Seed sellers call off strike after assurance from BJP state prez

Jaipur: Seed suppliers in the state ended their indefinite strike Friday, following assurances from agriculture minister Kirori Lal Meena and BJP state president Madan Rathore. The strike, which began Thursday, involved more than 15,000 seed suppliers. Rathore facilitated discussions between the seed suppliers and the agriculture minister, leading to the suspension of the strike. The suppliers are optimistic about meeting with the agriculture minister within the next day or two to discuss their issues. On Thursday, the Rajasthan Agricultural Input Dealers Association in Jaipur had started an indefinite strike from Friday against the unfair action taken by the agriculture department. "We had a meeting with Rathore, who gave heed to all our problems. He assured us that in some days we would be able to meet Meena. Thus, we have decided to call off the strike," said Purushottam Khandelwal, president of the Rajasthan Agricultural Input Dealers Association. Khandelwal said the association has made a list of their demands, problems and will share those with Meena. "We were assured by Rathore that no injustice would be done to the seed manufacturers and promised our meeting with Meena and senior officials of the department to get a solution to all our problems." ‘Assault on justice itself': Delhi HC refuses to reduce sentence of advocate who outraged modesty of woman judicial officer

The Delhi High Court on Monday refused to reduce the sentence of an advocate convicted of outraging the modesty of a woman judicial officer in 2015, saying that acts threatening or intimidating a judge, especially through 'gender-specific abuse, is an assault on justice itself, and must be met with firm accountability'. The court, however, modified the sentence to the extent that it will now run concurrently, not consecutively. Advocate Sanjay Rathore, who was sentenced to two years' imprisonment by a trial court, had moved the Delhi High Court, seeking a reduction in his punishment. Deciding his plea, Justice Swarana Kanta Sharma ruled that the court 'finds no ground to take any lenient view, and reduce the sentence awarded to the petitioner to the period already undergone by him'. In October 2015, a judicial officer was serving as a metropolitan magistrate in Karkardooma court when Rathore, enraged by an adjournment in his matter in his absence, had verbally abused her, including using gendered abusive language. An FIR was subsequently lodged at Farsh Bazar police station. Rathore was sentenced to 18 months' imprisonment for the offence under Section 509 (intending to outrage modesty of a woman) of the Indian Penal Code, three months under Section 189 (injury to public servant), and an additional three months under Section 353 (assault or criminal force against public servant to deter them from their duty). It was directed that the sentences would run consecutively, thereby resulting in a total sentence of two years. Justice Sharma modified the sentence, in effect sentencing Rathore to one year and six months' imprisonment. Rathore has already undergone five months of imprisonment. Justice Sharma, while deciding the plea, recorded, 'The act of outraging the modesty of a judicial officer while she was presiding over court proceedings, seated on the dais and discharging her solemn duty of dispensing justice, in this court's opinion, attacks the very foundation of judicial decorum and the institutional integrity…'. 'The petitioner herein was not mere litigant or a bystander in the courtroom, but he was an officer of the court, and thus under a heightened obligation to uphold the dignity of the forum and its presiding officer…This is, therefore, not merely a case of individual misbehaviour, but a case where injustice was done to justice itself – where a judge, who symbolises the impartial voice of the law, became the target of personal attack while discharging her official duties…,' the court added. 'Any act that seeks to threaten or intimidate a judge, especially through gender-specific abuse, is an assault on justice itself, and must be met with firm accountability…To trivialise such conduct under the garb of emotional outburst or momentary lapse is to reflect a patriarchal mindset – one that struggles to respect women in authority and seeks to normalise the unacceptable. This cannot be permitted. Not in law. Not in court…,' Justice Sharma further said. 'No judicial officer, particularly those at the district level who form the backbone of our justice delivery system, should ever be made to feel exposed or unsupported. The female force within the judiciary must never be left feeling helpless or as though they are to be treated at someone else's pleasure…If a woman holding judicial office is made to feel that her authority is conditional on the civility or restraint of others, the very foundation of judicial independence would get shaken,' the court added. Justice Sharma further recorded that the incident 'reflects a mindset where even women in empowered roles are not seen as immune from humiliation or indignity'. 'It is important that such incidents are not dismissed as isolated or trivial. They must be treated with the seriousness they deserve, for they influence how the judiciary is perceived, and more importantly, how women perceive their place in it,' Justice Sharma said.

