[UPDATED] High Court dismisses Najib's ex-lawyers' suit against Malaysian Bar

KUALA LUMPUR: The Malaysian Bar's statement criticising Datuk Seri Najib Razak's former legal team over their handling of his final SRC International appeal at the Federal Court did not amount to defamation, the High Court heard. Judge Roz Mawar Rozain made the ruling before dismissing a defamation suit filed by senior lawyer Datuk Mohd Zaid Ibrahim and two others against the Bar and its former president, Karen Cheah Yee Lynn. Zaid, along with Liew Teck Huat and Reuben Mathiavaranam, had represented the former prime minister in his final appeal at the Federal Court in August 2022, replacing Tan Sri Muhammad Shafee Abdullah. The trio filed the suit over Cheah's media statement titled "Abuse of Process Brings Disrepute to Our Justice System", issued on Aug 9 that year, claiming it had tarnished their reputations. In her ruling, Roz Mawar said the plaintiffs failed to establish that the words, in their natural and ordinary meaning, were defamatory in law. She said the reputational impact of the plaintiffs' conduct had already crystallised prior to the publication, due to their public statements and the unfolding events at the Federal Court. "The plaintiffs themselves had, prior to the publication, made multiple public disclosures including press interviews, social media postings, and commentaries admitting their lack of readiness, criticising prior counsel, and seeking adjournments which were ultimately refused by the apex court. "Their reputational position had already been shaped by facts in the public domain. "The impugned statements in the press release did not further lower or injure their standing in the eyes of reasonable members of society," she said. Roz Mawar said the plaintiffs' claim of conspiracy to injure also failed, as there was no evidence of any agreement or concerted effort by the defendants to cause harm. "No evidence was adduced to establish a concerted agreement between the defendants. "If the complaint is based on a publication said to be defamatory, a separate claim of conspiracy cannot stand on its own," she said," she said, adding that the plaintiffs' claim for breach of statutory duty also had no merit. The court said Cheah, who was then the Bar president, had acted within her statutory remit under Section 42(1)(d) of the Legal Profession Act in making public comments on matters of concern to the legal profession. "There is no actionable breach, and no specific compensable loss was proven to have flowed from the alleged breach," she added. Najib, on July 25, 2022, appointed Zaid's law firm to replace Shafee & Co in the final appeal of the SRC International case at the Federal Court, with Datuk Hisyam Teh Poh Teik as lead counsel in place of Shafee. However, the apex court on Aug 23 upheld the conviction and sentence of 12 years' imprisonment and a RM210 million fine imposed on Najib, who was found guilty of embezzling RM42 million in funds belonging to SRC International Sdn Bhd. Najib's sentence was later reduced to six years, and the fine lowered to RM50 million, following his petition for a royal pardon on Sept 2, 2022.

KUALA LUMPUR: The Package 3 of Langat 2 Water Treatment Plant (LRA) made history after earning recognition from the Malaysia Book of Records (MBOR) for three national achievements, showcasing the country's engineering innovation and commitment to environmental sustainability. The three records set were Malaysia's first pipe conveyor-type water treatment waste transport system, the longest pipe conveyor system for water treatment waste at 1.918 kilometres and the longest shaftless screw conveyor system at 46 metres. Pengurusan Aset Air Berhad (PAAB) chief executive officer Zulkiflee Omar described the three projects worth RM210 million as a transformative step for Malaysia's water sector. 'This was not just an ordinary infrastructure project, it represented significant engineering innovation focused on sustainable environmental governance,' he said at the handing over of the certificates of recognition from MBOR here today. The LRA Langat 2 is capable of treating up to 1,130 million litres of water per day (MLD) and generating up to 400 tonnes of treatment waste daily, depending on the quality of raw water channelled from Sungai Semantan in Pahang through a 45-kilometre tunnel across the Titiwangsa Range to Hulu Langat. According to Zulkiflee that conventional waste management had required up to 96 lorry trips daily, creating road safety hazards, significant carbon emissions and community disruption. However, the new pipe conveyor system automatically transferred waste almost two kilometres to a dedicated landfill site near the Bunting Balance Pond, completely removing heavy vehicles from public roads. 'This system not only saves fuel and reduces carbon emissions, but also supports the country's commitment to sustainable climate change,' he said. He noted that the system can transport 120 tonnes of waste hourly during its eight-hour daily operation, preventing more than 35,000 lorry trips annually, thereby enhancing safety, boosting operational efficiency, and strengthening environmental protection. Zulkiflee also extended his gratitude to all stakeholders involved in the project's success, particularly recognising main contractor Salcon Engineering Berhad, financial consultants, government partners, and MBOR for the prestigious acknowledgement. 'This project proves that public facilities are also capable of producing innovative, responsible and world-class approaches,' he said.

