parole hearing. "It's a serious condition," attorney Mark Geragos told TMZ. "I just think he should be parole furloughed, I think is the proper term, and he could be medically furloughed in advance of the hearing so that he can work with the parole attorney and get up to speed and be ready and do it and give it his best shot. I think that it's the only fair and equitable thing to do." Fox News Digital has reached out to Geragos. Erik and his brother Lyle Menendez were sentenced to 50 years to life in prison for the 1989 murders of their parents – Jose and Mary "Kitty" Menendez – in their Beverly Hills mansion. The brothers initially claimed intruders broke into the home and killed their parents. They later described their actions as self-defense after their parents allegedly physically and sexually abused them for years. The case received renewed attention last year when Netflix released a series and a documentary about the killings. Fans rallied around the brothers and called for their release. Their parole hearing is scheduled for Aug. 21 and 22. California Gov. Gavin Newsom, who has the final say, said he plans to make a decision on whether the brothers are suitable for parole by Labor Day if they are recommended for release.
