Abbas Ansari, the Suheldev Bharatiya Samaj Party (SBSP) MLA from Uttar Pradesh's Mau Sadar assembly constituency who was sentenced to two years' imprisonment in a 2022 hate speech case by a special court on Saturday, has been disqualified from Uttar Pradesh legislative assembly. Abbas is the son of gangster-turned-politician Mukhtar Ansari who died last year. According to a notification issued by the UP legislative assembly on Sunday, Mau Sadar MLA Abbas Ansari is disqualified from May 31, 2025 as per Election Commission of India letter no. 509/Gen/2015/RCC, dated 13.10.2015 and order dated July 10, 2013 passed by the Supreme Court. Principal secretary, Uttar Pradesh legislative assembly, Pradeep Dubey said with the disqualification of Abbas Ansari, the Mau Sadar seat has been declared vacant. The Election Commission of India has been informed about the vacancy and the poll panel will issue a notification for holding the election, he said. The court of chief judicial magistrate (MP-MLA), Mau, Dr KP Singh, on Saturday sentenced Abbas Ansari to two years' imprisonment in a case of violation of election code of conduct and hate speech during the Uttar Pradesh Assembly polls in 2022. The Special MP/MLA court had convicted and sentenced Ansari to imprisonment of two years each under IPC sections 189 and 153-A, one year under section 506 and six months imprisonment under section 171-F. The court ordered that all the sentences will run simultaneously. Abbas's accomplice Mansoor Ansari was sentenced to six months' simple imprisonment under IPC section 120-B in the case and a fine of ₹1000 was imposed on him. Abbas Ansari, who was contesting 2022 assembly election as an SBSP candidate from Mau Sadar seat, had threatened officials of Mau administration during a public meeting at Paharpur ground of the city, saying he will 'settle scores and teach them a lesson' after the elections.

A day after being sentenced to two years in prison for a hate speech, Suheldev Bharatiya Samaj Party (SBSP) MLA, Abbas Ansari, son of dead mafia don Mukhtar Ansari, was disqualified from the Uttar Pradesh Assembly, an official said on Sunday. Assembly Speaker Satish Mahana declared Abbas Ansari's Mau Sadar constituency vacant and sent an intimation to the Election Commission of India to consider conducting a by-election. On Saturday, a Mau court convicted Abbas Ansari in a hate speech case and sentenced him to two years in prison for offences including criminal intimidation, promoting enmity and undue influence in the election. He was granted temporary bail soon after the sentence. The verdict was pronounced by Chief Judicial Magistrate K.P. Singh in the MP-MLA court at the District and Sessions Court, Mau, where Abbas Ansari was produced under tight security. The case pertained to a speech delivered by Abbas during the 2022 Uttar Pradesh Assembly elections. He had allegedly made provocative remarks at a public meeting, warning government officials that he would "settle scores and teach them a lesson" once his party came to power. "I have told the Samajwadi Party chief, Akhilesh Yadav, that after the formation of the government, there will be no transfers or postings for six months. Everyone will remain where they are. First, there will be 'Hisab-Kitab', only then will transfers take place," he had said. The statement was deemed threatening and inflammatory, prompting the Election Commission to impose a ban on his campaigning at the time. His speech went viral on social media. Following this, a case was registered against him at Kotwali Nagar police station in 2022. During the trial, six witnesses deposed before the court. Speaking to reporters, Abbas Ansari's counsel, Daroga Singh, said, "The Chief Judicial Magistrate has sentenced him to two years in the hate speech case. We will challenge this order in the Sessions Court. The impact on his MLA status will depend on the outcome of that appeal. Preparations are underway to move to the higher court." The conviction adds to the legal troubles faced by the Ansari family, which has long been under scrutiny for its criminal-political nexus in eastern Uttar Pradesh.

On Saturday, Abbas was sentenced to two years imprisonment in a 2022 hate speech case by a special MP-MLA court. While threatening the Mau administration during a public meeting at Paharpur ground on March 3, 2022, he had said he will "settle scores and teach them a lesson" after the elections. Defence lawyer Daroga Singh told PTI Abbas was charged under various sections of the Indian Penal Code, including: Section 189 for issuing threats to harm a public servant, 2. Section 153-A for promoting enmity between different groups based on religion, caste, place of birth, residence, or language and disrupting communal harmony, 3. Section 171F for exerting undue influence during elections, and 4. Section 506 for criminal intimidation. Singh stated that after hearing arguments from both sides, Special MP/MLA Court Judge K.P. Singh on Saturday convicted Abbas and sentenced him to two years each under Sections 189 and 153-A, one year under Section 506, and six months under Section 171-F. The sentences will run concurrently. In addition, Abbas was fined ₹ 2,000. Under the Representation of the People Act, a legislator's membership can be terminated if they are sentenced to two years or more by a court. Abbas was elected as an MLA for the first time in 2022, winning the Mau Sadar assembly seat on an SBSP ticket, which was part of the Samajwadi Party-led alliance at the time. Currently, the SBSP is allied with the ruling Bharatiya Janata Party (BJP)-led coalition, and its party president holds a cabinet position in the state government. Prior to Abbas, the Mau Sadar seat was long represented by his father, veteran politician Mukhtar. He was lodged in Banda district jail and passed away from cardiac arrest at a hospital in Uttar Pradesh in March 2024.

Hearing on the matter was completed on May 29. After hearing arguments of counsel for the parties in the case, the court had fixed May 31 as the date for pronouncing the sentence. After the hearing, the court convicted Abbas Ansari in the case. According to the prosecution in the case, a case was registered under sections 153 A (promoting enmity), 189 (threatening to cause harm to a public servant), 171 F (punishment for undue influence in elections or impersonation), 120 B (criminal conspiracy) and Section 506 (punishment for criminal intimidation) against Abbas Ansari and others in Kotwali police station area of Mau based on the complaint of sub inspector Gangaram Bind. In his complaint, Bind alleged that during the assembly elections, Abbas Ansari, who was contesting election as the SBSP candidate from Mau Sadar seat, had threatened officials of Mau administration during a public meeting at Paharpur ground of the city, saying he will 'settle scores and teach them a lesson' after the elections. Abbas Ansari was present in the court when the court pronounced the order.
