Allahabad HC relief for UPCC chief in violation of 144 CrPC order case

The Allahabad high court has stayed further proceedings of a case against former MLA Ajai Rai involving violation of a 2017 restraint order under section 144 of the CrPC. Justice Sameer Jain passed the order in a petition filed by Ajay Rai challenging summons issued against him as well as the charge sheet filed by the police. The Allahabad HC in its order dated July 28 fixed August 5 as the next date of hearing in the case. (For Representation) The court in its order dated July 28, after hearing parties concerned, fixed August 5 as the next date of hearing and observed, 'In the meantime, further proceedings pending against the applicant in the aforesaid case crime, shall remain stayed.' Rai, who is currently UP Congress chief, in his petition had sought quashing of summoning order dated September 9, 2019 and the charge sheet dated November 7, 2017, as well as the entire proceedings of case no. 2436 of 2019, (State Vs Surendra Patel and others) arising out of case crime no. 193 of 2017, under section 188 (disobedience to an order lawfully promulgated by a public servant) of Indian Penal Code lodged at Kotwali police station of Varanasi. As per the petitioner's counsel, charge sheet was filed against Rai under section 188 IPC but cognizance was taken by the court concerned on the charge sheet submitted for offence under section 188 CrPC. Therefore, the cognizance order passed by the court concerned was bad in the eyes of law and was liable to be quashed.

Lucknow: Samajwadi Party 's Media Cell posted on X, "The govt should give a compensation of Rs 1 crore each to the families of the deceased devotees, ensure proper treatment and compensation for those injured, and disclose the correct number of deaths. " The UP Congress described the incident as "extremely tragic". "The news of the death of two devotees due to an electric shock and several others being injured is distressing. We express our deep condolences to the grieving families and pray for the speedy recovery of the injured," it posted on X. "This incident points to serious deficiencies in the arrangements. Robust security and crowd management measures are extremely necessary at religious sites. We demand that the govt provide appropriate compensation and all possible assistance to the affected families," the Congress state unit said.

He along with Rai chaired the party's Awadh zone meeting during the day after Braj, Prayagraj and Poorvanchal zones. 'What happened with the energy minister in Vrindavan is an example of what people think for this government. The minister was stopped from worshipping at Vrindavan temple by Goswami community people as they protested the projects being forced upon the people there,' Rai claimed. 'An FIR was lodged against me in Varanasi when I tried to expose the government for poor services for the Kanwariyas. But as our leader Rahul Gandhi says these FIRs are medals for me from the BJP government,' he said. Senior Congress leaders, including PL Punia, Virendra Chaudhary, Naseemuddin Siddiqui, Dinesh Kumar Singh and Anil Yadav, were present in the meeting.

Not just the Congress but others too need an alliance in Uttar Pradesh to win the election, said former Uttar Pradesh Congress president Raj Babbar on Saturday. Former Uttar Pradesh Congress president Raj Babbar (HT File Photo) 'The alliance isn't just Congress's responsibility but others too have to be in it equally,' said Babbar. Raj Babbar came to preside over the oath-taking ceremony of newly appointed district and city unit office-bearers of the Lucknow Congress. Babbar was UP Congress president in July 2016 and was replaced by Aj Kumar Lallu in October 2019 after he resigned. 'They should be in it (alliance) if they want to defeat the opponent you are contesting elections against, and you want to be the power to defeat them,' he said without taking the name of the Bharatiya Janata Party (BJP). 'The alliance will be made on ground according to the situation (in the future) and not on the basis of the past,' he said. 'At present we are focused upon organisational strengthening (sangathan srijan) and the process is being done in the most transparent manner,' he said, adding, 'There are no faces that you can say belong to a particular group. The entire process is under a coordination committee and the aim is to unite with like-minded people who are loyal with the party and connect with old associates also in a strong manner. Sangathan Srijan will enhance credibility among workers and encourage accountability.' Commenting upon the political implications of the caste census Babbar said that it is going to change the scenario. 'Naturally. You may do anything or not but people, once they know their status via census, will raise demands. Here, the lines by Lohia are most relevant: Jiski Jitni Hissedari Uski Utni Bhagidari (share on the basis of population). 'The caste census is certainly going to change the upcoming political scenario in the state as we will get a clear picture of the Hissedari, the demand for Bhagidari will also become clear. It will impact the elections,' said Babbar. Asked about the state government's move demanding shopkeepers on the Kanwar route to display name and identity, Babbar said, 'Why is this being demanded during the Kanwar Yatra. If necessary, it should be for all times. Kanwar Yatra has been taking place for years and all respect it.' Responding to the recent language row in Maharashtra, Babbar said, 'It is the government's job to handle such issues with maturity, not provoke the people.'

Lucknow: Former chief of UP Congress and ex-MP Raj Babbar on Saturday urged newly included party office-bearers to commit themselves to the party and work with full dedication to defeat communal and casteist forces. He urged them to maintain social harmony and brotherhood, protect the Constitution from anti-constitutional forces, and work according to the Congress ideology and Gandhian principles. "This is the only way to deliver social justice to the oppressed, exploited and deprived sections of society," he said, speaking at the oath-taking ceremony organised as part of the ongoing organisational creation campaign. He also congratulated them on their new roles. Stating that hatred was being spread under BJP rule in an organised way, Babbar said: "In such times, it is the duty of every Congress worker to push Gandhian principles, which are deeply embedded in the Congress ideology." He emphasised that choosing the path of non-violence was the only way to keep the nation united. "You must work with complete confidence and trust. You must always keep the Congress, like a vast tree, flourishing. Strengthen your identity to such an extent that your name is cheered," he said. Senior party office bearers were present on the occasion.
