The Gauteng High Court, Johannesburg, which earlier declared the city's steep property rates regarding properties owned by independent schools unconstitutional, refused the city permission to appeal against the ruling.

THE Gauteng High Court, Johannesburg, has turned down an application by the City of Johannesburg following the court's earlier declaration that the municipality's rates policy is unlawful and constitutionally invalid to the extent that it regulated the categorisation and rating of educational properties.
The ruling issued by the court earlier this year follows the city's removal of a property category that applied to educational institutions, and adopted a property rates by-law and policy that categorised private schools as public enterprises.
This led to a drastic increase in property rates and taxes for private schools and other educational institutions.
Various stakeholders, including Curro Holdings, the Independent Schools Association of South Africa, and AfriForum, launched the application following the drastic school rate increase.
The court found that the city's public participation process in adopting the 2023/2024 property rates policy was inadequate and did not meet constitutional and statutory requirements.
It further found that the metro failed to meaningfully consult with stakeholders, including independent schools, ignored the best interests of scholars, and thereby violated the Constitution.

Aggrieved by this ruling, the city now asked the court for leave to appeal against it.
The city argued that this court erred on the facts and the law in its findings. It especially disagreed with the finding in which the court held that the city's public participation process, which led to the adoption of the city's 2023/2024 rates policy, rates by-law, and the city's budget to the inclusion of educational property under the 'Business and Commercial' category, was a 'sham'.
Judge Phaneul Mudau, in the application for leave to appeal, remarked that his court had the benefit of reviewing the full record of the city's consultation process (or lack thereof) and made specific findings on how and why it fell short.
This court noted, by way of example, that the city's response to public submissions does not engage at all with submissions made by members of the public.
The city, in this instance, failed to identify any misdirection by this court, nor any material factual evidence that was overlooked, the judge said.
He added that it is, therefore, unlikely that another court would have a different view of the city's inadequacies regarding the public participation process embarked upon.
'As Curro correctly pointed out, the city's disagreement with this court's factual appraisal of the consultation process does not translate into a bona fide prospect of success on appeal,' the judge said.
The city also argued that the court erred in finding that 'the city failed to consider the best interests of the children that attend independent schools when it decided to re-categorise private educational properties'.
But, Judge Mudau said, this criticism is without any foundation. He said the city failed to consider the best interests of the child in its decision to unlawfully categorise independent schools as 'business and commercial' properties without adequate prior consultation with the relevant stakeholders.

