Kerala trans couple can be named as ‘parents' in child's birth certificate. Why HC ruling is significant

In a significant development related to transgenders' rights, the Kerala High Court has directed the state authorities to issue a revised birth certificate of a child of a transgender couple, identifying them as 'parents' instead of father and mother, reported Onmanorama. The judgment was issued by Justice Ziyad Rahman AA on Monday on a plea filed by trans man Zahhad and trans woman Ziya Paval, seeking a gender-neutral format in the birth certificate issued by the Kozhikode Corporation under the Kerala Registration of Birth and Death Rules, 1999. The Kozhikode Corporation had earlier issued a birth certificate mentioning Zahhad as the mother and Ziya Paval as the father, along with the term transgender in parentheses. The trans couple objected to this classification, stating that it did not reflect their gender identities accurately. "We are extremely happy about the court's verdict. Trans couples like us can now opt to be recognised as 'parents' instead of gender-specific identities like 'mother' and 'father'. We filed the case soon after our child's birth," Ziya told Onmanorama. Ziya and Zahhad became India's first transgender parents on the birth of their child in February 2023. In their petition, they had requested the Kozhikode Corporation to avoid the name of father and mother on the birth certificate, since the biological mother of the child identified herself as a male years ago, and was presently living as male member in the society. "This is a major victory for the LGBTQ community. The certificate currently includes two slots -Name of Mother, Name of Father. This will be changed for trans parents henceforth. The fifth respondent, the Kozhikode Corporation, has been asked to modify the birth certificate and identify Ziya and Zahhad as parents," Padma Lakshmi, the lawyer who represented the trans couple, was quoted as saying by Onmanorama. Their plea was filed by advocates Mariamma AK, Padma Lakshmi, and Ipsita Ojal.

Kerala HC rules transgender parents be designated just 'parent' in child's birth certificate

Kochi: The Kerala High Court on Monday ordered that the gender details of Kerala's first transgender parents in their child's birth certificate be changed from "mother" and "father" to just "parent" for both partners. While the Pinarayi Vijayan government often says it is the first state government to have come out with a transgender policy, the transgender parents failed to get justice from the CPI-M ruled Kozhikode Corporation when they first approached it to modify their child's certificate, and then, took legal recourse. A bench of Justice Rahman passed the order on the plea by Zahhad, a transman (assigned female at birth but identifying as a man) and Ziya Paval, a transwoman (assigned male at birth but identifying as a woman), who are the first openly transgender couple in Kerala. "This writ petition is disposed of directing the fifth respondent to issue a birth certificate with the modification by removing the columns of names of father and mother and by incorporating the names of the petitioners as parents without referring to their genders," the court ruled. The transgender couple was in the news in February 2023 when Zahad gave birth to their child. The birth certificate of the child registered by the Kozhikode Corporation recorded the mother's name as Zahad (transgender) and the father's name as Ziya (transgender). Zahad and Ziya approached the Corporation to change the details in their child's birth certificate to indicate both of them as just 'parents' rather than mother and father. But the Corporation authorities rejected their request, and the couple then approached the High Court seeking relief. "Since scientifically there's some contradiction in the fact that a male is giving birth to a child, the petitioners requested the authorities to avoid the name of father and mother but simply writing 'parent' to avoid further embarrassment which the third petitioner (child) would have to face during her life time viz. school admission, Adhar Card, PAN Card, Passport and various other documents including job and connected matters," the parents contended. They also pointed out that the denial of such a certificate is a denial of their and their child's fundamental rights. Moreover, the denial of the new certificate goes against the dictum laid down by the Supreme Court in the landmark NALSA case. They further added that various other countries allow couples, especially same sex couples, to choose their title in their child's birth certificate from among 'mother', 'father' and 'parent'.

5-Year-Old Dies From Rabies In Kerala Despite Timely Vaccination After Dog Bite

Last Updated: Ziya Faris, a 5-year-old from Kerala, died from rabies despite timely vaccination after a stray dog bite. Treated at Kozhikode Medical College, she succumbed to severe injuries A child from Kerala's Malappuram district has died from rabies, despite receiving timely vaccination and treatment following a stray dog bite. The deceased, identified as Ziya Faris, was the daughter of Salman Faris, a resident of Malappuram. The five-and-a-half-year-old girl passed away while undergoing treatment at Kozhikode Medical College. According to The News Minute, Ziya was one of seven individuals bitten by the same stray dog on March 29. While the others are reportedly recovering, she sustained particularly severe injuries. According to the report, Ziya was attacked while walking to a nearby shop. The dog inflicted deep bites on her head, legs, and shoulder. She was first taken to Tirurangadi Taluk Hospital before being shifted to Kozhikode Medical College. There, doctors administered both the intradermal rabies vaccine (IDRV) and rabies immunoglobulin (RIG) as part of the standard post-exposure prophylaxis. RIG, also known as anti-rabies serum, provides immediate passive immunity, buying time until the patient's own immune response kicks in. Initially, her recovery appeared promising. Her wounds began healing by April 1, and she even resumed playing outside. But on April 25, Ziya developed a fever and was rushed back to the hospital, where tests confirmed she had contracted rabies. Her condition quickly worsened, she was unable to eat or open her eyes in her final days, doctors said. As The News Minute notes, the World Health Organization (WHO) warns that bites on the head, neck, hands, and other highly nerve-dense areas can allow the virus to travel more swiftly to the brain. This proximity can undermine even timely post-exposure treatment, highlighting the dangerous unpredictability of rabies in high-risk bite locations. Kerala recorded 102 rabies deaths between 2021 and April 2025, with 20 victims having received full or partial vaccination, Onmanorama reported, citing RTI data from the Directorate of Health Services. Among them, 10 had suffered severe bites to the head and face, areas where the virus can reach the brain faster, reducing vaccine effectiveness. An expert panel formed by the Kerala government in 2022 found that rabies deaths despite vaccination were largely due to bites on highly innervated areas like the head, face, neck, and between fingers, the Onmanorama report pointed out. The committee ruled out vaccine quality issues, noting all tested batches met safety and potency standards. It concluded that in fatal cases, the virus likely entered the nervous system directly through deep wounds, shortening the incubation period. First Published:
