Mumbai, In a legal dispute spanning over three decades, a local court here has ordered a housing society to evict the land it had leased in 1966 from yesteryear Bollywood couple Kamal Amrohi and Meena Kumari in Bandra.
The appellate bench of the Court of Small Causes in Bandra has ruled in favour of Amrohi's son, Tajdar Amrohi, and ordered the 162-member society to hand over possession of the land in the posh Pali Hill locality within six months.
The order was passed on April 23.
Additional Chief Judge Ashish Ayachit and Judge D R Mali held that the society failed to pay the contractual rent regularly and has hence committed default.
"The society has consciously committed a breach of the covenants of the indenture of lease regarding the payment of contractual rent," the order said.
"The defendant society was not ready and willing to pay the arrears of rent, and they failed to comply with the provision of section 12 of the Bombay Rent Act. Therefore, the plaintiffs are entitled to a decree of eviction," it said.
Meena Kumari married Amrohi in 1952, and the couple purchased the land measuring over 11,000 square yards at Pali Hill in suburban Bandra in 1959.
The land was leased to the Cozihome Co-operative Housing Society Limited in 1966 for the construction of buildings at a rent of ₹8,835 per month.
In 1990, Amrohi terminated the lease agreement, claiming that the society had failed to pay the agreed rent and had defaulted in payments.
A year later, he filed a suit seeking eviction of the society and possession of the land.
In October 2007, the Court of Small Causes in Bandra passed an order in favour of Amrohi and passed a decree of eviction against the society, which challenged the order before the appellate bench.
The appellate bench has held that the trial court's order of eviction was "proper and correct".
The society has been ordered to hand over possession of the land within six months.
The society is planning to challenge this order before the Bombay High Court.

JHANSI : The granddaughter of the late Chambal rebel and ex-army man Paan Singh Tomar has been booked for allegedly assaulting a junior engineer from the power department, police said on Thursday. The incident occurred on Tuesday in Punjabi Colony, under Babina police station limits, when a team led by junior engineer Vaibhav Rawat was installing smart meters as part of a rural power distribution upgrade. According to SHO Tulsi Ram Pandey, when the team tried to replace the electricity meter at the house of ex-serviceman Shivram Singh Tomar, his teenage daughter Sapna Tomar resisted the move. She allegedly manhandled the engineer during the confrontation. A case has been registered against Sapna Tomar under IPC sections pertaining to assault and obstructing a public servant from performing official duties. The case attracted public attention after a video of the incident, allegedly recorded by a power department staff member, surfaced online. The footage appeared to show Sapna engaging in a physical altercation with the engineer. Interest in the case has intensified as Sapna is said to be the granddaughter of Paan Singh Tomar, the Indian Army soldier-turned-dacoit whose life inspired a 2012 Bollywood biopic. Tomar was killed in a police encounter in Morena nearly 40 years ago. Police said an investigation is underway and further action will be based on the findings.

Mumbai: Over five years after she first moved the Bombay High Court to intervene and ensure the state gives her a house, Devika Rotawan, the youngest victim of the 26/11 terror attacks and a prosecution witness, was allotted a Mhada house and will soon be moving in. Rotawan, now 25, was a first year BA student at Chetna College in Bandra when she moved the HC. She was barely 10 when the three-day terror siege by 10 terrorists from Pakistan took place inNov 2008. She was a key eyewitness during the trial. "My father taught us that even if you meet 100 people and 99 of them are bad, if one is good, follow that one. He's the one who encouraged me to testify,'' she told the TOI, on Wednesday, adding that she is yet to fully move into the newly allotted home. She said she had received the house keys in March. "But we're overjoyed. For the first time, we feel like we'll have a stable place to call home." "Some minor work is still left — just electrical fittings and installing a fan," she said of the flat she has been allotted in Andheri, suburban Mumbai. On her plea first argued by Delhi-based advocate Utsav Bains in 2020, the HC had in 2020 asked the state to consider the request for a house under its economically weaker section (EWS) scheme and to provide for her higher education. She aspired to join the Indian Police Service (IPS), she said. "My dream of becoming an IPS officer had to be set aside, but my goal is still to serve the nation in whatever way I can." Rotawan's experience post-attack, she said, has been marked by displacement, uncertainty. "Most landlords didn't want to rent to us after they heard about our connection to the case." Despite surviving the attack, the emotional impact still stays with her. "Even now, a part of me is always anxious that something like that could happen again," she said. "But I've learned that you can't let fear hold you back — if I had, I would've never moved forward."

Court accepts ACB closure report in Powai land ‘fraud'

ACCEPTING THE closure report filed by the Anti-Corruption Bureau (ACB), a special court has said that no criminal case is made out into allegations of a Rs 30,000-crore land fraud in Powai, clearing businessman Niranjan Hiranandani and others. The proceedings related to the allegations that in the Powai Area Development Scheme intended for affordable housing, losses were caused to the public exchequer by diverting the land for the construction of luxury apartments by developers, including Hiranandani. Special Judge S E Bangar on June 2 accepted the 29-page closure report filed by the ACB, while also rejecting a protest petition filed by activist Santosh Daundkar. 'There is no material worth the name to even create a suspicion indicative of any offence by the accused persons,' the court said. It also said that around 8,000 residents of the housing scheme have not filed any criminal complaints or supported the complainant, Daundkar, and ruled that he is neither a resident nor an investor in the scheme. Stating that the case was of a 'civil nature', the special court also said that proceedings before the Bombay High Court related to the housing scheme had been disposed of and in light of compliance done by the developers, nothing was brought on record to infer any criminal offence. The ACB began its probe into the allegations in 2012 but had filed a closure report in 2013, which was first rejected by the court in 2018 and a further probe was ordered. The ACB reinvestigated and again submitted a closure report in 2019, maintaining that no offence was found. The ACB said that the issues raised were that of policy and contractual violations and were not of criminal culpability. For development of the Powai area, a tripartite agreement was executed between the state of Maharashtra, Mumbai Metropolitan Region Development Authority and Hiranandani Developers Pvt Ltd on November 19, 1986, related to 232.32 acres of land. The agreement required development of 50 per cent flats each of 40 sq metres and 80 sq metres, and 15 per cent of the developed flats to be handed over to the state. It was alleged that instead of low-income affordable housing, unauthorised amalgamated luxury units were constructed, leading to commercial exploitation of land and violation of the terms of the agreement. The ACB, while seeking closure of the case, relied on orders by the high court, where separate proceedings were filed, referring to three Public Interest Litigations, which were disposed of in 2023. The ACB argued that the order settled the issue and no grievance remains. The high court had disposed of the PILs, observing that all contractual obligations under the 1986 agreement were fulfilled and compliance was made of its earlier interim orders, including directions for the construction of 2,661 flats of the agreed upon square metres and handing over of 256 flats to the government. Daundkar had claimed that the PILs addressed compliances with housing policy but criminal culpability remained. His plea seeking access to internal notings related to the scheme were rejected by the court stating that they were 'confidential'. 'There is no alleged breach of terms of the tripartite agreement, any other irregularities and illegal acts found to be committed by the accused/respondents,' the court said, putting an end to the long-pending proceedings.