Delhi HC refuses leniency in sentence for advocate who abused female judge in courtroom

The Delhi High Court on Monday refused to take a lenient view against a lawyer who used abusive language towards a sitting female judge in her courtroom, emphasising it 'would amount to doing injustice to justice'. The case dates back to October 30, 2015, when advocate Sanjay Rathore stormed into a courtroom at the Karkardooma Courts Complex and verbally abused the Metropolitan Magistrate after being informed that his client's vehicle challan matter had been adjourned to the next day. When the judge reiterated that the matter had already been adjourned, Mr. Rathore allegedly charged towards the dais anduttered extremely offensive and vulgar remarks towards the judge. Deeply shaken by the incident, the judge had submitted a formal complaint with the police. She alleged that the advocate 'had insulted her and had outraged her modesty being a female judicial officer, and had also insulted the court's dignity.' Subsequently, the trial court convicted Mr. Rathore and he was sentenced to 18 months of simple imprisonment under Section 509 of the IPC (insulting the modesty of a woman), and three months each under Sections 189 (threatening a public servant) and 353 (assault or criminal force to deter a public servant from duty). The trial court directed that these sentences run consecutively, resulting in a total sentence of two years of simple imprisonment. 'Reflects systemic vulnerability of women' During the hearing, the petitioner's counsel restricted his submissions solely to the quantum of sentence, choosing not to contest the conviction itself. He urged the court to take a lenient view, arguing that the petitioner had already spent 5 months and seventeen days in judicial custody, and should be released on the basis of time already undergone. Justice Swarana Kanta Sharma, in the 18-page verdict, said, 'Any act that seeks to threaten or intimidate a judge, especially through gender-specific abuse, is an assault on justice itself, and must be met with firm accountability'. Justice Sharma said that this was 'not merely a case of individual misbehaviour, but a case where injustice was done to justice itself – where a judge, who symbolises the impartial voice of the law, became the target of personal attack while discharging her official duties'. 'When a female judge becomes the target of personal indignity and humiliation by an officer of the court – an advocate: as in the present case – it reflects not only a personal wrong but also the systemic vulnerability women continue to face, even at the highest echelons of legal authority,' she added. Justice Sharma found no ground to take a lenient view or to reduce the sentence to the period already undergone by the petitioner. The judge, however, modified the order on sentence to the limited extent that all the sentences awarded to the lawyer will run concurrently – and not consecutively. Consequently, the total sentence to be actually undergone by the lawyer will be confined to 18 months.

JDA demolishes remaining properties to widen Sirsi Rd

1 2 Jaipur: In a surprise drive on Sunday, the enforcement wing of Jaipur Development Authority (JDA) carried out demolition of remaining properties on either sides of the Lt Gen Sagat Singh Marg between Jharkhand Mod crossing and Khatipura Tiraha towards the Sirsi Road. The JDA team spared just three houses, which had obtained stay orders from the Rajasthan High Court, and a decade-old Hanumanji temple on this Marg. On April 9, JDA first conducted the demolition drive and left around 72 properties after BJP MLA from Civil Lines constituency, Gopal Sharma, intervened, saying that owners had land leases from the erstwhile Jhotwara panchayat. Bhawani Singh Rathore, president of local traders' association, claimed that property owners were not ready for the demolition drive Sunday, especially when their petitions were still pending at JDA tribunal. "The team carried out this 'secret drive' around 4am Sunday. As soon as information reached us, we assembled at the spot and started a protest. We were detained at a police station and released only late afternoon when all properties had been razed," said Rathore. Police confirmed that altogether 30 traders were detained during the demolition drive. However, no cases have been registered against the traders. "We are BJP workers and never imagined that the party govt would take such a drastic step against us. We even tried to get in touch with MLA Gopal Sharma. Although he gave us assurance over the phone, he did not turn up at the spot on Sunday," Rathore added. JDA officials said that the latest drive came following a contempt petition at the High Court. The division bench of Justices Inderjeet Singh and Anand Sharma sought a detailed plan for removing these remaining encroachments by Friday. "On Friday, we submitted the affidavit clarifying our plans. The court ordered us to submit the status of cases pending at JDA tribunal on Monday. Meanwhile, the drive was carried out on Sunday. We are going to report this at the High Court as well," said JDA advocate Amit Kuri.
