Kolkata: The Alipore court on Friday allowed the voice sample test of the three main accused in the law college gang rape case. Sourin Ghosal, the public prosecutor in this case, informed the court that the voice samples of the main accused, Monojit Mishra, and his aides, Zaib Ahmed and Pramit Mukherjee, will be recorded and matched with call records collected prior to the incident. "We told the court that this will further prove that the accused planned and executed the crime over a period of several days, said Ghosal. Kolkata: In what is being claimed as a first-of-its-kind order by a court in Kolkata, all four accused in the South Calcutta Law College rape case were remanded to police custody for an additional period of three days, 39 days after they were first arrested. The prime accused in the case, Monojit Mishra, an alumnus and a contractual employee of the college, and two of his suspected accomplices, Pramit Mukhopadhyay and Zaib Ahmed, both students, along with Pinaki Banerjee, security guard of the campus, were granted police custody till August 8 by Amit Sarkar, Additional Chief Judicial Magistrate of Alipore Court. The order was passed on Tuesday in the wake of all four accused having previously been remanded to police custody for 11 days, followed by their judicial custody for another 28 days. "Under the provisions of Section 167 of the earlier CrPC Act, the prayer for police remand had to be made within the first 15 days of arrest. That provision has now changed under the new Bharatiya Nagarik Suraksha Sanhita (BNSS), which replaced the CrPC on July 1, 2024. The BNSS now empowers the police to pray for remand anytime within the first 60 days of arrest for heinous crimes like rape and murder," Sourin Ghosal, the Kolkata Police Chief Public Prosecutor in Alipore Court, explained. "But this was the first time that the relevant clauses of BNSS were invoked in a court in Kolkata and, possibly, in the entire West Bengal and in which the judge found merit," Mr Ghoshal added. He said that the prayer for additional police remand of the accused was made in the light of fresh reports received by the investigators from cyber and forensic experts. "The statements previously made by the accused and the reports we have now received do not match in many places. Hence, there is a need to freshly interrogate the accused in police custody and, if required, they may be made to sit face to face to get to the bottom of the alleged crime," Mr Ghoshal said. In its order, the ACJM court, Alipore, rejected the defence counsel's prayer for bail and held that Section 47 of the BNSS, which mandates the police to inform the arrested person of the grounds of arrest and right to bail, has been "duly complied" with. "It transpires from the prayer of the prosecution that PC is required for the purpose of pending investigations and so more fully described in the forwarding report of the IO. On perusal of the CD (case diary), I do find incriminating materials available against all the accused persons," the judge stated in his order. "All these aspects seem to this Court to be much of the essence and importance so far as investigation of this case is concerned, but the case itself is very grave and heinous to say the least. The purpose of the investigation of this case can be well served if the police custody of the present accused persons is granted by this court as prayed for," the order goes on to add. The shocking on-campus rape was alleged by a first-year student at the law college in south Kolkata's Kasba area where she named Mishra as the principal perpetrator of the crime and both Mukhopadhyay and Ahmed as accomplices. While the crime allegedly took place between 7.30 pm and 10.50 pm on June 25, the three accused were arrested on the intervening night of June 26 and 27. They were subsequently produced in Alipore court and remanded in police custody on June 27. A day later, the on-duty security guard of the campus during the time of the alleged crime, was also booked and remanded in custody. All accused have since been produced before the court thrice for extension of police remand and their subsequent judicial custody. The Kolkata Police prayed for the maximum term of custody for all the accused after they had served two back-to-back judicial remands of 28 days.

Kolkata: An Alipore court on Tuesday sent the law college gang-rape accused to police custody till Aug 8. This is the first time in any lower court in Kolkata that any accused under BNS was sent to cop custody after spending over two weeks in judicial custody, public prosecutor Sourin Ghosal said. Kolkata Police produced four accused at the court from judicial custody and requested cop custody for the three main accused — Monojit Mishra, Zaib Ahmed and Pramit Mukherjee — till Aug 8, and security guard Pinaki Mukherjee till Aug 9. "We have found that the reports are not in accordance with our forensic findings. This is why we need to question the accused yet again," Ghoshal informed court. Cops also claimed in court that the statement of main accused did not match forensic reports. Mukherjee also moved court and sought bail. The order was initially reserved for several hours for the second consecutive day of hearing.

Calcutta University has decided not to hold its LLB fourth, sixth, and eighth semester examinations at the law college in Kolkata where a former contractual staffer allegedly raped a student on June 25, an official said on Sunday. The examinations will be held from August 11 to August 26 at the university's other centres. 'The shadow of the horrific incident is still in the minds of all, and there are barricades in front of the campus since the investigation is going on. The police are present on the campus, guarding the student union room and the guard room where the alleged crime took place. So the college will not be an exam centre,' said the university official, adding that the second semester examinations could also not be held at the college because of heavy police deployment in the wake of the alleged rape. In the Calcutta High Court, counsel representing the college had requested the bench of Justices Soumen Sen and Samira Das De to provide a temporary police post on the campus until the college could hire new security staff. According to sources, a member of the college's governing body had requested the university not to consider the college as an examination centre until the police deployment was withdrawn. Monojit Mishra, 31, a former contractual staffer at the college, and security guard Pinaki Banerjee, 55, and second-year students Zaib Ahmed, 19, and Pramit Mukherjee, 20, are the accused in the case. Mishra was also a functionary of the ruling Trinamool Congress's student wing. On Friday, the university removed two of its nominees from the college governing body. Interim Vice-Chancellor Santa Datta De said in a statement that Sibranjan Chatterjee and Yashwanti Sremanee had been removed for 'the irregular appointment of Monojit Mishra and not opposing the appointment and other irregular activities of the governing body'. Also on Friday, the police sought police custody of all four men accused in the case for further investigation, but the Alipore court sent them back to judicial custody till August 5. Police sources said there had been some discrepancies in the statements of the accused and their gait analysis (comparison of a person's walking pattern to that captured in CCTV footage) report. The police's detective department has taken over the rape case from the Special Investigation Team (SIT). The SIT, which initially had five members and was later expanded to add four more, will now assist the department in the inquiry.

This is the first time that the Kolkata Police asked for custody of any accused under BNS in the Alipore court — also the first in a heinous crime — after the accused spent over two weeks in judicial custody, said sources.
