Pune Porsche Crash: Police To Challenge Juvenile Board's Decision To Try Accused As Minor
The Juvenile Justice Board rejected police's plea to treat the teenager in the Pune Porsche case as an adult for the trial. Police will challenge the decision in a higher court. The Pune city police have decided to challenge the Juvenile Justice Board 's decision, which allowed the 17-year-old boy accused in the Porsche car crash to be tried as a minor for the trial in the case, in a higher court. The accused allegedly drove a Porsche in the Kalyani Nagar area of Pune in an inebriated state in May last year, mowing down two motorcycle-borne IT professionals – Anish Awadhiya and Ashwini Costa. The case sparked nationwide outrage when the boy was granted bail after just writing a 300-word essay on road safety, after which he was sent to an observation home. He was released on the orders of the Bombay High Court on June 25, 2024. Juvenile Board's Decision In Pune Porsche Case Police had filed an application before the Juvenile Justice Board, seeking that the child in conflict with the law be tried as an adult in this case, citing the 'heinous" nature of the crime. The police cited sections of the Juvenile Justice (Care and Protection of Children) Act, 2015, arguing that not only were two persons crushed to death but there were also attempts to tamper with the evidence. However, the Juvenile Board on Tuesday rejected the plea by police to treat the boy as an adult for the trial. Senior Advocate Vikas Pahwa said the intent behind Section 15 of the Juvenile Justice Act is fundamentally rooted in the principle of reformation for children in conflict with the law. Defence counsel Prashant Patil told news agency PTI that he opposed the prosecution's demand to treat the teenager as an adult. 'We had cited a Supreme Court Judgement – Shilpa Mittal Vs State in which the SC has defined what constitutes a heinous crime. The guidelines decided by the Supreme Court are binding on everyone. However, the plea by the prosecution is contrary to the apex court's judgement. We demanded that since the plea is contrary to the SC guidelines, it is not maintainable," he said. Patil argued that there was not a single section in the case that required a minimum punishment of seven years, hence the Board did not determine that the boy should be treated as an adult. The police will now challenge the decision in a higher court. Evidence Tampering Earlier this month, the prosecution told the court that attempts were made to swap blood samples at a second hospital to save the juvenile accused, but they were thwarted. The Pune police, who first got blood samples of the minor collected at the Sassoon Hospital, suspected that there was a possibility of tampering, as per the prosecution. The teenager's blood samples were later collected at the Aundh Government Hospital, but some of the other accused, including his parents, got news of it and approached hospital authorities to swap the samples. However, the doctors refused to cooperate and turned them away. At least 10 people, including the teenager's parents, were arrested in the case. The boy's mother is out on bail, but the remaining nine are currently in jail. In a significant update on the Pune Porsche crash case, the Juvenile Justice Board on Tuesday rejected the Pune City Police's plea to try the 17-year-old accused in the crash case as an adult. The teen, who was driving the car that killed two people on May 19 2024, will now face trial as a minor. The crash case involves the deaths of two IT professionals, Anish Awadhiya and Ashwini Costa, both from Madhya Pradesh, who were killed on May 19 2024 when the minor's Porsche collided with their motorcycle in Pune. The juvenile driver was apprehended but later given bail by the Juvenile Justice Board. The minor driver was allegedly served alcohol at a restaurant and bar despite being underage. The incident sparked widespread outrage and controversy over the leniency shown to the accused and the influence of political connections. Also, the parents of the juvenile driver allegedly bribed the doctors to swap his blood samples with those of his mother and similarly, Singh had been accused of replacing the blood samples of his son in connivance with the doctors at the government-run hospital. Earlier, on April 22, the Supreme Court granted interim bail to the mother of the teenage main accused in the Pune Porsche case after she was arrested for allegedly tampering with evidence by swapping her son's blood sample in an attempt to shield him from legal consequences. A case was registered by the Pune crime branch unit after the accident against the parents of the accused minor and doctors of Sassoon Hospital, including two others. They were booked for allegedly conspiring to tamper with evidence and manipulating the blood sample. (With ANI inputs)

New Delhi: The main accused in the Pune Porsche crash case - in which an allegedly drunk teenager rammed his father's Rs 2.5 crore electric supercar into a two-wheeler and killed two software professionals - cannot be tried as an adult now, despite having crossed that threshold, the Juvenile Justice Board has said. The main accused - out 'celebrating' exam results by heavy underage drinking, and running up a bill of Rs 48,000 in just 90 minutes - was 17 years old at the time of the tragic incident; he was four months short of the legal age for driving and eight years shy of Maharashtra's legal drinking age, which is 25. The crash, and the death of Aneesh Awadhiya and Ashwini Koshta, both from Madhya Pradesh and both just 24, led to outrage, particularly since the accused is the son of a prominent Pune businessman and the local police were accused of deliberately mishandling critical evidence to ensure his release. This included feeding him burgers immediately after the crash to hide or dilute the alcohol in his bloodstream. Local police reportedly also did not alert their superiors, as required to by law. There were also questions asked of the medical professionals involved, including doctors tasked with extracting and securing samples from the accused to test for blood alcohol levels. It soon transpired the blood samples had been replaced with those of his mother - who was arrested and then released in April - in a crude attempt to conceal the fact he was driving while drunk. And finally the Juvenile Justice Board itself faced scrutiny after allowing the boy bail 15 hours after the crash. The conditions imposed - one was to write a 300-word essay - were slammed as 'ridiculous'. However, this order was countered by the Bombay High Court. Last year Pune Police had sought permission to try the main accused - the others included members of his family for trying to destroy evidence - as an adult, citing his "heinous" act. In May, exactly a year after the crash, and with no sign of justice for his son Anish, Om Awadhiya said, "Our son is no longer with us; nothing can compensate for that loss, but justice would send a strong message against drunk driving and those who believe money and power put them above the law." "This entire year has been painful for me, my wife, and our whole family. Not a single day goes by without us remembering him and cherishing his beautiful memories. After Anish's tragic death, our world has come crashing down," Mr Awadhiya, who lives in Madhya Pradesh, said. At present the boy's father, doctors Ajay Taware and Shrihari Halnor, hospital employee Atul Ghatkamble, and two middlemen are in jail in connection with this case. The boy remains with his family.

