Second suspect arrested in CBP officer shooting has lengthy criminal past, DHS says
Print Close By Greg Norman Published July 21, 2025 The second illegal immigrant suspect arrested Monday in the shooting of an off-duty U.S. Customs and Border Protection Officer in New York City over the weekend has a lengthy criminal background, officials said. Cristian Aybar Berroa of the Dominican Republic "illegally entered the United States on June 19, 2022, and was released into the country on interim parole pending his immigration hearing," according to the Department of Homeland Security. He then allegedly committed a litany of crimes in New York City, including arrests for 2nd degree reckless endangerment in May 2023 and 4th degree felony grand larceny and petit larceny in March and April 2024, officials said. Following the April 2024 arrest, "Despite an active ICE detainer, the New York City Department of Corrections released Berroa back onto NYC streets," Homeland Security said. NOEM BLAMES 'SANCTUARY' POLICIES FOR MIGRANT ACCUSED OF SHOOTING OFF-DUTY CBP OFFICER Berroa was then arrested by the New York City Police Department in February 2025 for 2nd degree reckless endangerment, reckless driving and for driving without a license, the DHS continued. "On June 12, 2025, Berroa pled guilty to petit larceny at the Bronx County Supreme Court. This plea was made in consolidation of all his previous arrests, and he was conditionally discharged and allowed to roam the streets of NYC," it also said. "A judge ordered Berroa a final order of removal on January 3, 2023." He and Miguel Francisco Mora Nunez are now expected to face federal charges in connection to the shooting at New York City's Fort Washington Park late Saturday, Interim U.S. Attorney for the Southern District of New York Jay Clayton announced Monday. "A witness of the attack stated that she and the victim were sitting on the rocks by the water when two subjects on a scooter drove up to them, dismounted the scooter and approached them with a firearm drawn. The off-duty CBP officer responded by withdrawing his own firearm in self defense. The CBP officer was shot in his right arm and left cheek. Thankfully, the officer is in stable condition at the hospital," Homeland Security said. NYPD Commissioner Jessica Tisch said Monday that Berroa was the scooter driver in the incident. "He was arrested eight times between March and April 2024 for grand larcenies and robberies involving a scooter in the Bronx," she said. "He's also a suspect in at least four additional cases. He entered this country illegally through Texas in 2022." Multiple sources within U.S. Immigration and Customs Enforcement told Fox News that the men involved in the shooting are believed to be the same men caught on video in an armed robbery of a business in Leominster, Massachusetts, in February. Trump lashes out at Biden after illegal immigrant accused of shooting CBP officer in NYC
President Donald Trump lashed out at former President Joe Biden after an off-duty Customs and Border Protection (CBP) officer was allegedly shot in the face by an illegal immigrant with a lengthy criminal rap sheet in New York City. "Last night, in New York City, an incredible CBP Officer was shot in the face by an Illegal Alien Monster freed into the Country under Joe Biden," Trump wrote in a Truth Social post on Sunday. "He was apprehended at the Border in April 2023 but, instead of being deported, was RELEASED." The suspect was identified by the Department of Homeland Security (DHS) as 21-year-old Miguel Francisco Mora Nunez, a Dominican national. DHS confirmed that Nunez was arrested by Border Patrol near San Luis, Arizona, in April 2023, but was released into the U.S. by the Biden administration. The agency also told Fox News that Nunez has an active warrant for kidnapping in the state of Massachusetts, in addition to prior felony arrests. During a press conference on Sunday, NYC Mayor Eric Adams said Nunez had prior arrests for assault and violating an order of protection. Adams said Nunez also had an active bench warrant from the Bronx, was wanted for a robbery from last December and a stabbing from January. "The Democrats have flooded our Nation with Criminal Invaders, and now, they must all be thrown out or, in some cases, immediately prosecuted in that we cannot take a chance that they are able to come back," Trump added. "That's how evil and dangerous they are!" Authorities said Nunez rode up on a motorized scooter with another suspect and attempted to rob the CBP officer as he sat in Riverside Park on Saturday night. The officer, who has not yet been identified, pulled out a gun to defend himself. Police said the officer and Nunez were both shot multiple times. Nunez walked into an area hospital after the shooting, police said. The officer is expected to recover from his injuries. Trump added that the off-duty officer "bravely fought off his attacker, despite his wounds, demonstrating enormous Skill and Courage." Adams said Nunez was taken into custody. "He has inflicted violence in our city and once he is charged for last night's crimes, we will be able to add attempted murder to his rap sheet," Adams said. DHS has lodged a detainer against Nunez.