KUALA LUMPUR: Datuk Seri Najib Razak's move to initiate contempt proceedings against former Attorney-General Tan Sri Ahmad Terrirudin Mohd Salleh has been described as premature and in direct violation of a standing court order. The Attorney-General's Chambers (A-GC) said the issue raised in Najib's application is the subject of an ongoing appeal over the royal addendum, which has yet to be decided by the Federal Court. "The High Court on April 28 granted a stay of all proceedings pending the disposal of the said appeal at the Apex Court. "This stay encompasses all existing and future proceedings relating to the matter, including contempt of court actions," it said in a statement today. The A-GC warned that any attempt to commence or continue contempt proceedings while the stay remains in force amounts to a breach of the court's directive and undermines the orderly administration of justice. "Such actions are in direct contravention of the court's order and may be construed as an abuse of process. "The A-GC will not hesitate to seek the dismissal of the application on these grounds," the statement said. The statement was issued in response to an earlier report that Najib had, on May 21, filed contempt proceedings against Terrirudin over an addendum order issued by the former Yang di-Pertuan Agong, which purportedly allowed him to serve the remainder of his sentence under house arrest. The legal firm Messrs. Shafee & Co., which represented the former Pekan member of Parliament, said the application was based on clear evidence that Terrirudin had knowledge of the addendum order but chose to mislead the court. The statement said that despite being aware of the addendum order, the former A-G had allegedly instructed his officers to mislead the High Court by dismissing Najib's claims as speculative, a fishing expedition, and based on hearsay. It added that by choosing to mislead the court, the former A-G had brought the administration of justice into disrepute and should face serious consequences. It added that both Malaysian and international legal principles, including recent Federal Court decisions, clearly require the government to present all relevant facts and documents in any judicial review. Najib is serving a six-year sentence after being convicted of misappropriating RM42 million from SRC International Sdn Bhd. The High Court had initially sentenced him to 12 years in prison with a fine of RM210 million. This verdict was upheld by both the Court of Appeal and the Federal Court. However, his sentence was reduced to six years, and his fine was lowered to RM50 million following his petition for a royal pardon on Sept 2, 2022.

KUALA LUMPUR: Datuk Seri Najib Razak has initiated contempt proceedings against former Attorney-General(A-G) Tan Sri Ahmad Terrirudin Mohd Salleh. The legal firm Messrs. Shafee & Co., which represented the former prime minister, said that the contempt action relates to the addendum order issued by the former Yang di-Pertuan Agong, which allowed Najib to serve the remainder of his sentence under house arrest. The statement said that the application for leave to initiate contempt proceedings was filed against Terrirudin, who is now a Federal Court judge, on May 21. It added that the application was based on clear evidence that Terrirudin had knowledge of the alleged addendum order but chose to mislead the court. The statement further revealed that the addendum order dated Jan 29, 2024, was handed to Najib through his son, Datuk Mohamad Nizar, and that the Pahang Royal Council had officially confirmed its authenticity via a letter dated Jan 4 this year. "The contents of the documents not only confirm the existence of the addendum order and its Royal decree of house imprisonment, but further disclosed that it was personally addressed to Terrirudin for him to execute the order. "Despite knowing about the addendum order, it is our client's assertion that the former A-G instructed his officers to mislead the High Court by portraying Najib's claims as speculative, a fishing expedition and based on hearsay, even though he knew those claims were true. "Our client believes that by electing to mislead the High Court, the former A-G has brought the administration of justice into disrepute, warranting serious sanction by the Courts. "Given that the former A-G now serves as a Judge of the Federal Court, it is essential that he be accorded an opportunity to answer these serious allegations and, if appropriate, purge the contempt," said the statement. The statement said that as a public officer, Terrirudin had a duty to be fully honest with the Court. It added that both Malaysian and international legal principles, including recent Federal Court decisions, clearly require the government to present all relevant facts and documents in any judicial review. "A deliberate failure to do so undermines public confidence in the administration of justice, and indeed an obstruction of justice itself," it added. Najib is serving a six-year sentence after being convicted of misappropriating RM42 million from SRC International Sdn Bhd. The High Court had initially sentenced him to 12 years in prison with a fine of RM210 million. This verdict was upheld by both the Court of Appeal and the Federal Court.
