Accountant fined RM3,300 for recording male housemate in shower
KUALA LUMPUR: An accountant has been fined RM3,300 by the Ampang Magistrates' Court here after pleading guilty to secretly recording his male housemate who was having a shower. Magistrate Amalina Basirah Md Top imposed the sentence on Muhammad Fahmi Akmal Zakaria, 30, and further ordered that he serve five months' imprisonment in default of payment. The accused settled the fine. Muhammad Fahmi was charged with intending to insult the modesty of a 31-year-old man by recording him while he was showering, with the purpose of violating his privacy and decency. The offence took place at an apartment in Taman Ukay Perdana at 8.10am on June 20. He was charged under Section 509 of the Penal Code, which provides for a maximum sentence of five years' imprisonment, a fine, or both. According to the statement of facts, the victim noticed a flashing light on a bathroom shelf and found a concealed recording device. The victim found that hidden recording device, which contained a memory card with a video of him showering. The accused was arrested on June 20 and his recording device, mobile phone and laptop were seized. Investigations confirmed that he had recorded the victim showering. Earlier, counsel Mohd Azizi Darus from the National Legal Aid Foundation appealed for a minimal fine, submitting that the accused earns only RM2,500 per month and is financially responsible for his family. He further submitted that his client claimed the act was intended as a joke. However, Deputy Public Prosecutor Norhidayah Abdullah Sani urged the court to impose a deterrent sentence. "Public interest must take precedence. This was not a joke. Had the video been disseminated, it would have severely humiliated the victim," she said. – Bernama

Student charged with outraging modesty at MRT station claims trial
KUALA LUMPUR: A private university student claimed trial at the magistrates' court today to a charge of outraging the modesty of a woman at an MRT station in Cheras last Sunday. Muhammad Hafiz Damian Abdul Qawwiy, 19, entered his plea after the charge was read out before Magistrate Atiqah Mohamed @ Mohamad Saim. "I understand the charge. I plead not guilty," he told the court. He is accused of committing the act by making gestures to look at the private parts of a 28-year-old woman at 8.53pm at the Taman Pertama MRT station on June 22. The charge, framed under Section 509 of the Penal Code for intending to insult the modesty of a woman, carries a maximum five-year jail term, a fine, or both upon conviction. Deputy public prosecutor Nurainizatul Farhana Zainal did not offer bail as the offence is non-bailable. In mitigation, National Legal Aid Foundation lawyer Mohammad Sufi Mohammad Sukor appealed for bail, noting that Hafiz is a young offender. "I ask that he be granted bail as he is about to sit for an examination. "This is his first offence, and he has cooperated with police. There is no risk of him absconding. "His foster father is present in court to post bail, but only has less than RM1,000," he said. This prompted Atiqah to ask the foster father, seated in the public gallery, how much he had. The foster father replied that he had RM1,000. Atiqah also asked Hafiz about his examination, to which he said his final paper was on Thursday. The court allowed bail at RM1,000 with one surety and ordered Hafiz to report to the police station monthly until the case is disposed of. Mention has been fixed for Aug 18 for the appointment of counsel.

Policeman under probe for inappropriate gesture, language towards woman in viral clip
KUALA LUMPUR: A policeman is under investigation following the circulation of a viral video on social media showing an interaction with a woman that allegedly contains inappropriate language or gestures deemed insulting. Ampang Jaya district police chief Assistant Commissioner Mohd Azam Ismail said the incident came to light when the Pandan Indah police station chief came across the 90-second clip on Instagram around 5pm yesterday. He said the video was initially uploaded on TikTok by a user before going viral on Instagram. "The video is believed to show an interaction between the policeman and a woman, during which inappropriate language or gestures allegedly insulting the woman were used," he said. As such, Azam urged those involved in the video to come forward to assist with the investigation. This, he said as the case is being investigated under Section 509 of the Penal Code for words or gestures intended to insult a person's modesty, and Section 233 of the Communications and Multimedia Act 1998 for improper use of network facilities or services. "If convicted, Section 509 carries a punishment of up to five years' imprisonment, a fine, or both while Section 233 provides for a fine not exceeding RM50,000, imprisonment of up to one year, or both," he said in a statement. Azam also said that the policeman involved has been identified and removed from active duty pending further investigation. "An internal disciplinary investigation is also being carried out, together with the probe" he said. Video of cop allegedly harassing female motorcyclist being probed
KUALA LUMPUR: A video of a policeman asking inappropriate questions of a female motorcyclist is being investigated. Ampang Jaya OCPD Asst Comm Mohd Azam Ismail said when contacted on Sunday (June 15) that police were aware of the 1min, 30sec clip of the encounter on social media. "As such, we are urging the woman in question to come forward to assist investigations," he said. The case is being investigated under Section 509 of the Penal Code for insulting modesty and under Section 233 of the Communications and Multimedia Act 1998 for inappropriate use of network services. The video shows the woman being questioned during a police stop. The uniformed policeman allegedly asks the woman where she lives and if she wants to go to a hotel with him. Singaporean to be charged today over viral Johor road rage incident
JOHOR BARU: A Singaporean man arrested over a road rage incident last Saturday, which was caught in a clip that went viral on social media, will be charged in the magistrate's court here today. The 40-year-old is expected to face charges under Section 426 of the Penal Code for mischief, which carries a penalty of up to three months' imprisonment, a fine, or both; and Section 509 for using words or gestures intended to insult another's modesty, an offence punishable by up to five years' jail, a fine, or both. Johor Baru (North) police chief Assistant Commissioner Balveer Singh confirmed that the man will be brought to court at 9am. He was arrested at 6.20pm on Sunday, less than 24 hours after the 31-year-old Malaysian BMW driver lodged a police report over the alleged road rage incident, which occurred near Taman Ungku Tun Aminah in Skudai at 2.39pm on June 7. The altercation reportedly began when the suspect, who was driving a Singapore-registered Toyota Altis, allegedly honked repeatedly and tailgated the BMW, seemingly upset about being obstructed. The confrontation escalated when the suspect allegedly exited his vehicle, kicked the BMW and verbally insulted the driver.
