1 2 Kendrapada: Additional district-cum-special judge (Pocso), Kendrapada, on Tuesday sentenced a 70-year-old man to 20 years of rigorous imprisonment for raping a 9-year-old girl in Nov 2024. Judge Pragyan Paramita Roul also imposed a fine of Rs 50,000 on the convict, a neighbour of the girl. Failure to pay the fine would result in another year of imprisonment. Special public prosecutor Manoj Kumar Sahu said the verdict was based on testimonies from seven witnesses, including the survivor, and medical reports. The court also directed the Odisha State Legal Services Authority (OSLSA) to provide compensation of Rs 6 lakh to the girl, who was then a Class III student. The crime came to light when the survivor's mother filed an FIR on Nov 29, 2024, alleging that the man had raped her daughter the previous evening when she was alone at home. The elderly man had allegedly threatened to kill the girl if she revealed the incident to anyone. Police arrested the man under sections 65 (rape on a woman under 16 years of age) and 331 (house trespass or house-breaking) of BNS, along with Section 6 of the Protection of Children from Sexual Offences Act, 2012.

Extensive legwork, technical leads: How Pune Rural police solved a case of rape and murder of 2-year-old girl in 48 hours

On February 15, 2021, a 25-year-old labourer from a remote village in the hilly region of the Pune district left home for work at around 9 am. The labourer was given the work to chop some large logs of wood next to a dam. Back home were his wife and three children — two daughters aged three and two, and a two-month-old son. His mother had gone to a nearby reservoir to catch fish to be sold in the local market. At around 12 pm, he got a call from a man from his village, saying his two-year-old daughter had gone missing, the police records show. A brutal rape and murder What followed was an extensive search conducted across eight villages in the area, as senior police officers also joined the operation. The police received the first lead when a rickshaw driver told them he had dropped a man and a girl of that description to a location in a neighbouring village. A woman from a neighbouring village further pointed the police in the direction where the man was seen taking the girl. A day after she had gone missing, the girl was found dead in a cement pipe next to a bridge on a road connecting two villages. Autopsy revealed that the girl had been brutally raped and murdered. The police, which had registered a kidnapping case, added the provisions related rape of minor, murder, destruction of evidence and provisions of the Protection of Children from Sexual Offences (Pocso) Act. After the first lead Abhinav Deshmukh, who was the superintendent of police for Pune Rural at the time, formed eight teams and launched an extensive probe. The teams started working on the preliminary description of the suspect, and combed remote hamlets in hilly regions spread across over a dozen villages. Some of these hamlets did not even have motorable approach roads. After their extensive legwork, the police received a possible location where the suspect could have been hiding. Subsequently, working on technical leads and ground-level police work, the investigation team found out that the suspect was hiding at a brick kiln on the outskirts of a village in the Mahad taluka of the state's Raigad district. Within 48 hours after registration of the case, the Pune Rural police arrested Sanjay Baban Katkar, 38, a brick kiln labourer. Katkar had been hiding in a small hut at a brick kiln on the outskirts of Nate village in Mahad. After his arrest, Katkar denied any link to the case, but confessed to the crime following sustained interrogation. He also showed the police where he had disposed of the victim's body and the location where he had dumped his jacket, which he was wearing at the time of committing the crime. The police probe showed that Katkar worked at a brick kiln near the victim's village and had kidnapped her from her house while passing through the area. During the fact-tracked trial of the case in a Special Court for Pocso cases, as many as 16 prosecution witnesses were examined along with circumstantial evidence gathered by the investigation team, including the results of DNA analysis. In the judgment pronounced in the last week of February 2022, the court sentenced Katkar to death under Section 6 of the Pocso Act. He said the assault began six months ago when one of the accused, known to the girl, allegedly lured her to a hilly area on the outskirts of Belagavi city. There, she was raped by the six accused. The six accused recorded the incident on a phone camera, and used the video to blackmail her. They allegedly raped her at multiple locations in the next six months. Pocso case was registered Based on a complaint filed by the survivor on Saturday, Belagavi police nabbed five of the six accused in a swift operation from Saturday evening to Sunday noon. They are looking for the six accused, now absconding. The case was registered under Protection of Children from Sexual Offences (POCSO) Act at the APMC police station of Belagavi. Three weeks ago, three persons, including two minors, one of whom was the son of a police officer, were arrested in connection with the rape of another minor girl at a farmhouse on the Belagavi's outskirts. Ghaziabad: A man was sentenced to seven years in jail on Saturday and fined Rs 20,000 in an 11-year-old case of abduction, inducement for marriage, and rape of a minor. The Special Pocso Court of Lal Babu Yadav mentioned that since the crime commenced before the amendment to the Pocso Act , the convict was sentenced to the maximum quantum available under penal provisions during that period. On Feb 11, 2014, a minor girl was kidnapped from near the Satmola factory in Sahibabad. Her father later registered a case of abduction and forceful marriage at the Karkar Model police station against the accused, who also worked in the same factory. Police launched a manhunt, and the girl was rescued and the accused arrested from Sahibabad railway station on Feb 22, 2014. The girl was sent for a medical test and her statement was recorded under CrPC section 164. A case was then registered under sections 363, 366, and 376 of IPC along with section 3/4 of the Pocso Act, 2012. The accused plead not guilty on all charges, claiming the girl had insisted on their marriage and that he never forced her into any sexual act. Special public prosecutor (Pocso) Satish Sharma argued that the girl was a minor and was allured for marriage. He was also pronounced guilty under section 366 of IPC for alluring a minor for marriage and seducing her under section 366 of IPC. In addition, the court noted that while dealing with Pocso cases, the maximum quantum of sentence prescribed under IPC and the Pocso Act should be awarded. "During the time of the commission of the crime, the provision for an increased sentence of up to 20 years under the Pocso Act was not introduced, and hence the maximum quantum under section 376 of IPC and section 4 of the Pocso Act was seven years, so the convict is being sentenced to seven years along with a fine of Rs 15000," the judgment read. All sentences will run concurrently, and the amount of fine charged is to be handed over to the girl, who is now an adult, for her rehabilitation. The court also clarified that the period of time already spent in jail in connection with the ongoing case would be adjusted in the total quantum of the sentence.
