A 12-year-old boy appeared in the Brakpan magistrate's court in the presence of his guardian to face charges of culpable homicide and driving a motor vehicle without a licence. 'It is alleged that on Saturday at about 1pm, the minor was driving his parents' vehicle at the corner of Madeley and Northdene streets when he drove over a 14-year-old boy and bumped into a wall,' National Prosecuting Authority spokesperson Lumka Mahanjana said. The 14-year-old boy was declared dead on the scene. The 12-year-old was then taken to the Brakpan police station and later released into the care of his parents on Sunday. AG can still order police probe into Beng Hock's death, says lawyer

PETALING JAYA : The attorney-general (AG) can still direct that the police investigate who was responsible for the death of former political aide Teoh Beng Hock under a more serious offence based on a Court of Appeal ruling issued 11 years ago, a lawyer said today. Salim Bashir said investigations could be conducted for culpable homicide not amounting to murder, causing death by negligence, or voluntarily causing grievous hurt. 'The Court of Appeal in 2014 found that Teoh's death was accelerated by the 'unlawful acts of persons unknown' and that the AG could direct the police to conduct further investigations,' he told FMT. He said there is no limitation period within which charges must be brought against a suspect. However, the prosecution must ensure that it is able to call the necessary witnesses and present the required evidence in court to support the charge, he added. Salim was speaking to FMT after two senior DAP leaders called for AG Dusuki Mokhtar to explain in detail why he thinks there is insufficient evidence to prosecute anyone for criminal offences which may have resulted in Teoh's death. Speaking on behalf of the party's central committee, its national chairman Gobind Singh Deo and secretary-general Loke Siew Fook called on the AG to review his decision and push ahead with charges against those responsible without further delay. FMT has contacted Dusuki, who is also the public prosecutor, for his response. Salim, a former Malaysian Bar president, said the AG under Article 145(3) of the Federal Constitution and Section 376 of the Criminal Procedure Code had the discretion whether to prosecute a suspect, and which provision of the law to utilise. Last week, lawyer-activist M Visvanathan told a gathering in solidarity with Teoh's family that three doctors had during an inquiry said that the deceased had injuries to his neck, which occurred before he fell from the fifth floor of Plaza Masalam in Shah Alam. 'These injuries would have been capable of making Teoh immobile or unconscious,' he said when contacted, adding that a judge in the Court of Appeal bench stated that there was no necessity to 'engage Sherlock Holmes to investigate because the circumstances are so credible'. Visvanathan said it was absurd for police to confine their recent investigation to wrongful confinement under Section 342 of the Penal Code as Teoh had been detained by the Malaysian Anti-Corruption Commission (MACC) for lawful investigations. Lawyer Rafique Rashid Ali called for the AG to issue a press conference instead of a letter to Teoh's family explaining why he had classified the case as requiring no further action (NFA). 'As the guardian of public interest, the AG should be transparent and accountable as this is a high-profile public interest case, and there needs to be closure to the family's predicament,' he said. Rafique said that in October 1994, then AG Mohtar Abdullah announced through the media that he was not pressing charges against an influential political leader as he had no prima facie evidence to pursue a charge of raping an underaged girl. However, Mohtar said he was not exonerating the suspect of the alleged offence. He said another AG, Apandi Ali, had in January 2016 told the media that then prime minister Najib Razak had been cleared of any criminal wrongdoing in the RM2.6 billion channelled into Najib's bank accounts and finance ministry-owned firm SRC International Sdn Bhd. Apandi said there was 'insufficient evidence' to implicate Najib and ordered MACC to close its three investigation papers. However, in 2018, Najib was charged with corruption in the SRC International and 1MDB case. Teoh died on July 16, 2009 after being questioned for hours by MACC officers. An inquest was held and the coroner returned an open verdict. However, the Court of Appeal ruled that Teoh's death was caused by 'one or more persons unknown', including MACC officers. In 2019, police launched an investigation under Section 342 of the Penal Code for wrongful confinement. In November last year, the High Court ordered the police to complete its long-delayed investigations within six months. Before 2018, two special investigation teams were set up – one in 2011 and the other in 2015 – to look into Teoh's death. Both cases were classified as NFA by the public prosecutor.

