Madras HC Orders Rape Convict's Prison Wages Be Split Between Children Of Victim And Wife
Last Updated: The court ruled that both children — the one born from the rape and the one from the convict's wife — must receive equal financial support. In an extraordinary verdict, the Madurai Bench of the Madras High Court recently upheld the rape conviction of a factory foreman and directed jail authorities to extract labour from him in prison, with his wages to be split between two children — one born out of the sexual assault and the other from his lawful marriage. The bench of Justice KK Ramakrishnan confirmed the conviction of the 40-year-old appellant, Paraman, under Section 376 of the Indian Penal Code. Court dismissed his plea that the sexual act was consensual, finding that the alleged consent was obtained through coercion, threat, and a false promise of marriage — rendering it invalid under law. The judgment emphasised the vulnerability of the victim, a woman from the same Scheduled Caste community, who worked under Paraman at Saradha Match Factory in Puliparapatti village, Virudhunagar District. The high court found that Paraman used his position of authority to harass and ultimately sexually exploit her. When she became pregnant and sought support, he refused to marry her, prompting her to lodge a complaint in 2006. While the initial police action was limited to charges of cheating and harassment, the judicial process evolved to frame charges of rape based on the victim's testimony and evidence. The trial court sentenced Paraman to seven years of rigorous imprisonment and imposed a fine of Rs 60,000 in 2019. Against this decision, he moved the high court. Citing the victim's credible and consistent testimony, Justice Ramakrishnan relied on several Supreme Court precedents to underline that coercion, abuse of position, and false promises vitiate any alleged consent. 'Only due to the economic duress and constant fear she has succumbed to the accused and her consent is not a voluntary one, but has been obtained by coercion," the court observed. 'Extraordinary circumstances demand extraordinary remedy," the court noted, invoking landmark rulings from the apex court including Prithipal Singh v. State of Punjab (2012) to justify this deviation from the norm. 'The duty of this court does not end with the dismissal of the appeal by confirming the conviction and sentence imposed against the appellant…Mere conviction and sentence of imprisonment in the said circumstances can not meet the ends of justice in the eyes of the children," the court stated. Accordingly, with a 'heavy heart", the high court directed the jail authorities to extract labour from the appellant and his salary is to be disbursed equally to the child born through the victim and his lawful wife. The court also directed the jail authorities to submit a compliance report every six months.

Madurai: Confirming an order of the mahila court in Srivilliputhur , which sentenced a man to seven years of for sexually assaulting a woman in Virudhunagar district, directed the prison authorities to extract work from the man and use his salary for the maintenance of the child born to the survivor and the child born to his wife. In 2006, Paraman sexually assaulted a woman worker at her house. She became pregnant and asked him to marry her, but he refused. Based on the woman's complaint, police registered a case and subsequently arrested Paraman. In 2019, the Mahila court in Srivilliputhur convicted and sentenced Paraman to seven years of imprisonment and imposed a fine of 60,000 for the offence under Section 376 (punishment for rape) of IPC. Challenging the trial court's conviction, Paraman (appellant) preferred the present appeal before the HC. Justice K K Ramakrishnan observed that the victim clearly deposed before the trial court that she was subjected to rape under coercion, in her house, and as a result, a female child was born. The evidence of the victim is cogent and trustworthy. Therefore, the court had no hesitation in upholding the conviction based on the victim's evidence. Hence, the judges dismissed the appeal and confirmed the conviction and sentence imposed on the appellant by the trial court. The judge observed that the duty of the court does not end with the dismissal of the appeal by confirming the conviction and sentence imposed against the appellant. Observing that extraordinary circumstances demand extraordinary remedies, the judge directed the prison authorities to extract work from the appellant and pay his salary for the maintenance of both children. A periodical report of the disbursement of the amount to the children, every six months, should be submitted before the court. The survivor is also at liberty to approach the court if there is any failure on the part of the appellant to pay the amount, the judge directed.

Man dies by suicide at private hospital in Salem
A 60-year-old man died by suicide at a private hospital in Salem city on Wednesday. The police identified the deceased as Paraman, who ran a lorry workshop in Sankari. He was unwell for the past few months and was undergoing treatment at a hospital near the Town Railway Station. On Wednesday, Paraman visited the hospital and consulted with doctors. Later, he ended his life. His body was sent to the Government Mohan Kumaramangalam Medical College and Hospital for autopsy. The police are investigating the circumstances surrounding his decision.