Pune Porsche Crash: Attempt Made To Tamper With Minor's 2nd Blood Sample, Says Prosecution
Last Updated: In the 2024 Pune Porsche crash case, the prosecution revealed the minor accused's second blood sample was attempted to tamper with at the hospital, allegedly by his parents In a startling revelation that has emerged in the 2024 Pune Porsche crash case, the prosecution has told the court that an attempt was made to tamper with the minor accused's second blood sample that was supposed to collected 'secretly" at Aundh District Hospital, allegedly at the behest of his parents and a middleman. The prosecution submitted this information under CrPC Section 173(8), which allows for further investigation after a chargesheet is filed. According to a reported by The Indian Express, quoting a Crime Branch officer, 'Under the Criminal Procedure Code section 173(8), which allows further investigation in the case after chargesheet has been filed, we have submitted to the court some important findings in the form of an investigation note and supporting documents and records. These findings and supporting records show that the father and mother of the minor driver and middleman Ashpak Makandar had gone to the district hospital in Aundh when the minor was taken there to collect a second blood sample in the evening on May 19, 2024, by the police team." The second sample was meant to be collected secretly following suspicions of tampering with the first sample taken at Sassoon General Hospital earlier that morning, hours after the fatal crash that killed two IT professionals, Aneesh Awadhiya and Ashwini Koshta, at Kalyani Nagar junction on May 19, 2024. At the Aundh district hospital, these family of the accused made an attempt to tamper with the 17-year-old accused's blood sample, said the officer, however, the doctors at the hospital refused to do so. 'At the district hospital in Aundh, these accused again made an attempt to tamper with the blood sample. While the sample was supposed to be taken secretly, family members still learned about it, as some of them were at the Yerawada police station in the aftermath of the accident. As the parents and middleman made attempts to tamper with the blood sample, the doctors at the Aundh hospital refused to do so," The Indian Express quoted the officer as saying. This alleged failed tampering attempt came just hours after the prosecution claims that the first blood sample at Sassoon General Hospital was swapped with that of the boy's mother. DNA reports later confirmed that the swab from Sassoon did not belong to the minor's father, and was in fact matched to the mother. The second blood sample, taken at 6 pm at Aundh hospital, was sent for forensic analysis along with the Sassoon sample and a DNA sample from the minor's father, collected after his arrest on May 21. The Indian Express earlier reported that these results confirmed a major criminal conspiracy, with evidence pointing to involvement from top medical staff, the minor's parents, and several middlemen. On June 27, Special Public Prosecutor Shishir Hiray formally opened the prosecution case under CrPC Section 226, detailing the charges against the 10 accused. He submitted to the court what the prosecution believes is sufficient evidence to frame charges, including criminal conspiracy and destruction of evidence. Among those arraigned are Dr Ajay Taware, then head of forensic medicine at Sassoon; Dr Shrihari Halnor, then the casualty medical officer; hospital mortuary staffer Atul Ghatkamble; and middlemen Ashpak Makandar and Amar Gaikwad, who allegedly facilitated the tampering. The minor's 51-year-old father and 50-year-old mother have also been booked for criminal conspiracy and influencing the forensic process. Additionally, a 37-year-old man and two other parents were arrested for allegedly providing their own blood to substitute samples of the minor's co-passengers, in a wider web of attempted evidence manipulation. The crash occurred after the minor, who had just passed his Class 12 exams, celebrated the results with friends at a pub in Pune last year. Allegedly intoxicated, he was driving a Porsche Taycan with no number plates when it crashed into the victims' motorcycle. Pune Porsche Case Accused Doctor Now Arrested In Kidney Transplant Racket

Pune Police on Thursday arrested Sassoon General Hospital's former medical superintendent, Dr Ajay Taware in connection with an alleged kidney transplant racket at a leading private hospital. Taware, who is currently lodged at the Yerwada Central Jail, was arrested last year for allegedly tampering with the blood samples of a 17-year-old boy accused of crashing a Porsche car into a motorbike in Pune's Kalyani Nagar and killing two persons. He has now been taken into custody by the city crime branch with the 2022 kidney transplant racket at the Ruby Hall Clinic, a leading private hospital here, reported news agency PTI. Deputy Commissioner of Police (Crime) Nikhil Pingale informed the doctor will be produced before the court today. In 2022, Taware was head of the Regional Authorisation Committee that approved kidney transplants. Jailed Doctor Arrested In Kidney Transplant Racket In May 2022, the Pune Police registered a case against 15 persons, including the managing trustee of the Ruby Hall Clinic and some of its employees, in connection with an alleged malpractice during a kidney transplant procedure in March that year. According to PTI, a woman from Kolhapur, who was allegedly promised Rs 15 lakh, fraudulently posed as the wife of a man who needed a transplant and donated her kidney in 2022 to a young woman patient. In turn, the young woman's mother donated her kidney to the man. Notably, such a swap involving two patients and their relatives is carried out when the patients cannot receive a kidney from their own kin because of a blood group mismatch. On March 29, 2022, four days after undergoing the transplant surgery at the Ruby Hall Clinic, the woman revealed her real identity after she had a dispute over money.
