The Jammu and Kashmir and Ladakh high court has issued notices to Union home secretary and the Central Reserve Police Force (CRPF) asking them to respond to the sacking of a jawan before next hearing on June 30. The court was hearing a plea filed by CRPF jawan Munir Ahmed challenging his dismissal from service, his counsel, advocate Ankur Sharma told HT. Acting on the petition, justice Javed Iqbal Wani has issued notices to Union home secretary and CRPF and has asked to reply before the next hearing—June 30. Ahmed was dismissed from service after it was found that he married his cousin sister Menal Khan, a Pakistani national who had migrated from Jammu's Bhalwal tehsil during partition in 1947. In his writ petition, Ahmed claimed that since he was sacked from service in 'An arbitrary, capricious, and whimsical manner' through an impugned termination order dated May 2, 2025, he requested the HC to 'set it aside'. Ahmed in his petition said, 'From 2022, he had duly intimated the authorities concerned in the CRPF about his marriage and duly followed the procedure and rule.' He also produced communications and representations presented to the higher authorities, the petition mentioned. Munir Ahmed reiterated that he first filed an application seeking permission for his marriage in 2022. However, in January 2023, it was reverted, along with some objections. The MPs wrote to the Union minister of state for home affairs and the Union minister for external affairs, seeking a visa for his wife. In the latest letter dated February 6,by Gulam Ali Khatana, a nominated Rajya Sabha MP from the BJP, requested external affairs minister S Jaishankar to expedite the granting of a long-term visa to Munir's wife. In a similar request in February 2024, Jugal Kishore Sharma, BJP MP from Jammu-Reasi, requested the then minister of state for home affairs Ajay Kumar Mishra to clear Menal Ahmed visa application pending before the MHA. Munir Ahmed was dismissed after India decided to repatriate Pakistani nationals in the aftermath of Pahalgam terror attack on April 22 that left 26 tourists dead and scores injured.

SRINAGAR: A CRPF jawan from Jammu and Kashmir, Munir Ahmed, who was dismissed from service for marrying a Pakistani woman, has moved the Jammu and Kashmir High Court to challenge his termination. Ahmed, through his counsel Ankur Sharma, a BJP leader, filed a petition in the Jammu wing of the High Court contesting his sacking. Justice Javed Iqbal Wani has issued notices to the respondents – Director General CRPF, and Commandants of the CRPF's 41 Battalion at Bangrasia, Bhopal (Madhya Pradesh), and 72 Battalion at Sodra, Sunderbani in J&K's Rajouri district. The court has directed the respondents to file their objections on or before the next date of hearing, which has been scheduled for June 30. Munir Ahmed, who joined CRPF in 2017 and has served in Chhattisgarh, Bihar, J&K and Madhya Pradesh, was dismissed from service on May 2 for marrying a Pakistani woman, Menal Khan, who is also his cousin. Ahmed maintains that he had informed the CRPF headquarters about his intention to marry a Pakistani national. 'My marriage with Pakistani national Menal Khan, who is also my cousin, was decided by our elders during my childhood. In 2022, I informed the CRPF officials of my intent to marry a Pakistani national (Menal Khan) and sought permission for marriage. Responding to a letter dated 24/01/2023 by CRPF in which some queries were raised, I submitted required documents on 18/10/2023. Again, on 05/11/2023, I sought clearance/NOC for marriage with Menal,' Munir told The New Indian Express.

