The incident occurred in January 2025 at CES, where Genki possessed an 'exact' 3D printed physical mockup of the Nintendo Switch 2 console. This was before the device's official reveal, and as such, attracted the attention of fans and media outlets. All of these were being done behind closed doors, which prompted a visit from Nintendo's legal team to Genki's CES booth. The meeting resulted in the complete shutdown of Genki's CES booth a day before the conclusion of the trade show.

A month after Genki's CEO, Edward Tsai, allegedly revealed the highly confidential Nintendo Switch 2 design at CES, Nintendo of America has filed a lawsuit against them with the United States District Court for the Central District of California. The court filing accuses Genki of trademark infringement, false advertising, and unfair competition. The lawsuit is currently awaiting approval from the United States District Court judge. Here's an excerpt from the court filing:

At the CES event, Genki demoed and promoted unauthorized purported mockups and renderings of the Nintendo Switch 2 and its accessories. Further, Genki presented at least two unauthorized 3D-printed mockups of the Nintendo Switch 2 to reporters. Genki boasted its alleged early access to the unreleased console and allowed guests to hold and measure the mockups.'
Nintendo doesn't take trademark infringements lightly. Following the court filing, Nintendo has requested the accessory manufacturer, Genki (also known as Human Things) to stop promoting or selling any accessories for the Nintendo Switch or Nintendo Switch 2.
Genki responds to the lawsuit filed by Nintendo
On May 4, 2025, the Genki team gave a public response to Nintendo's allegations and the lawsuit. They
haven't officially denied the allegations
and stated that they are working with legal counsel to respond thoughtfully. Here's what they said:
'You may have seen that Nintendo recently filed a lawsuit against us. We're taking it seriously and working with legal counsel to respond thoughtfully.
What we can say is this: Genki has always been an independent company focused on building innovative gaming accessories for the community we love. We're proud of the work we've done, and we stand by the quality and originality of our products.
While we can't comment in detail, we're continuing preparations to fulfill orders and showcase our newest products at PAX East this week.'
As tensions rise, both sides of the party await an official hearing from the court. Genki's business will take a massive hit if they are barred from selling Nintendo Switch 2 accessories. Seeing the hype over this newly launched console, Genki was planning to capitalize on it, but the recent incidents took a turn for the worse from their perspective. Only time will tell how this lawsuit ends.