Two people in India died after a dentist performed hair transplant surgeries on them despite having no training or qualifications. Vineet Kumar Dubey, 37, and Mayank Katiyar, 32, both died within 48 hours of having operations performed by Dr Anushka Tiwari in the city of Kanpur, located in the state of Uttar Pradesh. Tiwari surrendered at a local court on Monday and was arrested on suspicion of culpable homicide, after dodging raids in several states for weeks, according to local media. Dubey, an engineer and father-of-two, attended Tiwari's private Empire Clinic on March 13, but died of a brain infection at Regency Hospital in Kanpur two days later. 1 His wife Jaya Tripathi filed a complaint, and said her husband was left with a badly swollen face and was in pain before his death. She explained: 'His face was so swollen, it looked like a balloon. His eyes were bulging out. I couldn't even recognize him. 'He had just completed his PhD and received a job offer from a top U.S. firm. He wanted to surprise me with his new look.' But she said police failed to act on the complaint for nearly two months. It emerged this month that Katiyar also died after a procedure with Tiwari, died on November 19 last year. His mother said her son died in her lap at a private hospital in Farrukhabad one day after having surgery. The authorities had been trying to catch up with Tiwari for weeks, carrying out raids in multiple states in an effort to find her. Her cell phone location was traced to Rohtak and Panipat, but she remained under cover until she gave herself up to the court. According to India Today she initially claimed she had not performed the procedures herself, and blamed another doctor. But a case of culpable homicide has now been brought against her for both of the deaths based on the complaints from the families. State lawyer Dilip Singh said in a statement: 'There are serious allegations against Anushka Tiwari, a dentist, who performed a surgery outside her professional domain. She surrendered in court and has been sent to jail.' In her complaint, Tripathi alleged that she had tried in vain to reach the dentist as her husband's condition deteriorated on March 14. She told NDTV: 'We called again Dr Anushka Tiwari the same night around 11 and she admitted that she performed the surgery without a test.' An initial investigation into Dubey's case by the health authorities revealed significant medical negligence, a committee found. It said the procedure was carried out in spite of the patient being diabetic and hypertensive. He developed a bacterial brain infection, which led to encephalopathy and death. After Katiyar died his family also approached the police. His mother Pramodini Katiyar told News18: 'He came home at 5pm but was crying in pain by midnight. His face swelled and darkened. 'By morning, he couldn't see and was struggling to breathe. He died in my lap the next day.' She said Dr Tiwari blocked her number and became unreachable after her son died. The grieving mother said of the dentist: 'I want her arrested - otherwise, she'll take away someone else's son tomorrow.' The family lodged a complaint on May 13. Dr Tiwari has appeared on YouTube speaking on hair care as a 'dermatologist'. Her clinic is registered in the name of her husband, Dr Saurabh. Investigators are now looking at the qualifications of other staff members. The next hearing is scheduled for June 6.

(Bernama pic) PETALING JAYA : A former election candidate has been sentenced to 10 years in jail after pleading guilty in the Seremban High Court to culpable homicide not amounting to murder over her husband's death three years ago. Justice Rohani Ibrahim meted out the sentence on Lau Seck Yan, 58, after she pleaded guilty to the amended charge, Sinar Harian reported. Lau, who ran as an independent candidate in the 2018 Port Dickson by-election, previously pleaded not guilty to murder. Rohani ordered Lau's jail sentence to commence from the date of her arrest on Jan 23, 2022. Lau was charged with causing bodily injury that was likely to cause death to Poh Seng Hiap, 55, at a house in Rasah Kemayan Golf & Country Township, Seremban 2 at 3.30pm on Jan 23, 2022. The former lecturer at a private college was charged under Section 304(a) of the Penal Code, punishable by up to 30 years in prison and a fine upon conviction. Her lawyer, Kitson Foong, had asked the court for a lower jail term since Lau had pleaded guilty and did not have a criminal record. Deputy public prosecutor Khairunnisa Hazwani Omar sought a sentence commensurate with the seriousness of the crime, citing public interest in the case. The 2018 Port Dickson by-election was won by PKR president Anwar Ibrahim, who defeated a candidate from PAS as well as five independent candidates, including Lau, who received 214 votes.