The Jammu and Kashmir and Ladakh High Court has issued a notice seeking the Central Reserve Police Force's stand on a petition by a former constable against his dismissal from service for allegedly concealing his marriage to a Pakistani woman, The Indian Express reported on Thursday. The paramilitary force, in its May 3 order to dismiss the former constable, Munir Ahmed, had also accused him of 'knowingly harbouring' the Pakistani woman even after her visa expired Munir, however, had said that he had received permission for the marriage on April 30 last year. The former constable, who is a resident of Jammu and Kashmir's Bhalwal, was last posted with the 41st battalion of the Central Reserve Police Force in Bhopal. He was stationed at the 72nd battalion stationed in Jammu and Kashmir before that. Munir's marriage to a Pakistani woman named Minal Khan was said to have come to light when India directed Pakistani citizens to leave the country by April 27 in the backdrop of the April 22 Pahalgam terror attack, which killed 26 persons. The paramilitary force said that his actions 'were found to be in violation of service conduct and detrimental to national security'. In his petition in the court, Munir described his dismissal from the paramilitary force as 'arbitrary, capricious and whimsical', adding that he had informed authorities 'time and again by following the procedure and rules since 2022', according to The Indian Express. He added that he had also informed the Central Reserve Police Force that he had married Khan on May 24 last year. The petition claimed that Munir had informed the paramilitary force about his impending marriage in 2022. The Central Reserve Police Force responded with some objections, which was answered by the former constable in October 2023, it added. Munir said that the inspector general of the Central Reserve Police Force on November 17, 2023, told the special director general of police that the former constable had submitted documents that appeared to be sufficient for the purposes of intimation as per Central Civil Services Conduct Rule 21(3) provisions, , The Indian Express reported. This provision mandates that a government servant who marries or has married a person of a different nationality must immediately inform the government. The petition added that Munir had 'also asked for guidance in the matter for taking a final decision in the matter', according to the newspaper. 'The DIG [deputy inspector general] also vide communication dated December 12, 2023 informed the Inspector General (Adm) that the petitioner has done his duty to inform the department under the relevant rule and has submitted the relevant documents and the same have been sent to the office for necessary action/issuance of no objection certificate,' the newspaper quoted the petition as having said. The petition said that on April 30, 2024, the director general of the paramilitary force 'certified that the petitioner has intimated the department well within the rules'. This communication also said that 'there is no mention of issuing any no objection certificate under the rules', it added. Munir then married Khan via video conferencing on May 24 last year, the petition said, adding that it was registered in both Pakistan and in India. He said that he had informed the Central Reserve Police Force about it through representations in October and December. On his transfer to the 41st battalion of the Central Reserve Police Force in Bhopal in March, he had also told the new commandant of his marriage, the petition said. Munir told the court that that Khan had been in India on a visiting visa till February 28 and had then had applied for a long-term visa on March 4, which was still pending, The Indian Express reported. In light of the petition, Justice Javed Iqbal Wani issued notices to the Centre, the director general of the Central Reserve Police Force, and the 41st and 72nd battalions. The court gave them until the next hearing on June 30 to file any objections to the petition.

Last Updated: The petitioner said he followed the rules, which only require an employee to intimate the department about marriage with a foreign national Munir Ahmed, a 31-year-old constable in the Central Reserve Police Force (CRPF), has approached the High Court of Jammu & Kashmir and Ladakh at Jammu, challenging his dismissal from service for marrying his cousin, a Pakistani national. Ahmed alleges that he was terminated in an 'arbitrary, capricious and whimsical" manner by CRPF authorities after marrying his cousin. According to the CRPF, Article 311 of the Constitution, which outlines the safeguards for civil servants against arbitrary dismissal or removal from service, was used to immediately terminate him. CRPF recently terminated another jawan involved in espionage in the same manner. According to Ahmed's petition, he had informed the department back in 2022 of his intent to marry a Pakistani woman. 'I duly informed my officials and submitted an application seeking permission," he stated in the petition. However, the department rejected the request on January 24, 2023, raising objections. In response, Ahmed submitted detailed replies on October 18, 2023, addressing each concern raised. The petitioner argued that he followed the rules under Central Civil Services (Conduct) Rule 21(3), which only require an employee to intimate the department about a marriage with a foreign national. Internal CRPF communications, including one dated April 30, 2024, from the Director General of Police, CRPF, confirm this. 'There is no mention of issuing any no objection certificate under the rules. The petitioner has intimated the department well within the rules," reads the letter. Ahmed married his cousin, Menal Khan, on May 24, 2024, via online video conferencing. He submitted all related documents, including the Indian Nikahnama, Pakistani marriage certificate, and wedding invitation. The marriage was legally registered in both countries. His wife legally entered India on February 28, 2025, using a valid short-term visa. On March 4, 2025, she applied for a Long Term Visa (LTV), which was under process at the time of Ahmed's dismissal. The petition notes that several Members of Parliament supported the visa application through written recommendations. Despite repeated representations and submission of documents, Ahmed was dismissed from service on May 2, 2025, while he was on sanctioned leave to care for his ailing father, who is battling cancer. 'I was on leave from April 28 to May 3 for domestic problems. Still, I was terminated without proper inquiry," he said. The termination order accused Ahmed of 'harbouring a Pakistani national in India" without informing authorities, which he denies. 'I have consistently informed my superiors and submitted every required document. The accusation is completely baseless," he told the court. Ahmed's performance records also reflect positively on him. His Annual Performance Reports for 2023 and 2024 rate him as 'Very Good," and he has not faced any disciplinary action during his service. Through his writ petition, Ahmed has asked the court to quash the termination orders, reinstate him with full back wages, and direct the CRPF to allow him to continue serving. He is also seeking interim relief to stay the operation of the dismissal order while the case is heard. 'This order violates my fundamental rights under Article 21 of the Constitution. I have been punished for following the rules just because I married across the border," Ahmed stated in his plea. The CRPF, while terminating Ahmed, had said: 'In a matter of serious concern, CT/GD Munir Ahmed of 41 Battalion of CRPF has been dismissed from service with immediate effect for concealing his marriage to a Pakistani national and knowingly harbouring her beyond the validity of her visa.