'Our visit to the United States did not focus on issues of Black Economic Empowerment,' Ramaphosa told Parliament on Wednesday afternoon. 'It focused on resetting the relationship with the United States and ensuring that we continue open conversations with our major trading partners.' He was responding to a question from Nicholaas Hendricks Pienaar of the Democratic Alliance (DA) in Limpopo. Pienaar asked whether the Government of National Unity (GNU) should revise Broad-Based Black Economic Empowerment (BBBEE) policies to attract more international investment and stimulate economic growth and job creation. Ramaphosa reiterated the government's commitment to economic transformation. 'Our commitment to black economic empowerment, as expressed through various policy documents and statements, remains steadfast,' he said. 'Through the Statement of Intent signed by various parties in the GNU, we are committed to translating the values of our Constitution into reality - particularly social justice, redress, and equity.' Last month, IOL News reported that, just days after a high-level meeting at the White House, attended by South African billionaire Johann Rupert and Tesla CEO Elon Musk, the South African government appeared to be easing regulations to facilitate the entry of Starlink, Musk's satellite internet service. The alleged shift in policy has sparked debate over the influence of global business elites on national legislation and whether diplomatic lobbying is steering South Africa's tech and telecommunications framework. Rupert, citing rising crime and economic stagnation, called for Starlink's launch to be fast-tracked. 'We need Starlink in South Africa,' he said. Meanwhile, Ramaphosa pointed to the Constitution's Equality Clause as a foundation for transformation policies like BBBEE. 'There are a number of measures that the Equality Clause calls on us to embark on - legislative measures to protect or advance persons disadvantaged by unfair discrimination,' he said. He emphasised that the BEE Act remains a central lever for inclusive, sustainable growth. 'We must dispense with the false notion that we must choose between transformation and growth,' Ramaphosa said. 'Black economic empowerment is not only compatible with investment and growth - it is essential to achieving broad-based prosperity.' Ramaphosa added that BEE should not be seen as a project for a select few. 'It must be a national project. Everyone, including those who benefited under apartheid, must be involved,' he said. 'Failing to do so risks economic stagnation.' In a follow-up question, Pienaar asked Ramaphosa if he would support foreign investments like Starlink without requiring a 30% ownership stake for local partners. However, Ramaphosa responded by pointing to the country's equity-equivalent model, which allows foreign companies that cannot meet direct ownership requirements to instead contribute to transformation initiatives. 'For offshore-based companies with global ownership structures, we've come up with an innovative, equity-equivalent solution,' Ramaphosa said. 'They embark on initiatives that support transformation and get involved in economic development without handing over equity. And many have embraced this approach.' He added that while South Africa is not unique in requiring local ownership, it may be the only country offering a flexible equity-equivalent system - which many multinational companies have welcomed. 'We are not averse to coming up with good solutions, so long as there is commitment to transformation,' Ramaphosa said. 'That, to us, is not negotiable.' President Cyril Ramaphosa has stressed the need to dispel the notion that transformation and growth are mutually exclusive, arguing that Broad-Based Black Economic Empowerment (B-BBEE) is essential for broad-based growth and prosperity. During an oral question-and-answer session before the National Council of Provinces (NCOP) on Wednesday, the president reaffirmed the government's commitment to B-BBEE, referencing various policy documents and public statements. DA MP Nicolaas Pienaar asked President Ramaphosa whether the government of national unity (GNU) should revise B-BBEE policies to attract more international investment by making them more effective and inclusive to drive economic growth and job creation. B-BBEE is 'compatible with investment and growth' The president emphasised the need for demonstrable steps to ensure the achievement of equality and the involvement of all South Africans in transformation processes. 'Black economic empowerment is not only compatible with investment and growth, but is essential to the achievement of broad-based growth as well as prosperity,' he said. He argued that the current government must act decisively and explicitly to ensure genuine progress toward equality. 'However, despite the progress that has been made across a range of measures, we can do better. Pienaar asked a follow-up question about Elon Musk's internet service Starlink, and supporting investment that delivers internet access to rural communities without requiring businesses to hand over 30% of their companies. 'Equity equivalent measures' Ramaphosa discussed the 'innovative' equity equivalent measures that allow offshore-based companies to participate in the transformation process with joint ownership. He explained that many major companies have embraced this solution and are actively investing in the country. 'We are not averse to coming up with good solutions, as long as there is commitment to transformation that, to us, is not negotiable and we will not turn back from that,' he said. EFF MP Meisie Kennedy raised concerns about the misuse of B-BBEE policies by the politically connected elite, who allegedly syphon billions of rands under the guise of empowerment. She asked the president about measures to prevent unregulated foreign control infrastructures from bypassing necessary B-BBEE laws in relation to Starlink. Measures will not violate constitution or laws Ramaphosa mentioned that Minister of Communications and Digital Technologies Solly Malatsi has announced public hearings to discuss the efficacy of the announced measures. 'There's no violation as far as he's concerned and as far as I'm concerned, with regard to our laws, and it's not specifically aimed at one or another company,' he said. The president made assurances that the measures will not violate the constitution or any laws. Meanwhile, the latest Quarterly Labour Force Survey from Statistics South Africa showed that the number of unemployed youth increased by 151 000 to 4.8 million, while the number of employed youth dropped by 153 000 to 5.7 million. Ramaphosa acknowledged the critical challenge of youth unemployment and outlined various interventions, including the Presidential Employment Stimulus and the Basic Education Employment Initiative. 'We need to move faster to create the jobs' He also mentioned the Employment Tax Incentive, the Youth Employment Service, and the Jobs Boost Outcomes Fund. The president emphasised that South Africa must accelerate economic growth to tackle youth unemployment and highlighted ongoing reforms aimed at making the economy more attractive to investors. 'We recognised that young people remain frustrated with the pace of change, and as we increased access for them to get an education, we need to move faster to create the jobs that they now need,' Ramaphosa said. Ramaphosa responded by stressing the need to strengthen the state's capacity to drive economic growth and reduce youth unemployment. National Dialogue ANC MP Jane Mananiso called for the National Dialogue to address various youth challenges, including sustainable jobs and the inclusion of diverse groups like people with disabilities, LGBTQIA+ people, and youth in conflict with the law. He agreed on the importance of inclusive programmes and highlighted the need to address mental health challenges among unemployed youth. Image: Zara Julius Various focus groups have met to discuss and fine-tune their submissions for their particular interests concerning the development of the Tafelberg school site in Sea Point. The site at 353 Main Road has been vacant for 15 years and just five years ago the Western Cape Government's Department of Infrastructure was mandated to develop a plan for spatial redress. Three focus group discussions were hosted in recent weeks since three conceptual plans were tabled on Saturday May 21. The development scenarios include an open market and affordable and social housing, which interested parties can comment on. The group discussions were hosted by the Department of Infrastructure and its appointed professional service provider team, including engineers, architects and urban planners from Zutari, who were flanked by specialist heritage advisors from Rennie, Scurr and Adendorff. He emphasised that while residents and people living in Sea Point were directly impacted or affected, the area was of interest to all in Cape Town. 'It is an area that's held dearly by all Capetonians. This is where they come on weekends. This is the road they walk down. This is where recreation and entertainment facilities are. It's by the beach. It is near the mountain,' he said.
