The Bushiris filed their application before the High Court of Malawi in Lilongwe on Wednesday. They claim they weren't given a chance to be heard, violating natural justice principles. The couple fled to Malawi in November 2020, after being granted bail of R200 000 each under strict conditions in the Pretoria Central Magistrate's Court. 'There have been clear and evident attempts to have myself, my wife and my family killed. Despite our several attempts to report to authorities, there has never been state protection,' he said. 'We have come to a painful conclusion that what my wife and I have faced in the Republic of South Africa since 2015 is purely persecution, not prosecution. 'What is shocking is that it was me who, in 2018, opened cases of extortion and intimidation against the officers who are, today, investigating, arresting and prosecuting me and my wife of these several allegations. Obviously, there can never be independence and impartiality. It's purely acts of open vengeance,' Bushiri said. JOHANNESBURG - Self-proclaimed prophet, Shepherd Bushiri, and his wife, Mary, have filed a review application before the high court of Malawi of the judgment that ordered their extradition to South Africa. In March this year, the chief resident magistrate in Lilongwe ordered that the couple be extradited following a request by South Africa. They were arrested on a string of charges against them, including fraud and money laundering. The controversial pair fled to their home country in 2020 after failing to comply with their bail conditions, leading to South Africa's extradition request. In papers before the high court in Malawi, the controversial couple argued that the chief magistrate erred in law by breaching the fundamental principles of natural justice. They argued that the chief magistrate delivered her final ruling on South Africa's extradition request without affording them an opportunity to defend themselves. This, they argued, was contrary to Malawi's constitution, the Criminal Procedure and Evidence Code and the Extradition Act. A top official in one of South Africa's biggest political parties has been sacked after he visited a controversial Malawian pastor in April. Floyd Shivambu has been removed as secretary-general of the uMkhonto weSizwe (MK) party barely six months into the job after he attended an Easter service at self-proclaimed pastor Shepherd Bushiri's church. Mr Bushiri, from Malawi, was one of southern Africa's best known preachers when he was arrested and charged with fraud in South Africa in 2020. After being released on bail, he managed to flee to his home country in unclear circumstances. South Africa has been trying to extradite him ever since. Mr Bushiri denies any wrongdoing. The MK party, which was founded by former President Jacob Zuma, said in a press conference on Wednesday that Mr Shivambu's removal came after his actions "were found to be against the spirit and prescripts of the MK party's constitution". "The president and national officials were left with no other option but to act swiftly," said MK official Nathi Nhleko. He added that the trip "was not an officially sanctioned programme of the organisation". However, Mr Shivambu remains a member of the party and will instead represent MK in the National Assembly.