FBI captures final illegal immigrant inmate who escaped ICE facility in New Jersey
The final illegal immigrant inmate who escaped an ICE center in New Jersey last month was arrested by the FBI after being tracked down on the other side of the country. Andres Felipe Pineda-Mogollon was taken into custody Thursday in Los Angeles after a traffic stop in the Silver Lake neighborhood, the FBI's Los Angeles Office wrote on X. Homeland Security Investigations assisted in the arrest. "We are tremendously grateful to our brave ICE agents and law enforcement partners for capturing Andres Pineda-Mogollon and the other three dangerous criminal illegal aliens who escaped Delaney Hall," Department of Homeland Security Assistant Secretary Tricia McLaughlin said in a statement. "Politicians and activists relentlessly try to smear ICE, but the facts remain true: Delaney Hall houses dangerous criminals, including these four fugitives who committed aggravated assault, burglary, theft and even threatened to kill law enforcement. Now, these slimeballs no longer pose a threat to public safety." The Colombian entered the U.S. in 2023 and overstayed his tourist visa. He was one of four inmates DHS described as "public safety threats" who broke out of Delaney Hall, a privately-run ICE detention center in Newark, New Jersey, the evening of June 12. Franklin Norberto Bautista-Reyes, Joel Enrique Sandoval-Lopez and Joan Sebastian Castaneda-Lozada, all from Honduras, were captured before Pineda-Mogollon. Their escape June 12 happened after an apparent disturbance inside the building, a senior Homeland Security official confirmed to Fox News. Immigration attorney Mustafa Cetin told around 50 detainees at the private center pushed down a dormitory wall after becoming agitated when meals were delayed. "It's about the food, and some of the detainees were getting aggressive, and it turned violent," Cetin said at the time. Pineda-Mogollon was arrested by the New York City Police Department April 25 for larceny and again on May 21 by the Union, New Jersey, Police Department for residential burglary, conspiracy to commit residential burglary and possession of burglary tools. Bautista-Reyes illegally entered the U.S. in 2021 during the Biden administration and was arrested by the Wayne Township, New Jersey, Police Department May 3 for aggravated assault, attempt to cause bodily injury, terroristic threats and possession of a weapon for unlawful purposes. Sandoval-Lopez illegally entered the U.S. as a minor in 2019 and was arrested by the Passaic Police Department in October for unlawful possession of a handgun and again Feb. 15 for aggravated assault. Castaneda-Lozada entered the U.S. illegally in 2022 and was arrested by the Hammonton Police Department May 15 on charges of burglary, theft and conspiracy to commit burglary.

Illegal immigrant convicted of shooting at small-town officer in high-speed chase
A small-town traffic stop turned into a deadly confrontation when an illegal immigrant opened fire on a Tennessee Highway Patrol officer. The Knox County District Attorney General's Office announced Thursday that Eugenio Abraham Solis-Klarks, 31, was convicted of first-degree attempted murder and sentenced to 18 years in prison without the possibility of parole after a Jan. 12 officer-involved shooting. A source familiar with the matter previously confirmed to Fox News Digital Solis-Klarks was living illegally in the United States from Guatemala. Tennessee authorities initially pulled Solis-Klarks over Jan. 12 around 6:30 p.m. in Lenoir City after Tennessee Highway Patrol Tpr. Morgan Snyder observed him driving 97 mph on Interstate 75 in Loudon County. Tpr. Snyder pulled the Guatemalan national over for speeding and asked if he had any ID. Upon being pulled over, authorities said, Klarks presented a Guatemalan consular ID card. The trooper called for backup, and troopers Paul Dubroc and Justic Hasse arrived at the stop. When authorities began to issue a citation, Solis-Klarks fled, "leading officers on a high-speed pursuit into Knox County," court records state. All three troopers pursued Solis-Klarks, who was driving in excess of 100 mph, the district attorney's office said. As they approached an exit, he "abruptly changed lanes to take the exit ramp," the department said. Only Dubroc was able to safely change lanes and continue to pursue Solis-Klarks' vehicle, the department said. The Guatemalan migrant lost control of his vehicle, and Dubroc pulled up next to him and ordered him to show his hands, the department said. "Solis-Klarks retrieved an assault rifle from his vehicle and aimed it at Trp. Dubroc," authorities said. "Tpr. Dubroc and Solis-Klarks exchanged gunfire over the hoods of the vehicles before each retreated around their vehicles." As Solis-Klarks ran toward the interstate entrance ramp, where troopers Snyder and Hasse were arriving, Tpr. Dubroc fired again, striking Solis-Klarks in the legs. Troopers then took him into custody and began providing medical treatment. No troopers were injured. "This defendant has been held accountable because of the professionalism of the Tennessee Highway Patrol and the Tennessee Bureau of Investigation," DA Charme Allen said Thursday. Tennessee is one of dozens of states that has seen increases in crime by illegal immigrants in recent years. Under a state law passed in 2024, Tennessee law enforcement agencies are required to honor ICE detainer requests. In February 2024, the Nashville Banner reports, ICE made 33 detainer requests in Nashville, resulting in 11 individuals being taken into custody. By the following month, requests increased to 75, with 42 individuals detained. It was immediately unclear if Immigration and Customs Enforcement (ICE) is pursuing the deportation of Solis-Klarks. Illegal immigrant convicted in 100 mph DUI crash that killed Washington state trooper
Jurors in Washington state delivered a guilty verdict against an illegal immigrant accused of killing a state trooper last year. Raul Benitez-Santana, 33, was found guilty of vehicular assault and vehicular homicide in connection with the death of Washington State Patrol Trooper Christopher Gadd. Gadd, 27, was killed when his cruiser was hit by a speeding car in March 2024 at more than 100 mph. Benitez-Santana was under the influence at the time of the crash, and admitted to drinking and smoking marijuana before driving, Fox Seattle reported. He was swerving across the road before slamming into the rear end of Gadd's vehicle, which was parked on the shoulder. Gadd was watching for speeding and DUI drivers, when he was struck and killed in a three-vehicle crash on Interstate 5. After his arrest, U.S. Immigration and Customs Enforcement (ICE) issued a detainer request with Snohomish County Jail for Benitez-Santana, a Mexican citizen. He was first encountered by immigration agents on Oct. 28, 2013, at the South Correctional Entity in Burien, Washington, after being arrested for failing to appear in court for driving on a suspended license. He was also sentenced to 90 days behind bars, with 87 of the days suspended, in May 2013, after being convicted of possessing less than 40 grams of marijuana. On Oct. 6, 2014, Santana was sentenced to 90 days behind bars for driving on a suspended license, and in May 2019, was arrested again for domestic violence assault.
