Use of filthy language against woman: HC quashes case against vehicle inspector
Kochi: High court has quashed the criminal case and further court proceedings against a motor vehicle inspector (MVI) in Thiruvananthapuram, accused of uttering outrageous words to a woman during a driving test for not cutting her nails. Justice G Gireesh passed the order on a petition by the MVI seeking to quash the case registered against him by the Nedumangad police under Sections 294(b) (uttering obscene words in a public place) and 509 (words, gestures, or acts intended to insult the modesty of a woman) of the IPC, as well as the further court proceedings. The prosecution case was that, in 2022, during a driving test, the petitioner allegedly asked the complainant whether he should trim her nails and whether she should be taken for a bath before starting the test. He further remarked that certain offspring of immoral women would come for a driving test without brushing their teeth, taking a bath, or trimming their nails. He then allegedly called her the daughter of an immoral woman and asked her to get out of the vehicle. Following her complaint, police registered a case and submitted the final report before the magistrate court, Nedumangad. Private Jet I Search Ads Learn More Undo Upon perusal of facts, HC noted that as the incident occurred inside a car, which is a private place, Section 294(b) would not be attracted, as the words were not uttered in a public place. Similarly, it could not be said that the alleged words of the petitioner were intended to shock the sense of decency of the complainant as a woman, nor could it be said that his alleged acts had any sexual connotation. At most, HC observed, it could be said that the petitioner had used filthy language, enraged by her appearance for the test. The bench also cited a Supreme Court decision holding that the mere use of filthy language, without any contextual framework or accompanying words indicating an intent to insult the modesty of the victim, would not constitute an offence under Section 509. KUCHING (Aug 6): The Magistrates' Court here today imprisoned an e-hailing driver for one day and fined him RM5,000 in default three weeks' jail for asking a teenage passenger to remove her headscarf. Magistrate Ling Hui Chuan convicted Wan Allam Halim Shah, 62, on his own guilty plea to a charge under Section 509 of the Penal Code, which provides for up to five years in jail, or a fine, or both, upon conviction. Wan Allam paid the fine. According to the charge, he intended to insult the modesty of a 16-year-old girl at around 11pm at Jalan Camar on April 26. Based on the facts of the case, the retiree, who worked as an e-hailing driver, drove the victim from an eatery at Jalan Matang to Kampung Rampangi. It is understood the victim was heading home after completing her part-time job at the eatery. During the journey, Wan Allam repeatedly asked the girl to remove her headscarf, saying he wanted to see her face because he did not believe she was only 16. The victim did not comply with his request and felt his actions humiliated her as a Muslim woman. She managed to record a video of his requests. A police report was lodged leading to Wan Allam's arrest. Deputy public prosecutor Adriana Maisarah Mohd Farid appeared for the prosecution while Wan Allam did not have legal representation.

Penang police resubmit doctor's indecent acts case to DPP
KEPALA BATAS: Penang police have resubmitted the investigation paper to the Deputy Public Prosecutor's (DPP) office regarding a male doctor accused of multiple indecent acts, including molesting a female patient. Acting Penang police chief Datuk Mohd Alwi Zainal Abidin confirmed the submission, which includes a forensic chemical analysis report. The latest investigation covers three cases in the Timur Laut district, where the doctor allegedly behaved inappropriately toward female patients. Authorities are awaiting further instructions from the DPP. Another case in the Barat Daya district is also under investigation and will soon be referred to Bukit Aman's CID before submission to the DPP. The 43-year-old doctor is being probed for incidents between February and March this year in Timur Laut, while a fourth case involving molestation was reported on July 21 in Barat Daya. The Timur Laut cases are being investigated under Section 509 of the Penal Code and Section 14 of the Minor Offences Act 1955, while the Barat Daya case falls under Section 354 of the Penal Code. In a separate case, police are still awaiting DPP instructions regarding a 'Datuk Seri' accused of injuring a female sales assistant with a pistol-like object in George Town on June 1. Police resubmit investigation paper to DPP on doctor's alleged indecent acts
KEPALA BATAS: Penang police have resubmitted the investigation paper involving a male doctor who has been arrested four times over alleged indecent acts, including molesting a female patient. Acting state police chief Datuk Mohd Alwi Zainal Abidin said that the investigation paper submitted to the Deputy Public Prosecutor's (DPP) office includes the Forensic Department's chemical analysis report as required by the DPP. "The latest investigation paper involves three cases reported in Timur Laut, where the doctor allegedly behaved indecently towards female patients. We are currently awaiting further instructions from the DPP," he told reporters after the disposal of drug case items here on Monday (Aug 4). In another case involving the same suspect reported in Barat Daya, Mohd Alwi said the investigation has been completed and would be referred to the Bukit Aman Criminal Investigation Department (CID) Legal Division before being submitted to the DPP. Mohd Alwi said that the 43-year-old doctor is being investigated for three incidents in Timur Laut, which allegedly occurred between February and March this year, while the fourth case, involving an allegation of molestation, was reported on July 21 in Barat Daya. For the three cases in Timur Laut, police have opened investigation papers under Section 509 of the Penal Code, and Section 14 of the Minor Offences Act 1955. The case reported in Barat Daya is being investigated under Section 354 of the Penal Code. In a separate development, Mohd Alwi said that police are awaiting further instructions from the DPP's office regarding the case of a man with the title 'Datuk Seri' suspected of injuring a female sales assistant with an object resembling a pistol grip, in an incident on Jalan Kelawai, George Town, on June 1. He said that the investigation into the case has been completed, and the investigation paper was submitted to the DPP office about a month ago, for further action. A 41-year-old local man was arrested at 9.30 am on June 3, after surrendering himself at the Timur Laut police headquarters, following a police report lodged by the 28-year-old female victim. The incident, which occurred at around 2.20am, is believed to be due to a road dispute. - Bernama
