LA County Deputy Trevor Kirk sentenced to 4 months in prison for excessive force

Los Angeles County Sheriff's Deputy Trevor Kirk was sentenced to four months in prison Monday for an excessive force conviction involving an unarmed woman outside a Lancaster supermarket in 2023. In February, a federal jury found Kirk, 32, guilty of deprivation of rights under color of law for assaulting and pepper-spraying the woman. He had faced a maximum sentence of 10 years in federal prison. Last week, U.S. District Judge Stephen V. Wilson dismissed the felony allegation in the indictment, leaving only a misdemeanor charge. Kirk had been offered a misdemeanor plea deal before trial, that he didn't accept. "The Government isn't moving to dismiss the entire indictment—only the part that made the offense a felony. The jury still found that Defendant willfully used unreasonable force, which supports a misdemeanor conviction …," as written in Judge Wilson's seven-page order. Kirk's attorney, Tom Yu, has described his client as a "hero, not a criminal." Kirk and another deputy responded to a robbery call at WinCo Foods in Lancaster on June 24, 2023, where two customers were reportedly "assaulting loss-prevention employees." A man who matched the suspect's description was detained, and while the other deputy handcuffed the man, Kirk turned his attention to a woman who matched the other suspect description. The unarmed woman was recording the arrest with her cell phone and told the deputies the video was being live-streamed and that they were legally obligated to tell the man why he was being detained. Kirk walked up to the woman without giving any commands and tried to take her phone. When she started to turn away, he threw her to the ground, threatened to punch her, and pepper-sprayed her face twice. Kirk pressed his knew into the woman's neck, and she said that she couldn't breathe. Prosecutors said while he was on top of the woman he used his LASD radio to give a misleading report that he was in a "fight." The victim suffered blunt-force head trauma and injuries to her head, arms and wrist. Multiple videos showed the assault, with Sheriff Robert Luna describing the incident as "disturbing." In March, the Los Angeles Sheriff's Professional Association said the prosecution of Kirk was "wrongful and politically charged" and his actions, as seen on body-worn camera video, were "lawful, restrained, and aligned with training." "I still believe that my client used reasonable force and look forward to defending him in this criminal case," Yu said earlier. At the time charges were filed last year, the sheriff's department said Kirk was relieved of duty pending the outcome of the case

California shooting leaves 1 officer dead, another wounded

A police officer was killed and another was wounded in a shooting Saturday night in Baldwin Park, California, in Los Angeles County. The shooting happened near 4200 Filhurst Avenue at around 7:15 p.m., Baldwin Park police chief Robert López said at a news briefing. Baldwin Park police officers were called to the area after reports that shots were fired. At some point after the officers arrived at the scene, the suspect opened fire. Two officers were struck by gunshots and transported to Los Angeles County-USC Medical Center. One officer was transported on the ground and the other officer was airlifted to the hospital. The surviving officer was listed in stable condition. Another victim was also found dead at the scene from an apparent gunshot wound, the Los Angeles County Sheriff's Department said. One suspect has been taken into custody in connection with the shooting, according to the sheriff's department. The suspect was also wounded in the incident and transported to a hospital for treatment. Their condition is unknown. The incident remains under investigation.

Man shot in alleged home invasion near Modesto, sheriff's department reports

A man was shot early Saturday morning during an alleged home invasion near Modesto, according to the Stanislaus County Sheriff's Department. The incident was in the 7700 block of Foy Avenue in the Monterey Park Tract community, just south of Modesto and West of Turlock. The victim called 911 around 1 a.m. stating he had been shot in the abdomen after three suspects broke into the home and then fled. When deputies arrived they discovered what the sheriff's department reported as a marijuana grow operation. The sheriff's department reported that the California Highway Patrol began a pursuit of the suspects who were later apprehended and arrested in the Bay Area. The department did not have information Saturday afternoon on how the suspects were identified. The shooting victim, an adult male, was taken to a local hospital where he was in stable condition, according to the department. We will update this story as more information becomes available.

POWAY, Calif. (FOX 5/KUSI) — A motorcyclist is dead after a head-on crash on State Route 67 in Poway Saturday morning. The San Diego County Sheriff's Department reports a 22-year-old man died at State Route 67 and Ellie Lane in the City of Poway after his motorcycle collided head-on with a Ford truck towing a boat around 11:45 a.m. Saturday. Motorcyclist, 20, injured in collision with SUV Poway Fire and paramedics performed life-saving measures, but the motorcyclist died at the scene, according to the sheriff's department. He has not yet been identified pending family notifications. Poway Station traffic investigators are investigating the crash and whether drugs and/or alcohol were a factor.
